Abstrak :
It is quite often, wittingly or unwittingly, that people assume society, even the state, as person. They talk about society in a way as if it shares same attributes with human being: can be sick (as if it has body), can think (as if it has mind), can speak (as if it has mouth), for example. It is quite obvious that this gesture implies a view of society as an agglomeration of individuals. The problem arises around the legitimacy of this gesture: namely, to analogize the society as individuals always implies a logical leap. Things even get murkier when this gesture is applied even more to the way in which people recognize the state: as collectivities, as a ?big-person.? This gesture, which has methodological impact, is what the author call ?anthropomorphism analogy?. By doing what the author call psychogenealogy?a mixture of Lacanian psychoanalysis and Foucauldian genealogy, that is a way at seeing history as constituted by various contestation of materialization of desire?to the history of the modern state, namely, modern sovereign state, the author seeks to remedy this analogy with an objective account. The purpose is not to side with the analogy, but to prove that it is invalid not because it is scientifically inadequate, but that it is a true correspondence: state is person.

Penelitian ini bertujuan untuk mengevaluasi pengelolaan sumber daya mineral dan batu bara di Indonesia berdasarkan kedaulatan Negara dan Hak Menguasai Negara Negara sebagaimana diamanatkan di dalam Pasal 33 Ayat (3) UUD NRI 1945. Penulis mempergunakan metode penelitian yuridis normatif dengan studi kepustakaan. Hasil penelitian menunjukkan bahwa Pasal 33 Ayat (3) UUD NRI 1945 memberikan landasan konstitutional terhadap Negara untuk menguasai seluruh kekayaan alam yang ada di Indonesia, termasuk sumber daya mineral dan batu bara. Hak Menguasai Negara memberikan kewenangan kepada Negara untuk melakukan Pengelolaan secara langsung melalui mekanisme izin, pengurusan, pengaturan, pengendalian melalui mekanisme izin, dan pengawasan terhadap kegiatan pertambangan Minerba. Kewenangan tersebut merupakan kewenangan konstitutional Pemerintah Pusat dan merupakan bagian dari kedaulatan Negara atas sumber daya alam.

ABSTRACT
This research aims to evaluate the management of coal and mining sector in Indonesia based on the theory of state sovereignty and the rights of state control over natural resources as stated in Article 33 (3) of the 1945 Constitution of the Republic of Indonesia. The author uses juridical-normative research method, which is combined with literature studies. The research shows that Article 33 (3) gives a constitutional basis for the State to control all natural resources in Indonesia, including coal and mining. The rights of state control legitimates the State authority to perform a direct control over natural resources by conducting permits, management, legislation, control, and surveillance of mining activities. The authority to control natural resources is a constitutional authority that is given to the Indonesian central government as a manifestation of State sovereignty over natural resources.
