Cosmopolitanism, as an intellectual and political project, has failed. The portrayal of human rights, especially European, as evidence of cosmopolitanism in practice is misguided. Cosmopolitan theorists point to the rise of claims-making to the European Court of Human Rights (ECtHR) among Europe's Muslims to protect their right to religious freedom, mainly concerning the hijab, as evidence of cosmopolitan justice. However, the outcomes of such claims-making show that far from signifying a cosmopolitan moment, European human rights law has failed Europe's Muslims. Human Rights, Islam and the Failure of Cosmopolitanism provides an empirical examination of claims-making and government policy in Western Europe focusing mainly on developments in the UK, Germany, France, Italy and the Netherlands. A consideration of public debates and European law of conduct in the public sphere shows that cosmopolitan optimism has misjudged the magnitude of the impact claims-making among Europe's Muslims. To overcome this cul-de-sac, European Muslims should turn to a new 'politics of rights' to pursue their right to religious expression. This eye-opening book will be of interest to undergraduate and postgraduate students studying subjects such as Sociology, Human Rights, Minority Rights, Cosmopolitanism and Ethnic and Racial Studies

ABSTRAK
Nationalism provides foundation for the love of one's nation. This feeling is based on the shared history and mutual purpose for the future, which stand on solidarity and feeling of unity in a certain group. However, nationalism can often be used as justification for national fanaticism that sacrifice the interests of other groups or other nations. A new interpretation of nationalism in the cosmopolitan era is needed, where interdependence between nations and groups become a concrete and factual reality, and at the same time, the consciousness that human as an integral part of universal order is increasing. This article is an effort to place nationalism in the cosmopolitan framework, which puts highest importance on struggle to create tolerance, solidarity and social equality.

Based on data from fieldwork in Flores, this article suggests an indigenous form of tolerance and suppleness as the model for a new form of multiculturalism in Indonesia. Many studies of nationalism have criticized the perspective that developing nation-states need 'strong nationalism. However, if we step out of this hegemonic preoccupation, we come to realize that the relevant question is not how Indonesia can keep its unity but on what conditions Indonesia can function well as a politico-economic system, keeping diverse areas incorporated in the post-modern and global contexts at present and in the future. In Flores, people have been traversing real and imagined borders since the time of the Austronesian migration and the age of Southeast Asian maritime commerce. Even after independence, Flores has had direct transnational linkage through the Catholic network and recently quite a few Catholic priests and candidates from Flores have been sent abroad. Due to the development of global capitalism, many people from mountainous areas in central Flores also go to Malaysia as low-paid labourers, and they accommodate well to the new situations. As illegal labourers, Florenese people develop social ties with the people whom they meet overseas. Even when they are arrested and forced to come home from Malaysia, they are never stigmatized in their home village. I would like to name tentatively this principle of social adaptability and political flexibility, which also orders life in Florenese villages, 'Austronesian cosmopolitanism'. I further suggest that this Austronesian principle of political flexibility could prove a useful model for the Indonesian nation-state as it struggles to adopt a new political model that prevents the escalation of retaliatory violence and allows the country to continue as a politico-economic unit

The discourse of cosmopolitanism and nationalism reflects the tension of the flow of globalization in the process of uniting and separating, in the commitment to facilitating and abrupt cancelation. The paper uses the arguments posed by Charles Taylor to suggest a new alternative to analyze, and to respond to the phenomenon of globalization. The four topics of the discussion are pluralism, autonomy vs. authenticity, neutrality on the part of the state, and authenticity as a new component in liberalism.
