In 2016, DKI Jakarta Provincial Government has launched Transjakarta Cares as a special service for people with disabilities in accessing Transjakarta services. Transjakarta Cares service act as the fulfillment of accessibility to transportation in DKI Jakarta which is known to be very minimal (LBH Jakarta, 2015). Nevertheless, in its implementation, the Transjakarta Cares service received complaints from people with disabilities regarding the difficulty of getting access to the Transjakarta Cares services. This thesis analyzes the access of Transjakarta Cares services for people with disabilities in DKI Jakarta Province by adopting the theory of access proposed by Peters et al. (2008). The research approach used is post-positivist. The data collection techniques used are in-depth interviews conducted with various key stakeholders, including local governments, PT Transjakarta, and individuals and community disabilities as the primary data, as well as direct observation of the Transjakarta Cares service process and literature study as the secondary data. The results of this study show that the complex issues found greatly affect the failure of 8 of the 12 measured indicators, namely physical distance affordability indicators, fleet availability indicators, availability of supporting equipment indicators, the availability of service guidance indicators, economic consequences for service users indicator, economic consequences for service providers indicator, and acceptance indicator for Contact Center services, and service characteristics indicators. With the forenamed problems, operational governance, resource capacity, and economic policy frameworks to the scope of Transjakarta Cares services need improvement.
Skripsi ini meneliti terkait dengan kebijakan yang dibuat oleh PT. Transportasi Jakarta dalam menerapkan satu jenis dompet elektronik, yaitu AstraPay sebagai metode pembayaran tiket bus Transjakarta melalui aplikasi Tije. Kebijakan tersebut memberikan celah dugaan adanya praktek monopoli berupa diskriminasi sebagaimana yang diatur dalam ketentuan Pasal 19 huruf (d) Undang-Undang Nomor 5 Tahun 1999 dan apa konsekuensi hukum yang dapat dijatuhkan kepada PT. Transportasi Jakarta berdasarkan ketentuan Peraturan Pemerintah Nomor 44 Tahun 2021 Tentang Pelaksanaan Larangan Praktek Monopoli dan Persaingan Usaha Tidak Sehat. Metode penelitian yuridis-normatif digunakan dalam penelitian ini dengan dilengkapi penggunaan jenis data sekunder yang terdiri dari bahan hukum primer, sekunder dan tersier serta penggunaan pendekatan rules of reason untuk melihat dampak yang ditimbulkan akibat dari pelanggaran yang terjadi. Dari penelitian yang telah dilakukan, didapatkan hasil bahwa tindakan PT. Transportasi Jakarta memenuhi seluruh unsur yang terdapat dalam Pasal 19 huruf (d) Undang-Undang Nomor 5 Tahun 1999 dan dampak yang ditimbulkan adalah masyarakat atau pengguna Transjakarta tidak memiliki pilihan jenis dompet elektronik selain AstraPay untuk melakukan pembayaran tiket bus Transjakarta melalui aplikasi Tije, sehingga disimpulkan bahwa PT. Transportasi Jakarta telah melanggar Pasal 19 huruf (d) Undang-Undang Nomor 5 Tahun 1999. ......This thesis examines the policies made by PT. Transportasi Jakarta is implementing one type of electronic wallet, namely AstraPay as a payment method for Transjakarta bus tickets via the Tije application. This policy provides a loophole for allegations of monopolistic practices in the form of discrimination as regulated in the provisions of Article 19 letter (d) of Law Number 5 of 1999 and what legal consequences can be imposed on PT. Transportasi Jakarta is based on the provisions of Government Regulation Number 44 of 2021 concerning the Implementation of Prohibitions on Monopoly Practices and Unfair Business Competition. The juridical-normative research method used in this research is complemented by the use of secondary data types consisting of primary, secondary, and tertiary legal materials as well as the use of a rules of reason approach to see the impacts caused by violations that occur. From the research that has been carried out, the results obtained are that the actions of PT. Transportasi Jakarta fulfills all the elements contained in Article 19 letter (d) of Law Number 5 of 1999 and the impact is that the public or Transjakarta users do not have a choice of electronic wallet other than AstraPay to make payments for Transjakarta bus tickets via the Tije application, so it is concluded that PT. Transportasi Jakarta has violated Article 19 letter (d) of Law Number 5 of 1999.
