ABSTRACTThis article attempts to situate the Office on Missing Persons (OMP) in Sri Lanka in relation to varying approaches to mechanisms for searching for the missing. In particular, the article examines the possible tensions between a humanitarian and an accountability-based mandate and supports the position of the International Committee of the Red Cross that these two approaches can in fact be complementary in nature. It goes on to contend that the OMPs mandate is primarily humanitarian rather than exclusively humanitarian, and analyzes how this distinction may impact possible criminal prosecutions. It emphasizes the importance of preserving the humanitarian character of the OMP with the objective of ensuring that the victimsrights are at the centre of transitional justice processes."

"Skripsi ini membahas persetujuan tertulis Presiden dalam pemanggilan dan permintaan keterangan terhadap anggota Dewan Perwakilan Rakyat Republik Indonesia (DPR RI) yang diduga melakukan tindak pidana dengan menganalisis Putusan Mahkamah Konstitusi No. 76/PUU-XII/2014. Skripsi ini juga menjabarkan persetujuan tertulis dalam penyelidikan dan penyidikan yang diberlakukan bagi pejabat publik lainnya di Indonesia serta beberapa negara lain. Penelitian ini adalah penelitian yuridis normatif dengan analisa data kualitatif. Hasilnya, pertimbangan dalam Putusan Mahkamah Konstitusi No. 76/PUU-XII/2014 tidak konsisten, baik terhadap putusan Mahkamah Konstitusi sebelumya maupun terhadap pertimbangan lain dalam putusan tersebut.
The focus of this study is President?s written authorization in summoning and questioning of parliamentary member of Republic of Indonesia that suspected commiting a criminal act by analyzing Constitutional Court's Decision No. 76/PUU-XII/2014. This study also explain about written authorization in criminal proceedings of other public officials in Indonesia and other states. This study categorized as normative legal study with qualitative data analysis. The result of this study proves that the consideration of Constitutional Court's Decision No. 76/PUU-XII/2014 is inconsistent with Constitutional Court's previous decision and other consideration within this decision."Lengkap +
