In 1944 the Chicago Convention set out the foundations of public international law regulating international air transport, but until 2016 no international agreement existed to limit its environmental impact. Sustainable Development, International Aviation, and Treaty Implementation explains why the CORSIA scheme, adopted by the International Civil Aviation Organization in 2016, should be implemented in 2020 even though the adequacy of this scheme is still open to doubt and criticism. This book seeks to examine the many dimensions of the effort to contain greenhouse gas emissions from aircraft in a manner consonant with the principles of sustainable development, and examines the development of international law and policy in an area that has remained largely outside the general framework of international environmental law. International civil aviation is a significant polluter of the atmosphere, and in this volume, a group of air law and sustainable development law specialists considers how the international community can respond.

Skripsi ini mengkaji keterlibatan Indonesia dengan hukum lingkungan internasional ndash; khususnya perubahan iklim ndash; di era pemerintahan Jokowi kini. Penilaian tersebut dilakukan dengan melihat rencana aksi nasional Nawacita, serta langkah-langkah pelaksanaan yang diambil oleh pemerintahan yang menunjukkan komitmen terhadap perkembangan hukum perubahan iklim internasional. Meskipun pemerintah saat ini tidak memiliki tangan langsung dalam negosiasi perubahan iklim pasca-2012 di bawah Konvensi Kerangka Kerja PBB tentang Perubahan Iklim UNFCCC dan Protokol Kyoto, beserta awal administrasi yang dimulai tahun 2014, adopsi Perjanjian Paris 2015 dapat menjadi indikator yang menunjukkan bahwa administrasi kini-lah yang sedang dan akan membentuk kebijakan yang mencerminkan tujuan dari perjanjian internasional tersebut.Mengingat kompleksitas dan luasnya lingkup negosiasi lingkungan pasca-2012, pembahasan dimulai dengan mendeskripsikan respon lima negara yang berbeda terhadap instrumen hukum internasional tentang perubahan iklim. Satu aspek utama daripadanya, yaitu mitigasi emisi gas rumah kaca, adalah isu sentral untuk negosiasi pasca-2012, serta prioritas bagi Indonesia di arena internasional sebagai negara penghasil emisi akibat deforestasi dan perubahan penggunaan lahan. Isu transboundary loss, dimana didalamnya termasuk haze kebakaran hutan, menjadi contoh paling signifikan.Akibat dari Perjanjian Paris 2015 belum sepenuhnya dieksplorasi. Namun, mengingat kesejarahan perubahan iklim sebagai isu global, serta perlunya ada perubahan paradigma yang dianut oleh masyarakat internasional dalam rangka pembangunan berkelanjutan, skripsi ini berpendapat bahwa kebijakan domestik Indonesia beserta instrument/sistem hukum tentu harus sedemikian rupa sehingga dapat menjadi landasan bagi tujuan yang lebih ambisius ke depan.
This thesis examines Indonesia rsquo s engagement with international environmental law more specifically, climate change ndash in the current Jokowi administration. The assessment is undertaken by examining the national action plan Nawacita, as well as the implementing measures taken by the administration that shows a commitment to the developments of international climate change law. Although the current administration may not have had a direct hand in the ldquo post 2012 rdquo negotiations of climate change under the United Nations Framework Convention on Climate Change and the Kyoto Protocol seeing that it rsquo s term of office started in 2014, the adoption of the 2015 Paris Agreement proves that the administration will be responsible for shaping policies that reflect the aims of the ldquo ambitious and balanced plan rdquo of the agreement.Given the complexity and breadth of issues addressed by the post 2012 negotiations, this thesis chooses to draw comparisons between State responses to regime. Additionally, it focuses on one major aspect of the negotiations, namely, the mitigation of greenhouse gas emissions. This was the central issue for the post 2012 negotiations to resolve, as well as the key negotiating priority of Indonesia as a significant emitter of greenhouse gases due to deforestation and land use change. The thesis undertakes its assessment by looking at the underlying foundation of Indonesia rsquo s domestic policies, which is the Nawacita and putting it vis vis with actual policies and international issues of transboundary loss faced by the ongoing government.Furthermore, due to the contemporaneous nature of the subject, the ramifications of the 2015 Paris Agreement has yet to be fully explored. However, given the historicity of climate change as a global issue, as well as the changing paradigms espoused by the international community that now aims for sustainable development, this thesis argues that Indonesia rsquo s domestic policies and promulgated legal instruments must necessarily enable the environment so as to lay foundation for more ambitious goals beyond 2020.Keywords International law, climate change, post Kyoto.

In Justice in Extreme Cases, Darryl Robinson argues that the encounter between criminal law theory and international criminal law (ICL) can be illuminating in two directions: criminal law theory can challenge and improve ICL, and conversely, ICL's novel puzzles can challenge and improve mainstream criminal law theory. Robinson recommends a 'coherentist' method for discussions of principles, justice and justification. Coherentism recognizes that prevailing understandings are fallible, contingent human constructs. This book will be a valuable resource to scholars and jurists in ICL, as well as scholars of criminal law theory and legal philosophy.

Even though the concept of human rights mainstreaming is not new to public international law, it has recently gained increased recognition as a practical approach for recognizing the linkages between human rights and other social justice issues such as environmental protection. A plenitude of literature have been generated on the need to recognize and enforce human rights standards and norms in a wide range of issues including environment, health, gender, poverty, food, water and refugee protection to mention but a few. Despite the rapid ascendancy of the human rights mainstreaming concept, much attention have not been given to the scope of human rights mainstreaming and the practical aspects of human rights mainstreaming, particularly whether institutions consisting of ?outsiders? to the human rights epistemic community can interpret and enforce human rights obligation. Put simply, do environmentalists, scientists and outsiders to human rights have the capacity to mainstream human rights? This paper examines the scope and tenets of human rights mainstreaming, it then discusses the practical aspects of mainstreaming human rights into policy making, particularly how epistemic concerns on human rights mainstreaming can be addressed in national and international policy design and implementation. There is virtually no aspect of our work that does not have a human rights dimension. Whether we are talking about peace and security, development, humanitarian action, the struggle against terrorism, climate change, none of these challenges can be addressed in isolation from human rights.

Kewajiban negara untuk mengatur ketentuan mengenai suap terhadap pejabat publik asing dan pejabat organisasi internasional publik merupakan salah satu isi dari United Nations Convention against Corruption (UNCAC) 2003. Namun demikian, sebagai salah satu negara yang meratifikasi UNCAC, Indonesia belum mengatur mengenai ketentuan tersebut. Sementara Singapura melalui peraturan perundang-undanganya telah mengatur ketentuan tersebut sejak setengah abad yang lalu. Kebijakan hukum pidana Indonesia saat ini sedang berada dalam proses pembaharuan hukum pidana melalui pembentukan Rancangan Kitab Undang-Undang Hukum Pidana (RUU KUHP). Salah satu pembahasan dalam proses pembentukan RUU KUHP adalah ketentuan mengenai suap terhadap pejabat publik asing dan pejabat organisasi internasional publik. Penelitian ini bertujuan untuk membandingkan ketentuan mengenai suap terhadap pejabat publik asing dan pejabat organisasi internasional publik di Indonesia dan Singapura. Hasil perbandingan tersebut penting untuk memformulasikan pengaturan mengenai suap terhadap pejabat publik asing dan pejabat organisasi internasional publik yang sesuai dengan kondisi di Indonesia. Penelitian ini berbentuk yuridis-normatif dengan menitikberatkan pada pendekatan perbandingan dan pendekatan sosio-legal. Hasil penelitian menyimpulkan bahwa terdapat dua opsi dalam memformulasikan pengaturan mengenai hal tersebut di Indonesia. Opsi pertama adalah dengan mengikuti pembahasan tentang isu ini yang pernah dilakukan dalam RUU KUHP. Opsi kedua adalah dengan mengikuti struktur dan model Prevention of Corruption Act (PCA) 1960 di Singapura. Namun, sebaiknya kedua opsi ini sama-sama dikaji terutama opsi kedua, karena Singapura sudah terbukti unggul dan menjadikannya salah satu negara dengan tingkat korupsi paling rendah di dunia. ......The state's obligation to regulate bribery of foreign public officials and officials of public international organizations is one of the elements of the 2003 United Nations Convention against Corruption (UNCAC). Although Indonesia is a State Party to the UNCAC, it has not regulated it. Meanwhile, Singapore, through its laws and regulations, has regulated it since half a century ago. Indonesia's penal policy is currently in the process of reforming criminal law through the formation of the new Criminal Code Bill (RUU KUHP). One of the discussions in the process of drafting the new Criminal Code Bill is the provision regarding bribery of foreign public officials and officials of public international organizations. Hence, this study aims to compare the provisions regarding bribery of foreign public officials and officials of public international organizations in Indonesia and Singapore. The findings of the comparison will be crucial in order to formulate regulations regarding bribery of foreign public officials and officials of public international organizations in accordance with the conditions in Indonesia. This research applies juridical-normative approach highlighting several approaches namely comparative and socio-legal approaches. The findings of the study conclude that there are two options in formulating regulations regarding this matter in Indonesia. The first option is to follow the discussions on this subject that have been carried out in the Criminal Code Bill. The second option is to adopt the structure and the model of the 1960 Prevention of Corruption Act (PCA) in Singapore. Both options will be scrutinised especially the second option, because SingaporeĀ  has proven successfully to eradicate corruption and has made it one of the countries with the lowest levels of corruption in the world.
