"PMH yang dilakukan debitur pada perjanjian kredit mengakibatkan batalnya lelang eksekusi hak tanggungan seperti yang terjadi pada kasus dalam Putusan Mahkamah Agung Nomor 664PK/PDT/2020. Pembatalan lelang tersebut memberikan dampak hukum tertentu bagi para pihak dalam hal ini pemilik objek lelang yang sebenarnya, pembeli lelang, dan kreditur. Oleh karena itu, penelitian ini dilakukan untuk mengangkat permasalahan terkait (1) perbuatan melawan hukum yang menjadi dasar pembatalan lelang; dan (2) perlindungan terhadap para pihak yang dirugikan dalam rangkaian peristiwa penguasaan hak atas tanah. Penelitian hukum ini merupakan penelitian doktrinal dengan tipe penelitian eksplanatoris. Hasil penelitian adalah sebagi berikut: (1) pemalsuan identitas debitur dikategorikan sebagai PMH dan dapat dijadikan alasan untuk melakukan pembatalan lelang; dan (2) bentuk perlindungan hukum bagi pemilik obyek lelang adalah berupa hak untuk mengajukan tuntutan kepada Pengadilan untuk membatalkan lelang; sedangkan bentuk perlindungan hukum bagi pembeli lelang (yang beritikad baik) adalah hak untuk mendapatkan kembali uang pembayaran atas obyek lelang yang dimenangkannya; untuk kreditur, berhak mengajukan tuntutan ke pangadilan atas pemalsuan identitas debitur dan membayarkan sejumlah ganti rugi. The unlawful act committed by the debtor in the credit agreement resulted in the cancellation of the mortgage execution auction as happened in the case in the Supreme Court Decision Number 664PK/PDT/2020. The cancellation of the auction has certain legal impacts on the parties, in this case the actual owner of the auction object, the auction buyer and creditors. Therefore, this research was conducted to raise issues related to (1) unlawful acts which are the basis for canceling auctions; and (2) protection for parties who are harmed in a series of land rights control events. This legal research is a doctrinal research with an explanatory research type. The results of the research are as follows: (1) forgery of the debtor's identity is categorized as unlawfull act and can be used as a cause for canceling the auction; and (2) the form of legal protection for the owner of the auction object is in the form of the right to submit a claim to the Court to cancel the auction; while the form of legal protection for auction buyers who have good intentions is the right to get back the settlement for the auction object won; for the creditor, has the right to file a lawsuit against the court for fabricate the identity of the debtor and paying a sum of compensation. Therefore, suggested to the parties that involved in the auction to apply the precautionary principle and cooperate with the Directorate General of Population and Civil Registration and the Land Office to background check of land ownership. In addition, judges in handling similar cases should be guided by SEMA No. 7/2012 to protect auction winners as buyers with good faith."

Bagaimana upaya menciptakan asas efisiensi dan asas kompetisi terhadap pelaksanaan lelang online pesawat ex Pelita Air pada Kantor Pelayanan Kekayaan Negara dan Lelang Serpong? Penelitian ini menggunakan metode yuridis normatif, dengan menggunakan data sekunder dan menggunakan metode analisis data kualitatif, karena data yang diperoleh bersifat kualitas.Hasil penelitian menyatakan penerapan asas efisiensi dan asas kompetisi dalam pelaksanaan lelang online pesawat ex Pelita Air pada Kantor Pelayanan Kekayaan Negara dan Lelang Serpong tidak terjadi, khususnya bagi peserta lelang yang berasal dari luar negeri. Hal tersebut dikarenakan adanya ketentuan dalam Pasal 34 ayat (2) Peraturan Menteri Keuangan Republik Indonesia Nomor 27/PMK.06/2016 Tentang Petunjuk Pelaksanaan Lelang yang mengatur kewajiban Peserta Lelang menunjukkan NPWP, sehingga membuat peserta lelang dari luar negeri dengan terpaksa membutuhkan badan hukum di Indonesia sebagai perwakilannya, yang pada akhirnya adalah tidak terciptanya asas efisiensi dan asas kompetisi. Upaya menciptakan asas efisiensi dan asas kompetisi terhadap pelaksanaan lelang online pesawat ex Pelita Air pada Kantor Pelayanan Kekayaan Negara dan Lelang Serpong, yaitu materi peraturan perundang-undangan dengan memperhatikan keadilan bagi seluruh peserta lelang.

The provision on the necessity of NPWP for internet auction participants (online auction) becomes counter productive for bidders who are not Indonesian citizens, because it will cause inefficiency in the implementation of online auction. Problems in this research is how the application of the principle of efficiency and the principle of competition in the implementation of online auction airplane ex Pelita Air at State Service Office and Serpong Auction? How is the effort to create the principle of efficiency and the principle of competition on the execution of online auction aircraft ex Pelita Air on State Wealth Office and Serpong Auction? This study uses normative juridical method, using secondary data and using qualitative data analysis method, because the data obtained is quality. The result of research stated that the application of efficiency principle and competition principle in the execution of online auction of airplane ex Pelita Air at State Service Office and Serpong Auction does not happen, especially for bidders coming from abroad. (2) Regulation of the Minister of Finance of the Republic of Indonesia Number 27 / PMK.06 / 2016 Concerning the Auction Implementation Guidelines which regulates the obligation of Bidders to indicate NPWP, thus making the auction participants from abroad is forced to require legal entity in Indonesia as its representative, which in the end is not the creation of the principle of efficiency and the principle of competition. Efforts to create the principle of efficiency and the principle of competition on the implementation of online auction aircraft ex Pelita Air at the Office of State Assets and Auction Serpong, the material legislation with regard to fairness for all bidders."
