"One Village One Product (OVOP) merupakan program unggulan yang digagas oleh Pemerintah Jepang sebagai proyek untuk memajukan perekonomian suatu desa dengan menonjolkan produk lokalnya yang khas. Program ini sudah banyak diadopsi oleh beberapa negara dengan tujuan yang sama, termasuk Indonesia. Pengembangan program OVOP di Indonesia tidak terlepas dari peranan Hak Kekayaan Intelektual. Pengembangan program OVOP difokuskan bagi para pelaku usaha dalam skala kecil dan menengah (UKM) yang banyak tersebar di Indonesia, dimana mereka perlu memperoleh perlindungan hukum terkait HKI, terutama dalam hal penggunaan merek sebagai identitas produknya. Namun temuan di lapangan mengindikasikan bahwa masih banyaknya kendala yang dihadapi UKM dalam pendaftaran merek, dengan demikian UKM perlu disosialisasikan mengenai penggunaan merek kolektif sebagai salah satu jalan keluar permasalahan.

One Village One Product (OVOP) is a flagship program, initiated by the Government of Japan, as a project to promote the economy of a village with a distinctive feature local products. This program has been widely adopted by several countries with the same purpose, including Indonesia. Development of OVOP program in Indonesia cannot be separated from the role of Intellectual Property Rights. OVOP program development focused for business on small and medium scale enterprises (SMEs) throughoutIndonesia, where they need to obtain IPR-related legal protections, especially in terms of the use of the brand identity products. However, findings from the reak activities indicate that there are still many obstacles faced by SMEs in the registration of the brand, so SMEs need to be disseminated on the use of collective brand as one way out of the problem."

"The topic of this paper is to describe the defining criteria of originality of song works. The aspectof originality is important to make such work be protected by Copyright Law. In this research, thecriteria to define originality are based on certain doctrines and/or theories of originality that mayvary case by case. The use of such doctrines and/or theories is necessary, since the stipulationsregarding originality in the Indonesian Copyright Act has not been considered suffice. Withregard to the song works, the criteria of originality may be different from other works. Therefore,a comprehensive research on the characteristics of song as a work is also important. This researchis a qualitative research with prescriptive design. The research depicts the use of certain doctrinesand/or theories as supplementary provisions to the Copyright Law in defining the originality ofsongs, which have specific characteristics resulted from their author’s creations and intellectuals.Topik makalah ini adalah untuk menggambarkan kriteria yang menentukan orisinalitas karyalagu. Aspek orisinalitas penting untuk membuat pekerjaan tersebut dilindungi oleh Undang-Undang Hak Cipta. Dalam penelitian ini, kriteria untuk menentukan keaslian didasarkan padadoktrin dan / atau teori orisinalitas yang mungkin berbeda kasus per kasus tertentu. Penggunaandoktrin dan / atau teori-teori tersebut diperlukan, karena ketentuan mengenai orisinalitasdalam UU Hak Cipta Indonesia belum dianggap cukup. Berkenaan dengan karya-karya lagu,kriteria orisinalitas mungkin berbeda dari karya-karya lain. Oleh karena itu, penelitian yangkomprehensif tentang karakteristik lagu sebagai karya juga penting. Penelitian ini merupakanpenelitian kualitatif dengan desain preskriptif. Penelitian ini menggambarkan penggunaandoktrin dan / atau teori ketentuan tambahan Undang-Undang Hak Cipta dalam menentukankeaslian lagu, yang memiliki karakteristik tertentu yang dihasilkan dari kreasi penulisnya danintelektual tertentu."

"The conception of Intellectual Property Right (IPR) is generally misunderstood by among common people. In order to obtain a more comprehensive understanding of IPR, we may as well start with the most dominant point of view, namely that from the perspective of the State and Government.This point of view is dominant because the State and Government are the institutions which havethe authority to make law, to implement law and to interpret the law in the various forms of itsimplementation. A study of IPR can be taken from wider view, as cultural perspectivetake the approach of looking at various events related to the implementation of the laws concerned. It also provide various situations to analyze related to the implementation of Copyright Law in various regions all over Indonesia.Within current situation, after Indonesia has ratified the WTO/TRIPs, the consequence now is binding, politically, legally and economically, although we may freely provide the needs of our people, in this case : IPR protection system. There are of course many other things in the spirit of the Constitution and the Indonesian nation that can be explored further and applied in the IPR protection system. In the end, IPR as the part of the culture can be developed further by taking into consideration and looking into possibility that much suitable to the needs of Indonesian respective communities."
