Abstrak :
[Tesis ini membahas tentang kedudukan hukum wakaf tanah yang tidak dituangkan dalam akta ikrar wakaf apabila terjadi pembatalan wakaf. Wakaf tanah yang tidak dituangkan dalam akta ikrar wakaf memiliki kemungkinan yang besar timbulnya sengketa di kemudian hari. Pada saat wakif mengucapkan ikrar wakaf, maka wakif telah menyerahkan harta benda miliknya untuk selama-lamanya untuk kepentingan umum. Dengan demikian secara hukum wakif tidak lagi mempunyai hak atas harta yang menjadi objek wakaf pada saat wakif menyatakan ikrar wakaf. Metode Penelitian yang penulis gunakan dalam penelitian ini adalah yuridis normatif, yaitu penelitian yang hanya dilakukan dengan cara meneliti terhadap asas-asas baik tertulis ataupun tidak tertulis. Hasil penelitian menunjukkan bahwa wakaf yang tidak dituangkan dalam akta ikrar wakaf telah sah menurut Hukum Islam karena telah memenuhi syarat dan rukun wakaf, namun dari segi pembuktiannya pemberian wakaf tersebut tidak diakui menurut Hukum Negara karena tidak memenuhi ketentuan sebagaimana diatur dalam Undang-Undang Nomor 41 Tahun 2004 tentang Wakaf. Berdasarkan Pasal 3 Undang-Undang Nomor 41 Tahun 2004 tentang Wakaf, menyatakan bahwa wakaf yang telah diikrarkan tidak dapat dibatalkan.

Waqf land that is not stated in the deed of pledge endowments have a greater chance of the emergence of disputes in the future. At the time of the oath wakif endowments, then wakif has submitted his property in perpetuity for the public interest. Thus legally wakif no longer has rights to the property which is the object of waqf upon wakif states pledge endowments. Research methods that I use in this research is normative, the research that is only done by examining the principles either written or unwritten. Penelitian ini membahas mengenai keabsahan perwakafan tanah yang tidak diikuti pembuatan Akta Ikrar Wakaf di hadapan pejabat yang berwenang dalam Putusan Pengadilan Agama Pringsewu Nomor 0115/Pdt.G/2019/PA.Prw. Dalam kasus ini Wakif dan Nazhir melakukan perjanjian perwakafan tanah hanya secara dibawah tangan pada tahun 2008. Selama lebih kurang 10 tahun Nazhir sebagai pengelola tanah wakaf belum membuat Akta Ikrar Wakafnya di hadapan Pejabat Pembuat Akta Ikrar Wakaf (yang selanjutnya disebut PPAIW), sehingga status tanah wakaf belum memiliki kejelasan. Pokok permasalahan yang dibahas dalam tesis ini adalah keabsahan perwakafan tanah yang tidak diikuti pembuatan Akta Ikrar Wakaf di hadapan PPAIW serta perlindungan hukum terhadap Nazhir dalam perwakafan tanah tersebut. Metode penelitian yang digunakan adalah metode yuridis normatif. Tipologi yang digunakan dalam penelitian ini adalah penelitian preskriptif. Adapun hasil dari penelitian ini, perwakafan tanah yang dilakukan tanpa pembuatan Akta Ikrar Wakaf di hadapan PPAIW dalam kasus ini tidak sah, karena tidak terpenuhinya unsur harta benda wakaf. Surat Penguasaan Fisik Bidang Tanah atau Surat Keterangan Tanah (yang selanjutnya disebut SKT) sebagai bukti pemenuhan unsur harta benda wakaf baru terbit pada tahun 2016, sementara perwakafan tanah dilakukan pada tahun 2008. Hal tersebut melanggar syarat suatu sebab yang halal. Nazhir dalam kasus ini tidak dapat diberikan perlindungan hukum. Hal ini karena meskipun masih ada kemungkinan dapat disahkannya perwakafan tanah tersebut agar lahir perlindungan hukum bagi Nazhir, namun Nazhir dalam pelaksanaan perjanjian wakaf terbukti telah melanggar asas iktikad baik dalam perjanjian.
......This study discusses The Legality Of Land Waqf Which Is Not followed By The Making Of A Waqf Pledge Deed Before Authorized Official in the Pringsewu Religious Court Decision Number 0115/Pdt.G/2019/PA.Prw. In this case, Wakif and Nazhir entered into an underhanded land waqf agreement in 2008. For approximately 10 years Nazhir as waqf land manager has not made his Waqf Pledge Deed in front of the Waqf Pledge Deed Official (hereinafter referred to as PPAIW), so the status of the waqf land do not have yet. The main issues discussed in this thesis are the validity of the land waqf which is not followed by the making of the Waqf Pledge Deed before PPAIW and the legal protection of Nazhir in the land waqf. The research method used is the normative juridical method. The typology used in this research is prescriptive research. As for the results of this study, land waqf which is carried out without making a Waqf Pledge Deed before PPAIW in this case is not valid, because the elements of waqf property are not fulfilled. Physical Control of Land Sector or Land Certificate (hereinafter referred to as SKT) as evidence of fulfillment of waqf property elements was only issued in 2016, while land waqf was carried out in 2008. This violates the requirements for a lawful cause. Nazhir in this case cannot be given legal protection. This is because although there is still the possibility that the land waqf can be legalized so that legal protection is born for Nazhir, Nazhir in the implementation of the waqf agreement is proven to have violated the principle of good faith in the agreement.
