Summary:
"Can states adopt protectionist cultural policies? What are the limits, if any, to state intervention in cultural matters? A wide variety of cultural policies may interfere with foreign investments, and a tension therefore exists between the cultural policies of the host state and investment treaty provisions. In some cases, foreign investors have claimed that cultural policies have negatively affected their investments, thereby amounting to a breach of the relevant investment treaty. This study maps the relevant investor-state arbitrations concerning cultural elements and shows that arbitrators have increasingly taken cultural concerns into consideration in deciding cases brought before them, eventually contributing to the coalescence of general principles of law demanding the protection of cultural heritage

The reconstruction of society after conflict is complex and multifaceted. This book investigates this theme as it relates to cultural heritage through a number of case studies relating to European wars since 1864. The case studies show in detail how buildings, landscapes, and monuments become important agents in postconflict reconstruction, as well as how their meanings change and how they become sites of competition over historical narratives and claims. Looking at iconic and lesser-known sites, this book connects broad theoretical discussions of reconstruction and memorialization to specific physical places, and in the process it traces shifts in their meanings over time. This book identifies common threads and investigates their wider implications. It explores the relationship between cultural heritage and international conflict, paying close attention to the long aftermaths of acts of destruction and reconstruction and making important contributions through the use of new empirical evidence and critical theory. Marie Louise Stig Sorensen is a Reader in Archaeology at the University of Cambridge and Professor of Bronze Age Studies at Leiden University. She coordinates the University of Cambridge's postgraduate degree program in archaeological heritage and museums, one of the first degree courses in this field

ABSTRAK
Skripsi ini membahas tentang penegakan hukum terhadap kejahatan Benda Cagar
Budaya, khususnya pada tahap penyelidikan dalam studi kasus pencurian koleksi
emas di Museum Sonobudoyo Yogyakarta tahun 2010. Benda Cagar Budaya
merupakan sumber ilmu pengetahuan dalam merekonstruksi kehidupan masa lalu.
Kasus pencurian yang tidak kunjung terungkap selama lebih dari empat tahun
menunjukan adanya masalah dalam sistem penegakan hukum terhadap kejahatan
Benda Cagar Budaya. Skripsi ini juga membicarakan kejahatan Benda Cagar
Budaya dalam kaitannya dengan Organized Crime. Penelitian dilakukan secara
kualitatif dengan menggunakan teknik wawancara pada pihak kepolisian, ppns,
museum dan juga lembaga swadaya masyarakat.
ABSTRACT
This research will discuss about law enforcement effort on crime against cultural
property, concern with investigation obstacle within the case of larceny in
Museum Sonobudoyo Yogyakarta. Cultural property, as source of knowledge, in
the course of historical reconstruction. This particular case, that has been left
unsolved for over four years, indicate problems within the law enforcement effort
on crime against cultural heritage object. Also within this research, relation
between crime against cultural heritage objects and organized crime will be
discussed. This Research uses qualitative approach with interviews with police,
government internal affairs, museum?s manager and also NGO?s.
