Abstrak :
Tanah garapan adalah tanah kosong dan kemudian adanya penguasaan secara fisik tanpa adanya dasar hak yang resmi, notaris tidak akan membuat akta mengenai tanah garapan karena penggarap tidak punya hak apa pun terhadap tanah tersebut. Penelitian ini mengangkat permasalahan tentang bagaimana keabsahan surat pernyataan hak tanah garapan dan kewenangan notaris berkaitan dengan surat pernyataan oper hak atas tanah garapan berdasarkan putusan Mahkamah Agung Republik Indonesia nomor 122PK/PDT/2019. Untuk menjawab permasalahan tersebut, penelitian ini menggunakan pendekatan yuridis normatif. Dalam penelitian ini menggunakan data sekunder yang terdiri dari bahan hukum primer, bahan hukum sekunder dan bahan hukum tersier, penelitian ini menggunakan metode analisis data secara deskriptif analisis dengan pendekatan kualitatif. Hasil dari penelitian ini adalah Berdasarkan bukti kepemilikan tanah yang dimiliki oleh pemegang surat keterangan tanah/surat keterangan penguasaan tanah yang diterbitkan oleh Lurah/Kepala Desa yang disahkan oleh Kecamatan setempat berdasarkan Pasal 7 ayat (2), dan Pasal 39 Peraturan Pemerintah Nomor 24 Tahun 1997 tentang Pendaftaran Tanah, dapat dikategorikan sebagai alas hak yang diajukan sebagai kelengkapan persyaratan permohonan hak atas tanah dan Kewenangan Notaris melakukan waarmerking, merupakan tindakan hukum notaris atau pejabat umum lainnya yang berwenang menurut Undang-Undang, untuk mencatat dan mendaftarkan akta kontrak di bawah tangan yang telah dibuat oleh para pihak dalam daftar buku waarmerking yang disediakan khusus untuk itu sesuai dengan urutan yang ada. ......Cultivated land is empty land and then there is physical control without any legal rights basis, the notary will not make a deed regarding the cultivated land because the cultivator does not have any rights to the land. This research raises the problem of how the validity of the statement of cultivated land rights and the authority of a notary in relation to the operative statement on cultivated land based on the decision of the Supreme Court of the Republic of Indonesia number 122PK/PDT/2019. To answer this problem, this study uses a normative juridical approach. In this study using secondary data consisting of primary legal materials, secondary legal materials and tertiary legal materials, this study used a descriptive data analysis method with a qualitative approach. The results of this study are based on evidence of land ownership owned by the holder of a land certificate/certificate of land tenure issued by the Lurah/Village Head which is legalized by the local District based on Article 7 paragraph (2), and Article 39 of Government Regulation Number 24 of 1997. Regarding Land Registration, it can be categorized as the basis of rights filed as the completeness of the application for land rights and the Notary's Authority to perform waarmerking, is a legal action for a notary or other public official who is authorized according to law, to record and register contract deeds under the hands of those who have made by the parties in the waarmerking book list specially provided for it in accordance with the existing order.

In connection with the widespread occurence of the problem of land disputes that exist in Indonesia, on the basis of these facts the authors tried to examine the case of overlap (overlapping) that occured in Cilandak, South Jakarta between Fredy Gozali and Debby Yulita of land with buildings in Cilandak, South Jakarta, covering an area of 550 m2, This case stems from land state purchased by Debby Yulita of Robert Tumiwa under the Sale and Purchase Agreement Deed and Land Rights No. 56, dated on April 26, 2007 are made in the presence of R. John Sarwonom SH, Notary/PPAT in Jakarta, after that, Debby Yulita apply for rights to land to get a certificate of land rights on his behalf of Fredy Gozali. The problems are how the legal effect of the cancellation of certificate of land rights because of overlapping by the South Jakarta District Court No. 438.PDT.G/2008/PN.JKT.SEL, dated August 14, 2008 and how the responsibilities of the Land Office in South Jakarta municipality in solving problems of overlapping disputes that occured. Research used in research on the writing of this law is a legal research library that is judical normative, while the typology of research used in this study is descriptive prescriptive. This thesis are describe about the legal consequences that occured and responsibilities of the Land Office Municpality of South Jakarta after a case of overlap (overlapping) based on South Jakarta District Court that the status of the soil back into the ground state and do write-off on behalf of the Land Book Fredy Gozali and publishing rights certificate land of behalf of Debby Yulia.

Tanah merupakan kebutuhan dasar manusia sejak manusia tersebut lahir sampai dengan meninggal dunia, manusia senantiasa membutuhkan tanah sebagai tempat tinggal hidupnya, oleh karena itu dapat disimpulkan, tanah adalah tempat manusia tinggal, tempat darimana manusia berasal, dan juga tempat kemana mereka akan pergi. Studi kasus yang akan dibahas dalam tesis ini memaparkan tentang apa yang terdapat dalam teori belum tentu sepenuhnya benar, karena dalam Putusan Peninjauan Kembali Mahkamah Agung Republik Indonesia Nomor 582 PK/Pdt/2011 antara Perkumpulan Kelompok Tani Pemberdayaan Masyarakat Tani dan Nelayan Pesisir Pantai Kabupaten Mamuju Utara melawan PT. Unggul Widya Teknologi Lestari berakhir dengan kemenangan Pihak Kelompok Tani. Kelompok Tani ini memiliki tanah tersebut atas dasar lokasi dibuka sendiri maupun secara berkelompok yang berasal dari Tanah Negara seluas kurang lebih 2722 Ha (dua ribu tujuh ratus dua puluh dua hektar) sejak Tahun 1982 (seribu Sembilan ratus delapan puluh dua) yang terletak di Kabupaten Mamuju Utara, Propinsi Sulawesi Barat yang akhirnya dikukuhkan oleh Pemerintah Desa dan Kabupaten Mamuju pada Tahun 1994 yaitu dikeluarkannya SKP (Surat Keterangan Pemilikan Tanah), SKT (Surat Keterangan Tanah) dan Sporadik tentang Pemberian Hak Kepemilikan atas Tanah Negara, sedangkan PT. Unggul Widya Teknologi Lestari memiliki tanah tersebut berdasarkan Sertipikat HGU (Hak Guna Usaha) yang mendapatkan pengakuan dari Pemerintah Negara Republik Indonesia yang dikeluarkan oleh Badan Pertanahan Republik Indonesia Kabupaten Mamuju Utara. Seperti apakah kekuatan dan kepastian hukum yang diberikan oleh Hukum Negara Indonesia terhadap hak prioritas atas tanah bagi masyarakat adat setempat, khususnya dalam Putusan Peninjauan Kembali Mahkamah Agung Republik Indonesia Nomor 582 PK/Pdt/2011 dan apakah putusan Majelis Peninjauan Kembali sudah sesuai dengan kaidah-kaidah hukum yang berlaku. ......The soil is basic human needs since human beings are born to die, humans always need land as a place to live his life, therefore it can be inferred, the land is where humans live, a place where humans came from, and also the place where they will go.
