Skripsi ini membahas tentang konsep konflik bersenjata non-internasional dalam beberapa konvensi internasional. Permasalahan hukum internasional yang akan dibahas adalah Pertama, mengenai konsep konflik bersenjata non-internasional dalam Common Article 3 Konvensi Jenewa tahun 1949. Kedua, mengenai konsep konflik bersenjata non-internasional dalam Protokol Tambahan II tahun 1977 dan Rome Statute of International Criminal Court tahun 1998. Ketiga, mengenai kategorisasi konflik bersenjata yang terjadi di Ituri, Kongo, terkait adanya keterlibatan dari negara-negara tetangga Kongo dalam konflik tersebut. Dalam mempelajari konsep konflik bersenjata non-internasional tidak cukup hanya dengan melihat pengaturannya dalam konvensi, namun juga harus melihat penerapan konsep tersebut dalam kasus yang ada.
The focus of this study is the concept of non-international armed conflict in several international conventions. The problems of international law that will be discussed are; First, the concept of non-international armed conflict in Common Article 3 of Geneva Convention 1949; Second, the concept of non-international armed conflict in Additional Protocol II of Geneva Convention 1977 and Rome Statute of International Criminal Court 1998; and Third, categorization of armed conflict in Ituri, Congo, related to the involvement of neighboring countries in that conflict. In studying the concept of non-international armed conflict is not enough just to look at the regulation in the convention, but also have to look at the application of these concepts in the cases.

Global War on Terror yang dicanangkan oleh Pemerintah Amerika Serikat pasca serangan 9/11 yang dilansir merupakan perbuatan dari kelompok teroris al-Qaeda berujung kepada penangkapan besar-besaran atas orang-orang yang diduga sebagai anggota teroris al-Qaeda. Para tawanan terduga teroris tersebut ditempatkan di Penjara Guantanamo yang terletak di Teluk Guantanamo, Kuba. Pada permulaan Global War on Terror, pihak Amerika Serikat mengumumkan sebuah International Armed Conflict kepada Afghanistan demi memberantas rezim Pemerintahan Taliban dan kelompok terorisme al-Qaeda yang berada disana. Karena hal tersebut lah Hukum Humaniter Internasional sudah sewajarnya diberlakukan dalam konteks Global War on Terror tersebut, terutama kepada para tawanan terduga teroris yang ditangkap selama keadaan tersebut. Pada khususnya harus diberlakukan ketentuan-ketentuan yang terdapat di dalam Geneva Convention relative to the Treatment of Prisoners of War 1949 serta Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment 1984. Namun pada kenyataannya pihak Amerika Serikat tidak melaksanakan ketentuan-ketentuan yang terdapat di dalam Konvensi-konvensi tersebut dengan alasan para tawanan terduga teroris bukanlah pihak yang memiliki hak untuk dilindungi berdasarkan Konvensi-konvensi tersebut. Para tawanan terduga teroris tersebut kerap mendapatkan perlakuan tidak manusiawi dari para Militer Amerika Serikat yang bertugas di Guantanamo. Para tawanan pun tidak mendapatkan keputusan yang jelas dari sebuah pengadilan yang kompeten mengenai status mereka selama berada di dalam penawanan. Dengan demikian penting untuk dianalisa lebih lanjut mengenai status dari para tawanan terduga teroris tersebut, sehingga keberlakuan dari Konvensi-konvensi tersebut pun dapat lebih jelas tergambarkan. Permasalahan-permasalahan tersebut akan dijawab melalui penelitian yuridis-normatif sehingga diperoleh kesimpulan bahwa pada intinya Hukum Humaniter Internasional, khususnya ketentuan yang terdapat di dalam Geneva Convention relative to the Treatment of Prisoners of War 1949 serta Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment 1984 harus diberlakukan dalam keadaan Global War on Terror, terutama kepada para tawanan terduga teroris. ...... Global War on Terror declared by the Government of the United States after the attacks of 9/11 reported as an act by a terrorist group known as al-Qaeda, led to massive arrests of people suspected as the members of al-Qaeda terrorists. The suspected terrorist detainees were placed in Guantanamo Prison located at the Guantanamo Bay, Cuba. At the beginning of the Global War on Terror, the United States announced an International Armed Conflict to Afghanistan in order to combat the Taliban regime and al-Qaeda terrorist group located there. By that situation, the International Humanitarian Law has been duly enacted in the context of the Global War on Terror, especially to the suspected terrorist detainees who were captured during these circumstances. In particular, the provisions in the Geneva Convention relative to the Treatment of Prisoners of War in 1949 and the Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment 1984 should be applied. Nonetheless, the fact is that the United States did not execute the provisions in the Conventions on the grounds that the suspected terrorist detainees is not a party that has a right to be protected under the Conventions. The suspected terrorist detainees often get inhuman treatment by the U.S. Military who served in Guantanamo. Moreover, the detainess did not get their status clearly determined by any competent tribunal during their captivity. Therefore, it is important to analyze more about the status of the suspected terrorist detainees, so that the enforcement of the provisions in those Conventions could be clearly reflected. These problems will be reviewed using a juridicalnormative research method until it can be concluded that the International Humanitarian Law, in particular the provisions in the Geneva Convention relative to the Treatment of Prisoners of War in 1949 and the Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment 1984 must be enforced in the state of Global War on Terror, particularly to the suspected terrorist detainees.

Skripsi ini akan menganalisa Sistem Persenjataan Otomatis Mematikan/Lethal Auotonomous Weapons Systems (LAWS), suatu sistem senjata baru yang dapat beroperasi tanpa campur tangan manusia. Analisa terhadap LAWS didasari pada prinsip dasar hukum humaniter, yaitu prinsip pembedaan dan proporsionalitas, serta aturan dasar persenjataan, yaitu Larangan Indiscriminate Weapons, Larangan Pengguaan Senjata yang mengakibatkan Superfluous Injury dan Unncessary Suffering, dan Klausa Martens. Penelitian ini bersumber dari studi kepustakaan dengan metode yuridis normatif. Berdasarkan hasil penelitian, dapat disimpulkan bahwa perlu dibuat suatu ketentuan yang bersifat pembatasan (restriction) terhadap pengembangan dan penggunaan LAWS. ......This undergraduate thesis seeks out to analyze the use of Lethal Autonomous Weapon System (LAWS), a newly-invented weapon system which is capable to elf-operate without any human intervention. Analysis of the LAWS is based on he basic principles of humanitarian laws, namely, principle of distinction and rinciple of proportionality, as well as basic weaponry rules, such as Prohibition n Indiscriminate Weapons, Prohohibitions on Weapons that cause Superfluous njury and Unncessary Suffering, and Martens Clause. The research comes from iterature study with normative juridical method. Based on this research, it can be oncluded that a provision of a restriction nature shall be made to regulate the evelopment and use of LAWS.

This study focuses on the prohibition of sexual violence in armed conflict based on the provision of various international treaties and the sanctions that imposed on perpetrators of sexual violence according to the Rome Statute of International Criminal Court. The analysis on the provision of the Rome Statute of International Criminal Statute and its application in some cases of sexual violence in the Democratic Republic of the Congo. This study is based on the results of literature study with normative juridical method. Based on the result of this study, the provisions of the prohibition of sexual violence has not been properly applied in some cases that occur in armed conflict in the Democratic Republic of the Congo. Therefore, in addition to the provision of regulation, it is also necessary to establish the system of evidence that could facilitate the implementation of the sanctions to the perpetrators of sexual violence in armed conflicts.
Skripsi ini membahas mengenai larangan dilakukannya kekerasan seksual dalam konflik bersenjata berdasarkan perumusan dalam berbagai perjanjian internasional dan sanksi yang diberikan kepada pelaku kekerasan seksual berdasarkan statuta peradilan internasional. Analisa mengenai perumusan kekerasan seksual didasari pada ketentuan dalam Rome Statute of International Criminal Court dan penerapannya dalam kasus kekerasan seksual yang terjadi di Democratic Republic of the Congo. Penelitian ini disusun berdasarkan studi kepustakaan dengan metode yuridis normatif. Berdasarkan hasil penelitian, perumusan mengenai larangan kekerasan seksual belum dapat diterapkan secara baik dalam beberapa kasus yang terjadi pada konflik bersenjata di Democratic Republic of the Congo. Oleh karena itu, selain rumusan pengaturan, diperlukan pula sistem pembuktian yang dapat mempermudah dilakukannya penerapan saksi bagi pelaku kekerasan seksual dalam konflik bersenjata.

War and armed conflicts have been the major problems in international law especially for their defected impacts such as physical, psychological, and material loss for the victims. Wars and armed conflicts are subject to international humanitarian law so that people are protected from the soldiers violence where they kill each other in defending their national interests. Humanitarian law also has a purpose to protect wounded soldiers and prisoners of war from inhuman treatments. However, these wars and armed conflicts should be prevented because they have more disadvantages than advantages to human beings.
