Abstrak :
Terdapat permasalahan yang timbul dalam pengelolaan Rumah Susun berupa perilaku dominasi yang dilakukan oleh Pelaku Pembangunan (developer). Hal ini terjadi akibat adanya disharmoni dalam peraturan yang ada, pelaku pembangunan seringkali mengumpat di balik multi-tafsir daripada frasa-frasa yang terdapat dalam peraturan perundang-undangan yang berlaku. Skripsi ini selanjutnya membahas mengenai bagaimana batasan yang harus diperhatikan oleh pelaku pembangunan (developer) dalam pengelolaan rumah susun, serta membahas mengenai perlindungan hukum yang diberikan kepada para pemilik dan/atau penghuni akibat dominasi pengelolaan rumah susun yang dilakukan oleh pelaku pembangunan. Jenis penelitian yang digunakan oleh penulis adalah penilitian normatif yang berarti penelitian ini akan mengacu kepada norma hukum yang terdapat dalam peraturan perundang-undangan dan putusan pengadilan serta norma-norma yang berlaku dan mengikat pada masyarakat atau juga menyangkut kebiasaan yang berlaku di masyarakat. Atas permasalahan tersebut, penulis menawarkan saran agar pelaku pembangunan dapat mematuhi peraturan terkait untuk meminimalisir terjadinya praktek dominasi pada pengelolaan rumah susun. ABSTRACT
There are several problems that arise in the management of condominiums in the form of domination behavior by Developers. This happens due to disharmony in existing regulations, developers often hide behind multi-interpretations rather than the phrases contained in the applicable laws and regulations. This thesis discussed about limitations that must be considered by the Developers in the management of condominiums and the legal protection provided to owners and/or residents of condominiums because of the dominance of the management of condominiums by Developers. The type of research used by the author is normative research, which means that this research will refer to legal norms that apply to the community or also concerning the prevailing habits in society. For these problems, the authors offer suggested that Developers must comply with relevant regulations to minimize the occurrence of dominance practices in the management of condominiums. In addition, the author also suggested that the Government must take firm actions against Developers who commit arbitrary management of condominiums to protect the rights of owners and/or residents of condominiums.
