Abstrak :
Tujuan pemidanaan terhadap anak harus disesuaikan dengan keperluan dan kebutuhan anak tersebut demi masa depannya karena anak memiliki ciri-ciri khusus yang melekat pada dirinya yang tidak dapat disamakan dengan pelaku dewasa. Perkembangan mutakhir dalam hukum pidana khususnya yang berkaitan dengan persoalan pidana yang menjadi trend atau kecenderungan internasional adalah berkembangnya konsep untuk mencari alternatif dari pidana perampasan kemerdekaan dalam bentuknya sebagai sanksi pidana alternatif, khususnya bagi terpidana anak. Hal ini bertolak dari suatu kenyataan bahwa dalam perkembangannya pidana perampasan kemerdekaan semakin tidak disukai baik atas pertimbangan kemanusiaan, pertimbangan filosofi pemidanaan maupun atas pertimbangan ekonomi. Community service order (CSO) atau pidana pelayanan masyarakat merupakan salah satu dari pidana alternatif perampasan kemerdekaan atau penjara bagi anak yang bersifat non-institusional (di luar lembaga) yang direkomendasikan oleh instrumen internasional yaitu United Nations Standard Minimum Rules for the Administration of Juvenile Justice (Beijing Rules). Pidana pelayanan masyarakat telah dimasukkan dalam konsep pembaharuan hukum pidana anak Indonesia yaitu dalam Konsep atau Rancangan KUHP (RKUHP) dan Rancangan Undang-Undang tentang Sistem Peradilan Pidana Anak (RUU SPP Anak). Penelitian ini menggunakan penelitian yuridis normatif yang didukung dengan penelitian lapangan dalam bentuk wawancara dengan informan. Dari hasil penelitian diperoleh kesimpulan bahwa pidana pelayanan masyarakat sangat menunjang tujuan pemidanaan dan pembinaan bagi terpidana anak, baik dilihat dari tujuan pemidanaan secara umum maupun tujuan pemidanaan yang bersifat integratif. Relevansi antara pidana pelayanan masyarakat dengan pembaharuan sistem pemidanaan anak di Indonesia dapat diartikan bahwa pidana pelayanan masyarakat perlu dipahami dalam konteks kebijakan kriminal, dengan demikian pidana pelayanan masyarakat dapat memerankan fungsinya sebagai salah satu kontrol sosial dalam menunjang kebijakan penanggulangan kejahatan yang dilakukan oleh anak di Indonesia. Konsep pengaturan pidana pelayanan masyarakat yang ada dalam Rancangan Undang-Undang tentang Sistem Peradilan Pidana Anak (RUU SPP Anak) masih perlu disempurnakan lagi karena masih bersifat sangat umum. Pidana pelayanan masyarakat memberikan prospek dan harapan besar untuk dapat diterapkan dalam peradilan pidana anak di Indonesia, mengingat pelbagai keuntungan yang didapat dari pidana pelayanan masyarakat tersebut. ......Criminal sentencing of a juvenile offender should be adjusted to the special need and requirement of a juvenile or a minor, because despite being an offender, s/he is still a child, hopefully with a future and hence s/he has a special characteristic that is inherent to him/her that is not found in an adult offender. The recent development in criminal law reveals a growing international trend to seek an alternative to replace the more common method of incarceration, specifically in cases involving juvenile offender. This conviction stemmed from the notion that the concept of imprisonment is getting less popular, whether it is viewed from humane consideration, sentencing philosophy or economic consideration. Community service order (CSO) is one of the alternatives to incarceration to a juvenile offender that is non-institutionalized and it is recommended in an international instrument the United Nation Standard Minimum Rules for the Administration of Juvenile Justice (Beijing Rules). The concept of community service sentencing for juvenile offender has been entered into the draft reform of the Indonesian Criminal Code (RKUHP) and the draft for the Law for Juvenile Criminal Procedure System (RUU SPP Anak). This study is a judicial normative research supported by a field research in the form of interviews with competent respondents. From the result of the study, the author concludes that community service is highly supportive to the objectives of sentencing and education of a juvenile offender both from the perspective of sentencing in general or sentencing objectives that are integrative in nature. The relevance between community service sentencing and the juvenile criminal system reform may be interpreted that community service sentencing is perceived within the context of a policy on managing criminal offenders; therefore, community service sentencing may play its intended role as a social-control instrument to support the policy of managing criminal acts committed by juveniles in Indonesia. The existing draft on community service sentencing as contained in the draft for the Law for Juvenile Criminal Procedure System (RUU SPP Anak) still needs to be improved since it is still too broad in nature. Community service sentencing has the prospect and possibility to be applied in Indonesia?s juvenile criminal court, considering the huge benefits that may be reaped from such application.

Penelitian ini bertujuan untuk menganalisis faktor-faktor yang mempengaruhi perilaku brand switching konsumen jasa operator telekomunikasi. Hasil penelitian ini diharapkan nantinya dapat bermanfaat sebagai masukan bagi operator telekomunikasi untuk mengetahui faktor-faktor apa saja yang mempengaruhi konsumennya dalam melakukan brand switching. Berdasarkan hasil penelitian melalui survey pada 145 responden, maka diperoleh bahwa price, core service failure, service failure, rasa tidak nyaman (inconvenience), rasa penasaran, komunitas, involuntary switching, dan kompetitor dari sesama operator merupakan faktor yang mempengaruhi konsumen dalam melakukan brand switching ke operator lain. ......This study aims to analyze the factors that influence brand switching behavior of consumers of telecommunications service operators. The results of this study are expected to be useful as inputs for telecommunication operators to determine what factors are affecting consumers in doing brand switching. Based on the results of the research through a survey of 145 respondents, it was found that price, core service failure, service failure, inconvenience, curiosity, community, involuntary switching, and competitors from the same operator are factors that affects consumer in brand switching to other operators.
