Abstrak :
Pada tahun 1998 perekonomian Indonesia mengalami kemerosotan dan menyebabkan krisis kepercayaan masyarakat terhadap lembaga perbankan. Sehingga perlu dibuka kemungkinan yang lebih besar bagi masuknya modal asing melalui pembelian saham bank umum dengan tetap mempertahankan prinsip kemitraan. Selanjutnya dibuatlah Peraturan Pemerintah Nomor 29 Tahun 1999 tentang Pembelian Saham Bank Umum. Namun peraturan tersebut dinilai sebagai keterbukaan yang terlalu over. Kemudian Bank Indonesia (BI) meluncurkan aturan kepemilikan saham bank umum melalui Peraturan Bank Indonesia (PBI) Nomor 14/8/PBI/2012 tentang Kepemilikan Saham Bank Umum. Peraturan ini dibuat guna meningkatan ketahanan perbankan melalui peningkatan penerapan prinsip kehati-hatian dan tata kelola bank yang baik (good corporate governance). Penelitian ini adalah penelitian yuridis normatif yang menggunakan pendekatan peraturan perundang-undangan dan pendekatan perbandingan. Hasil penelitian menyarankan untuk Peraturan yang mengatur mengenai kepemilikan saham perbankan seharusnya mempunyai kesetaraan agar peraturan tersebut dapat memenuhi kepastian hukum dan sejalan dengan itu Bank Indonesia harus berkoordinasi dengan Otoritas Jasa Keuangan dalam hal pengawasan terhadap bank.

In 1998, the Indonesian economy was in decadence and caused a public confidence crisis towards banking institutions. Therefore, the greater possibility for the entry of foreign capital through the purchase of commercial banks shares needed to be opened while maintaining the principle of partnership. Furthermore, the Government Regulation No. 29 of 1999 concerning the Purchase of Commercial Bank Shares was formed. However, this regulation is rated as an over openness.Bank Indonesia (BI) had launched a commercial bank share ownership rules through Bank Indonesia Regulation (PBI) No. 14/8/PBI/2012 concerning Shares Ownership in Commercial Bank. This regulation was made in order to increase the bankingresilience through the implementation enhancement of the precautionary and bank good governanceprinciples. This research is a normative juridical which applying the legislation and the comparative approaches. The research result suggests that regulation which ruled the ownership of bank shares should have equality in order to meet the legal certainty and Bank Indonesia should coordinate with the Financial Services Authority in terms of bank supervisio.

Disamping memberikan hasil-hasil positif, kebijakan liberalisasi perbankannasional juga mengakibatkan akuisisi bank-bank lokal berskala nasional oleh parainvestor asing dengan kepemilikan saham sampai dengan 99 sembilan puluhsembilan persen. Ketidaksiapan bank-bank milik pemerintah dalam menghadapikompetisi regional berdasarkan kepemilikan aset, perbedaan kebijakan perbankandi negara-negara anggota ASEAN lainnya, harmonisasi dan kodifikasi peraturanperbankan nasional dan semakin dekatnya implementasi kesepakatan SingleMarket Policy merupakan permasalahan yang harus segera mungkin diselesaikanoleh pemerintah agar tercipta tata kelola yang baik, persaingan yang adil dankompetisi yang sehat di sektor perbankan nasional menuju Single Market PolicyIntegrasi Regional Masyarakat Ekonomi ASEAN Tahun 2020.
......In addition to providing positive results, national banking liberalization policy also resulting in acquisition of local nationwide banks by foreign investors withshareholding until 99 ninety nine percent. Unpreparedness of state ownedbanks facing the regional competition based on asset, the differences of bankingpolicies amongst ASEAN country members, harmonization and codification ofnational banking policy and the steady progression of single market policyimplementation are problems that government should be solved to improve bankgovernance, fair and healthy competition in the national banking sector towardsregional integration of single market policy of ASEAN economic community in2020.

banking liberalization process has begun since retification of General Agreement on Trade in Services (GATS) Possibly access for foreign investor into Indonesia banking open through such ways as: establishing a new bank, purchasing of bank's share and erecting of bank's branch and representative. According to current regulation foreigners who want to open a new bank should not be in form of bank as formerly regulated, but it can be as individual and as foreign non-bank entity. No more restriction regarding foreign ownership of mayority bank's shareholder. Through Government Regulation No. 29 year of 1999 concerning of purchasing general bank's share and Bank of Indonesia regulation No.2/27/PBI/2000 regarding general bank have arranged that maximum foreign ownership over general bank is 99% of the capital paid by general bank. The foreign ownership of bank is not only open through stock market but also by direct purchasing of share. Foreign domination on national bank is now rampant through such ways as acquisition, merger and or consolidation. The question is what's the relevancy amongst banking consolidation policy, single presence policy and foreign domination on Indonesia national bank?
