Abstrak :
This unique publication offers a complete history of Roman law, from its early beginnings through to its resurgence in Europe where it was widely applied until the eighteenth century. Besides a detailed overview of the sources of Roman law, the book also includes sections on private and criminal law and procedure, with special attention given to those aspects of Roman law that have particular importance to today's lawyer. The last three chapters of the book offer an overview of the history of Roman law from the early Middle Ages to modern times and illustrate the way in which Roman law furnished the basis of contemporary civil law systems. In this part, special attention is given to the factors that warranted the revival and subsequent reception of Roman law as the ‘common law’ of Continental Europe. Combining the perspectives of legal history with those of social and political history, the book can be profitably read by students and scholars, as well as by general readers with an interest in ancient and early European legal history. The civil law tradition is the oldest legal tradition in the world today, embracing many legal systems currently in force in Continental Europe, Latin America and other parts of the world. Despite the considerable differences in the substantive laws of civil law countries, a fundamental unity exists between them. The most obvious element of unity is the fact that the civil law systems are all derived from the same sources and their legal institutions are classified in accordance with a commonly accepted scheme existing prior to their own development, which they adopted and adapted at some stage in their history. Roman law is both in point of time and range of influence the first catalyst in the evolution of the civil law tradition.

Abstrak :
Tujuan dari penelitian tesis ini adalah untuk menjajaki faktor-faktor yang memengaruhi perilaku knowledge codifiication di konsultan pelatihan ABC Institute. Penelitian dilakukan secara kualitatif terhadap para analis di ABC Institute dengan menggunakan focus group discussion. Daftar pertanyaan di dalam focus group discussion mengacu pada 3 dimensi yang memengaruhi knowledge codification berdasarkan theory of planned behavior, yaitu attitude, subjective norms, serta perceived behavioral control (Ajzen, 1991). Hasil penelitian menemukan beberapa faktor penting yang dapat meningkatkan maupun menghalangi perilaku knowledge codification di ABC Institute. Berdasarkan hasil tersebut dirancanglah intervensi teknostruktural berupa implementasi struktur organisasi hypertext ( Nonaka & Takeuchi, 1995) yang digabungkan dengan proses pengembangan produk baru menggunakan model Stage-Gate (Cooper, 2001). ...... The objective of the thesis research was to explore factors influencing knowledge codification behavior in training consultant ABC Institute. The research was conducted qualitatively using focus group discussion. The list of questions in the focus group discussion consisted of three dimensions based on the theory of planned behavior; i.e attitude, subjective norms, and perceived behavioral control (Ajzen, 1991). The research finds some critical factors influencing knowledge codification behavior in ABC Institute. Based on the result, a technostructural intervention was designed. The proposed intervention was implementation of hypertext organization (Nonaka & Takeuchi, 1995) combined with the new product development process using Stage-Gate model (Cooper, 2001).

ABSTRAK
The Dutch Penal Code entered into force on September 1, 1886. Since then many parts of the Dutch Penal Code have been discussed. This article does not intend to provide an integral systematic overview of the Dutch Penal Code and the many changes it has been subjected to, but examines (in the first part of this article) it generally, with the aim of showing various arguments for a more thorough review of the Dutch Penal Code. Recognizing the need for revision of the Penal Code, the question arises as to what is meant by a revision. More clarity on what is meant by revising a Penal Code is necessary to prevent failure therein as a result of terminological ambiguity or carelessness. In the second part of this article three manners in which a Penal Code may be revised are described. They are: modification, integral revision, and re-codification.

Abstrak :
Tesis ini membahas tentang pengaruh keterikatan karyawan terhadap knowledge transfer sebagai faktor identifikasi dalam penelitian. Penelitian ini menggunakan analisa kuantitatif dan kualitatif dengan mengembangkan prinsip-prinsip knowledge management dalam penyusunan program pengembangan intervensi di PT. GYI. Hasil penelitian ini menunjukan adanya hubungan yang positif antara variabel penelitian dengan hasil kategorisasi responden dari kowledge transfer berada pada kategori sedang dan hasil uji konstruk yang dihasilkan menunjukan knowledge codification dengan nilai rata-rata terendah. Bentuk rekomendasi yang diusulkan adalah perubahan struktur organisasi guna memfasilitasi komunikasi horizontal yang dibantu dengan KM-Tools PDCA (Plan Do Check Action) dalam meningkatkan knowledge transfer dan knowledge codification di divisi manufaktur PT. GYI guna meningkatkan kinerjanya dengan berfokus pada intervensi Human Resources Management Practice. ......This thesis focused on the influence of employee engagement on knowledge transfer as the identification factor of this research. Quantitative and qualitative study used to develop intervension program at PT. GYI with knowledge management principles. Result of this research showed a positive relationship between variables with the categorization of the respondents on knowledge transfer in medium rate and constructs analysis shown knowledge codification in the lowest mean. Proposed recommendations is change in organization structure to facilitate horizontal communication and using KM-Tools PDCA (Plan Do Check Action) method to improve knowledge transfer and knowledge codification in manufacturing division PT. GYI to improve it's performance by focusing on interventions in Human Resources Management Practice.

Abstrak :
Sunah Rasulullah saw. merupakan sumber ajaran Islam kedua. Pemeliharaan sunah diserahkan sepenuhnya kepada umat, yaitu dengan mengabadikan ucapan, perbuatan dan tagrir beliau, atau disebut hadis. Upaya ini dilakukan turun-temurun dalam bentuk periwayatan hingga pengkodifikasiannya pada abad kedua hijriyah. Namun, ada saja ketidak-akuratan dalam periwayatan. Karenanya, para ulama berupaya menyeleksinya. Muncullah pembagian hadis menjadi tiga; sahib, hasan dan daif. Hadis sahih dan hasan memiliki keakuratan tinggi sebagai bentuk pengejawantahan sunah Rasulullah saw., hal ini tidak berlaku bagi hadis daif. Namun, ternyata dijumpai ulama yang menggunakan hadis daif sebagai hujah dan pengejawantahan sunah beliau. Penelitian ini menghasilkan kesimpulan bahwa pada selain bidang akidah, hadis daif juga digunakan sebagai hujah. Dalam bidang hukum, hadis daif dijadikan hujah dengan syarat: diterima dan diamalkan; dikenal imam-imam hadis tanpa ada yang mengingkarinya; dan sesuai dengan salah satu ayat Alquran atau dasar syariat. Selain hadis daif, amalan penduduk Madinah yang bersifat naqli dijadikan sebagai hujah. Dalam bidang akhlak/fadlail al-a'mal, hadis daif bisa digunakan dengan syarat: tidak terlalu lemah; tema hadis tergolong tema yang ditetapkan dalil yang diamalkan; dan pada saat mengamalkannya, tidak berkeyakinan bahwa ia berasal dari Nabi Saw., tetapi sebagai sikap berhati-hati. The Authority of Hadis Sahih in Exclamation of Passages of Sunah Rasulullah Saw. Sunah Rasulullah saw. is second resource of Islam teaching. The conservancy of Sunah is delivered fully to people, that is by immortalizing utterance, deed and his tagrir, or referred by hadis. This effort was done in the way of narrative till finally emerge the effort to codification of hadis in the second century of hijriyah. But, in the effort continuation the hadis there are invalid narratives. So that, the muslims scholar have effort to select it. Hence, emerging the divede of hadis become three; sahih, hasan and daif. Sahih hadis and hasan hadis have high accuracy as sunah Rasulullah saw. personification form, this not applicable matter to daif hadis. But, practically met many moslem scholar using daif hadis as hujah and making it as his sunah personification. This research yield conclusion that daif hadis also used as hujah, besides akidah area. In the field of law, daif hadis used as hujah on condition that: accepted and practiced; recognized by among hadis imam without there isn't disobeying it; and as according to one of the Alquran sentence or syariat bases. Despitefully, there are also using Madinah resident deed having the character of as hujah. In the field of behavior/ fad/rill al-a'mal, daif hadis can be used on condition that: do not too weak; the hadis theme still classified into theme which have been specified by theorem which have been practiced; and at the time of practicing it, do not convince of that he come from Prophet saw., however believing that it is as attitude take a care.
