Abstrak :
The management of communication sector which included government as a regulator and providing the service by operator and also other service provider, aimed to provide communication service which can fulfill intention and requirement of all public community not only in country, but also from and to foreign country. In sea communication sub-sector, especially in port, the government through the revision from Government Regulation No. 7011996 become Government Regulation No. 6912001 has given the facility to stakeholder to be able to respond the situation that happened in liberalization, competition in globalization, transformation in reformation era and also the implementation of decentralization. By the implementation of Government Regulation No. 6912001, PT. Pelabuhan Indonesia II, in managing port service in the future should positively done in improving income through good strategic management, because the challenge in the future in facing the competition is more competitive either in the country, for example of Local Government demand in order to make-up of Local Government Income and also competition which tend to ascend with other port in ASEAN, for example Port Of Singapore, Port of Kiang, Bintulu, Tanjung Pelepas, Hochi Minh, etc which have more efficient in operational performance. In facing the competition which tend to global, it is needed the existence of reliable strategic management matching with existing strategic environment which able to assign value added to company growth, especially in make-up its income. This is the condition which need excellence compete in managing its business. Therefore, in stimulating how the company could succeed in facing the competition in the future which tend to spread out, it is needed the existence of scenario planning of strategic management for company to know the situation happened in the next time, so that various policy which need to solve the condition could set up early. This research is aiming to analyze how compilation process of scenario planning of strategic management of PT. Pelabuhan Indonesia II in facing the globalization, to show what factors were become resistor in creating excellence competition of the company in providing the port service, and also to explain what factors which can be developed to to create excellence competition in providing the port service. The theory in this research, are taken from various literature, Internet websites and interview with all experts concerning the strategic management of PT. Pelabuhan Indonesia II to face the competition globally which analyzed with scenario planning approach. This research are basically showing and describing all external and internal factors related to scenario planning of company which estimated that it can influence emulation of management of port that happened in the future. The approaches used in this research are qualitative approach, so that it can explain the reality or symptom which happened in business management in the future. From the result of analysis, it can know that the decision of the strategic management of the company in the future very influenced by the decisions as a key factors for scenario input. Hereinafter, from the result of that analysis found that there are 10 factors which have high impact level and uncertainty of degree, which influence the compilation process of scenario, can divide to four clusters. The conclusion of this research is there are four scenarios in developing PT. Pelabuhan Indonesia II base on most sensible strategic management in the future. Pursuant to interpretation, hence the scenario ?PT. Pelabuhan Indonesia II Berjaya? is the scenario which is more reliable happened in the future. So that the scenario planning of strategic management of PT. Pelabuhan Indonesia II in facing the of globalization which have been compiled in this research become better and more objective, it is suggested to be continued with additional research by socialization or consulted with other related parties outside the company.

ABSTRAK
As Pelindo IV said, being a maritime axis of the world is a great aspiration for Indonesia. In order to achieve this goal, Indonesia, in this term Pelindo IV PT. Pelabuhan Indonesia Persero IV , should have a good performance. Thus, research in measuring how well Pelindo utilizing their capabilities to market their products, innovate, and learning, with its impact toward the company performance is needed. This research uses Structural Equation Modeling SEM with the help of LISREL 8.51 software. The results shows that Pelindo IV marketing and innovation capabilities held a positive and significant relationship with their performance, but not with the learning capabilities. The further explanation, and suggestion based on the conducted research and in depth interview with Pelindo IV internal will be shown in this study.

Menjadi pusat maritim dunia merupakan cita-cita yang besar bagi Indonesia. Untuk mewujudkan cita-cita tersebut, Indonesia harus memiliki industri transportasi laut yang kuat dimana infrastruktur yang berupa pelabuhan harus memiliki kinerja yang baik. Perlu adanya penelitian untuk mengukur seberapa baik kinerja pelabuhan, khususnya PELINDO IV, dalam memanfaatkan kapabilitas pemasaran, kapabilitas inovasi, dan kapabilitas pembelajaran mereka dan pengaruhnya terhadap kinerja perusahaan. Penelitian ini menggunakan Structural Equation Modelling SEM dengan bantuan software LISREL 8.51. Penelitian ini menemukan bahwa kapabilitas pemasaran PT Pelindo IV memiliki hubungan yang positif dan signifikan terhadap kinerja usaha PT Pelindo IV. Selanjutnya, penelitian ini juga membuktikan bahwa terdapat pengaruh positif yang signifikan antara kapabilitas inovasi PT Pelindo IV terhadap kinerja usaha PT Pelindo IV. Terakhir, Penelitian ini menemukan bahwa kapabilitas pembelajaran PT Pelindo IV tidak memiliki pengaruh yang signifikan terhadap kinerja perusahaan PT Pelindo IV. Penjelasan lebih jauh, dan saran-saran dari studi penelitian dan wawancara langsung dengan personil Pelindo IV akan ditampilkan dalam skripsi ini.

Skripsi ini membahas mengenai praktik monopoli jasa bongkar muat petikemas di Pelabuhan L. Say Maumere oleh PT Pelindo III (Persero) dalam Putusan KPPU No.15/KPPU-L/2018. Majelis Komisi KPPU menyatakan praktik monopoli terbukti berdasarkan kebijakan penataan pelabuhan yang dibuat oleh PT Pelindo III (Persero) selaku operator terminal pelabuhan L. Say Maumere yang mewajibkan penumpukan 100% petikemas di Container Yard sehingga mendapat keberatan dari beberapa perusahan pelayaran selaku pengguna jasa. Penelitian ini membuktikan bahwa PT Pelindo III (Persero) tidak terbukti melakukan praktik monopoli dan/atau persaingan usaha tidak sehat. Selain itu memberikan saran kepada pemerintah terutama Kementerian Perhubungan, KSOP Pelabuhan, Komisi Pengawas Persaingan Usaha, dan Pelaku Usaha terkait penyelenggaraan kepelabuhanan
This thesis analyzes the monopolistic practice by PT Pelindo III (Persero) in loading and unloading container services at L. Say Maumere Port. The KPPU RI commission assembly stated that the monopolistic practice has proved based on the port restructuring policy issued by PT Pelindo III (Persero) as the operator of L. Say Maumere port terminal that required 100% stacking of containers in Container Yard. The policy received objections from several shipping companies as service users. This research concludes that PT Pelindo III (Persero) has not proven of monopolistic action and/or unfair business competition. In addition, this research provides advice related to port management to the government, especially the Ministry of Transportation of the Republic of Indonesia, Port KSOP, Supervision of Business Competition of the Republic of Indonesia, and Business Actors.

Skripsi ini menganalisis sifat hubungan negara dan bisnis yang memfasilitasi berbagai pelanggaran dalam perpanjangan kontrak privatisasi JICT antara Pelindo II dan Hutchison Port Holdings tahun 2014. Analisis tersebut ditujukan untuk memperluas pemahaman mengenai penyebab munculnya permasalahan dalam upaya reformasi tata kelola BUMN secara umum, dan implementasi program privatisasi secara khusus. Penelitian ini menggunakan metode kualitatif dengan mengkombinasikan data primer dan sekunder. Berdasarkan analisis peneliti menggunakan teori patrimonial oligarkis Hutchcroft, penelitian ini menunjukkan bahwa berbagai pelanggaran pada perpanjangan kontrak privatisasi JICT merupakan praktik Booty Capitalism yang difasilitasi oleh hubungan negara dan bisnis yang bersifat patrimonial oligarkis. Kondisi demikian memunculkan konflik politik antar berbagai pemangku kepentingan yang terlibat. Penelitian ini berkesimpulan bahwa sifat hubungan negara dan bisnis yang patrimonial oligarkis merupakan akar permasalahan dari berbagai hambatan yang muncul dalam upaya mereformasi tata kelola BUMN di Indonesia pasca Reformasi, khususnya implementasi program privatisasi. ......This undergraduate thesis analyzes the nature of state and business relations, which facilitates various law violations in the extension of JICT privatization contract between Pelindo II and Hutchison Port Holdings in 2014. The purpose of this research is to expand the understanding of causes of problems arising in the efforts to reform state-owned enterprise governance in general, and the implementation of privatization program in particular. This research utilized qualitative method through combining primary and secondary data. Based on researcher's analysis using Hutchcroft’s patrimonial oligarchic theory, this study demonstrates that various law violations which were perpetrated in the privatization contract extension of JICT is a practice of Booty Capitalism which was facilitated by state and business relation with patrimonial oligarchic nature. Political conflict between stakeholders emerged as the outcome of such condition. This study concludes that patrimonial oligarchic state-business relations is the underlying cause of various obstacles which arise in the effort to reform state-owned enterprise governance in the Post.

PT Pelindo (Persero) merupakan Badan Usaha Milik Negara (BUMN) yang didirikan khusus untuk melakukan pengusahaan terhadap kegiatan kepelabuhanan di Indonesia, yang salah satunya adalah penyediaan jasa bongkar muat. Penelitian ini membahas terkait dugaan penguasaan pasar dalam penyediaan jasa bongkar muat yang secara khusus dilakukan oleh PT Pelindo IV (Persero) di Dermaga Yos Sudarso Pelabuhan Ambon, dengan melakukan analisis terhadap Putusan KPPU Nomor 29/KPPU-L/2020. Tujuan dari penelitian ini adalah untuk mengkaji terkait posisi PT Pelindo IV (Persero) selaku Badan Usaha Pelabuhan (“BUP”) Dermaga Yos Sudarso Pelabuhan Ambon yang telah menerima hak konsesi dari negara, serta kesesuaian pertimbangan Majelis Hakim KPPU dalam Putusan No. 29/KPPU-L/2020 mengenai Pasal 19 huruf A dan B serta Pasal 50 huruf A jo. Pasal 51 UU No. 5 Tahun 1999. Penelitian ini bersifat yuridis normatif dengan metode analisis kualitatif. Merujuk pada hal tersebut, penulis akan mengaitkan antara pokok permasalahan dengan peraturan serta doktrin terkait. Setelah penulis menganalisis dan membandingkan antara pertimbangan Majelis Hakim KPPU dengan yurisprudensi terdahulu, penulis menyimpulkan bahwa terdapat kekeliruan dalam pertimbangan Majelis Hakim KPPU terkait posisi PT Pelindo IV (Persero) sebagai BUMN khusus kepelabuhanan yang telah diberikan hak konsesi oleh negara sebagai salah satu bentuk Monopoli Negara dan merupakan pelaksanaan Pasal 33 ayat (2) Undang-Undang Dasar 1945. Oleh karena itu, KPPU sebagai lembaga penegak hukum persaingan usaha di Indonesia untuk lebih kritis dalam mempertimbangkan posisi, peran dan fungsi dari PT Pelindo (Persero) sebagai BUMN penyelenggara kegiatan kepelabuhanan di Indonesia. ......PT Pelindo (Persero) is a State Owned Enterprise (“SOE”) which was specifically established to operate port activities in Indonesia, one of which is providing container services. This research discusses the alleged market control in the provision of container services which were specifically carried out by PT Pelindo IV (Persero) at Yos Sudarso Pier, Port of Ambon, by analyzing the Verdict of KPPU Number 29/KPPU-L/2020. The purpose of this research is to analyze the position of PT Pelindo IV (Persero) as the Port Company of Yos Sudarso Pier, Port of Ambon, and the suitability of the KPPU Panel of Judges’ consideration in Verdict No. 29/KPPU-L/2020 regarding Article 19 letters A and B and Article 50 letter A jo. Article 51 of Law Number 5 of 1999. This research is judicial-normative with qualitative analysis method. Therefore, the author will link the subject matter with related regulations and doctrines. After the author has analyzed and compared between KPPU Panel of Judges’ considerations with previous jurisprudence, the author concluded that there was a mistake in the consideration of PT Pelindo IV (Persero)’s position as a special SOE for ports that had been granted concession rights by the state, which as a form of State Monopoly and is the implementation of Article 33 paragraph (2) of the 1945 Constitution. Therefore, KPPU as the business competition law enforces in Indonesia should be more critical in considering the position, role, and the function of PT Pelindo (Persero) as a SOE that organizes port activities in Indonesia.

ABSTRAK Tesis ini menggambarkan tentang konflik sosial yang terjadi terkait dengan sengketa lahan antara PT.Pelindo II dengan ahli waris Habib Hasan bin Muhammad Al-Haddad atau yang kemudian dikenal dengan nama ?Mbah Priok?. Konflik sosial yang terjadi kemudian mengalami puncaknya dengan terjadinya bentrokan antara massa dari simpatisan ahli waris makam ?Mbah Priok? dengan petugas Satpol PP dibantu Polisi dan unsur lainnya pada 14 April 2010. Kerusuhan yang terjadi saat pembongkaran makam ?Mbah Priok? ini, kemudian menimbulkan korban meninggal dunia dan luka-luka, selain juga kerugian materil. Maka untuk menyelesaikan konflik seperti ini, diperlukan upaya penanganan agar persitiwa ini tidak meluas, sehingga menimbulkan masalah baru. Sesuai dengan Undang-Undang No.2 Tahun 2002 tentang Kepolisian Republik Indonesia, maka Polri dalam kapasitasnya sebagai pelayan, pelindung dan pengayom masyarakat, mempunyai andil untuk menyelesaikan konflik tersebut dalam rangka meredam, dan membantu penyelesaian konflik dengan damai dan tanpa ada pihak-pihak yang dirugikan. Polres Pelabuhan Tanjung Priok kemudian berusaha menjadi mediator untuk menyelesaikan konflik yang terjadi dengan mengedepankan upaya mediasi yang diwujudkan dalam bentuk dialog yang mempertemukan para pihak yang berkonflik. Proses dialogis tersebut dilandasi oleh 3 (tiga) prinsip utama yang menjadi pijakan Polres Pelabuhan Tanjung Priok, yakni Integritas, Independensi dan kesabaran serta ketulusan. Dengan 3 prinsip utama tadi dan juga kesolitan dari tim kerja yang dibentuk, maka terjadilah kesepatan bersama antara para pihak yang dituangkan dan ditandatangani sebagai bentuk dari resolusi damai yang dikedepankan oleh Polres Pelabuhan Tanjung Priok dalam menyelesaikan konflik yang terjadi.
ABSTRTACT This Tesis describes the social conflict that arose in relation to the land dispute between PT. Pelindo II with the heirs of Habib Hasan bin Muhammad Al-Haddad or otherwise known as ?Mbah Priok?. The social conflict culminated with a clash that occurred between the massed supporters of the heirs to the tomb of Mbah Priok and the Civil Service Police Unit (Satpol PP) officers assisted by the Police and other elements on April 14, 2010. The riot that took place during the eviction of the Mbah Priok tombstone caused deaths and injuries as well as material damage. Therefore, in resolving such conflict, efforts in handling of clashes are needed to prevent the spreading which in turn leads to a new problem. In accordance with Law Number 2 Year 2002 concerning the State Police of the Republic of Indonesia, the State Police in its capacity as servant, protector, and guardian of the people has a role in resolving the conflict so as to subdue it and assist in resolving the conflict peacefully and without inflicting loss upon any party. The Tanjung Priok Port Resort Police attempted to become a mediator to settle the conflict by putting forward a mediation effort of engaging the conflicting parties in a dialog. The dialog process was based on 3 (three) main principles that serve as the foundation of the Tanjung Priok Port Resort Police, namely Integrity, Independence, and patience as well as sincerity. With these 3 main principles and the solidity of the work group that was formed, a collective agreement was reached between the parties which was put forth and signed as a form of peaceful resolution that was put forward by the Tanjung Priok Port Resort Police in resolving the conflict.
