"Tugas Akhir ini memaparkan tentang budaya Tionghoa yang hingga saat ini masih dijalankan di perkumpulan Himpunan Bersatu Teguh (恒明堂 Heng Beng Tong), sebuah perhimpunan orang Tionghoa di kota Padang. Tujuan dari penelitian ini adalah memberikan informasi dan memperkaya wawasan pembaca mengenai budaya Tionghoa apa saja yang tetap eksis di tengah komunitas orang Tionghoa Himpunan Bersatu Teguh (HBT), serta memaparkan dampak dan pengaruh terhadap masyarakat setempat. Proses penelitian yang dilakukan meliputi studi kepustakaan dan studi lapangan berupa wawancara terhadap narasumber. Anggota HBT terdiri dari Orang Tiongkok yang sudah menetap di Padang. Namun, meski hidup berdampingan dengan masyarakat dan budaya Minang, HBT tetap melestarikan budaya leluhurnya.

This research describes the Chinese culture which is still being carried out in the association "Himpunan Bersatu Teguh" (恒 明堂 Heng Beng Tong), an association of Chinese people in the city of Padang. The purpose of this study is to provide information and enrich readers' insights about what Chinese culture still exists in the Chinese community of "Himpunan Bersatu Teguh (HBT)", as well as to describe the impact and influence on the local community. The research process was carried out using the method of literature study and field study in the form of interviewing informants. The HBT members consist of Chinese immigrants who have settled in Padang. However, despite living side by side with the Minang community and their culture, HBT still preserves the culture of its ancestors.

"ABSTRAK
Hukum Waris yang diterapkan untuk masyarakat Golongan Tionghoa adalah Hukum Waris menurut ketentuan Kitab Undang--Undang Hukum Perdata beserta ketentuan-ketentuan terkait lainnya yakni Staatsblaad 1917:129 tentang Hukum Perdata dan Hukum Dagang untuk golongan Tionghoa (Bepalingen voor geheel Indonesie Betreffende het burgerlijk van de Chineezen). Sebagai hukum yang mengatur tentang peralihan harta peninggalan seseorang serta akibat hukumnya bagi para ahli waris yang ditinggalkan, hukum waris otomatis berlaku pada saat seseorang meninggal dunia. Ketidaktahuan masyarakat akan ketentuan dalam hukum waris, terkadang menimbulkan dampak hukum yang merugikan pihak-pihak tertentu, misalnya dalam hal pembuatan surat wasiat untuk kepentingan satu atau beberapa pihak, yang akhirnya merugikan pihak yang lain.
Permasalahan yang diteliti adalah mengenai status hukum dari sebuah surat wasiat yang melanggar Bagian Mutlak ahli waris legitimaris, disangkutpautkan dengan surat pernyataan penolakan warisan yang dibuat oleh ahli waris tersebut terhadap harta peninggalan ayahnya, yang dipergunakan oleh hakim sebagai alasan untuk menghapuskan hak waris ahli waris tersebut atas harta peninggalan ibunya ditinjau dari Putusan MARI No.2091K/PDT/2002.
Metode penelitian deskriptif analistis dan preskriptif digunakari untuk menghimpun data sekunder, sedangkan untuk data primer diperoleh dari wawancara dengan beberapa informan dan narasumber, yang kemudian diteliti melalui studi dokumen, dianalisis secara kualitatif dan disajikan secara deskriptif yang kemudian menghasilkan kesimpulan bahwa Putusan MART No.2091K/PDT/2002 telah menyimpang dari ketentuan hukum waris yang diatur dalam KUH Perdata, yakni surat wasiat yang melanggax Legitieme Portie ahli waris legitimaris seharusnya tidak secara otomatis menjadi batal demi hukum, namun tetap berlaku, dengan ketentuan harus dilakukan pengurangan (inkorting) sebesar jumlah yang terlanggar tersebut untuk dikembalikan kepada ahli waris legitimaris. Penolakan warisan tidak boleh dilakukan untuk warisan seseorang yang masih hidup, melainkan hanya untuk warisan yang telah jatuh terluang.

ABSTRACT
The law of inheritance applied for The Chinese people domicile in Indonesia is the one in accordance with the Book Of Civil Law, as well as other relevant regulation namely Staatsblaad 1917:129 concerning the Civil Law and Trade Law for the Chinese people (Bepalingen voor geheel Indonesie Betreffende het Burgerlijk van de Chineezen). As a law regulating about the transfer of inherited assets as well as its legal impact for the heirs, the law of inheritance thus automatically is considered to be put effectively by the time the inheritor passes away. However, people's unawareness of the rules consisted in the law sometimes could cause harm to certain parties' interest, take for example in the matter of testament making which is intended only to benefits one or more parties, but at the same time cause harms to other party.
The problem to be addressed in this research is to identify the legal status of a testament which violates the Legitieme Portie of a Legitimate heir, related to the inheritance refusal statement made by the heir towards the assets inherited by his father, which was used by the judge as the reason to cancel the heir's right to the inheritance left by his mother, reviewed from the Republic of Indonesia Supreme Court's Decision No.2091K/PDT/2002.
The method applied in this research is the descriptive-analytical and prescriptive one, which was utilized to collect the secondary data, while for the primary one attained from in-depth interview conducted with some informants and resource person, and then further scrutinized through document studies, and then analyzed qualitatively as well as descriptively, which eventually lead to a conclusion that the Supreme Court's Decision No.2091K/PDT/2002 has already violates the regulation consisted in the law of inheritance, regulated by the Book of Civil Law, mentioning that the testament violating Legitieme Portie of the legitimate heir should not be automatically canceled for the sake of Law, but instead should be still effective, in condition an incurring (reduce) should be applied on the violated amount to be return to the legitimate heir. The refusal should not be conducted for the inherited assets of someone who is still alive, but instead only for those which has been put into effect (jatuh terluang) since the inheritor has passed away."

It is generally assumed that Cina Benteng is a community of Peranakan Chinese living around Tangerang However one its communities in Situgadung Village rejected that notion in which they refer themselves as Orang Keturunan Eventually they identified themselves as Cina Benteng in the 1980s. This research gives a new understanding on ethnic identity and the differentiation between identity and ethnicity Identity is defined as a process where each individual plays a significant role to identify a collectivity in which he she feels belonged to while ethnicity is one of the manifestations of collectivities in which the society determine an individual's collectivity.

Makalah ini menganalisis diskriminasi terhadap anak perempuan dalam masyarakat Tiongkok pada novel The Black
Isle. Poin-poin utama dalam makalah ini adalah faktor penyebab dan dampak negatif dari diskriminasi terhadap anak
perempuan. Argumen-argumen dan tulisan dari Kristina Göranson (2010) dan Peter N. Stearn (2006) merupakan
acuan dasar dalam penelitian ini. Hasil dari penelitian ini menunjukkan bahwa tradisi dan keyakinan kuno
masyarakat Tiongkok merupakan faktor inti terjadinya diskriminasi terhadap anak perempuan. Akibat dari
diskriminasi tersebut dianalisis berdampak negatif pada tingkah laku anak perempuan yang didiskriminasi dan juga
keluarganya. Penelitian ini menunjukkan bahwa novel sering sekali membahas isu-isu yang terjadi di dunia nyata

"Tesis ini pada dasamya mengkaji bagaimana cara orang Tionghoa penganut agama Khonghucu di Cimanggis mempertahankan tradisi pemujaan leluhur.Dalam hal ini fokus penelitian penulis adalah upaya penyesuaian yang dilakukan pada makanan sesaji yang dipersembahkan oleh orang Tionghoa penganut agama Khonghucu di Cimanggis dalam upacara pemujaan leluhur. Dalam mengkaji masalah ini penulis menggunakan pendekatan strukturalisme yang diperkenalkan oleh Levi Strauss untuk mengetahui sejauh mana penyesuaian itu terjadi dan pada tingkat apakah terjadi perubahan itu.
Pengkajian dilaksanakan dengan pendekatan kualitatif dengan menggunakan metode etnografi, yang memusatkan perhatian pada upaya yang dilakukan penganut Khonghucu di Cimanggis dalam makanan sesaji pada upacara pemujaan leluhur. Metode pengumpulan data dilakukan dengan pengarnatan, wawancara mendalam dan penggunaan literatur yang relevan.
Hasil penelitian yang penulis lakukan pada orang Tionghoa penganut agama Khonghucu di Cimanggis memperlihatkan bahwa salah satu cam yang dipilih dan diinginkan oleh mereka untuk mempertahankan tradisi pemujaan leluhur adalah dengan melakukan resistensi pasif Yang dimaksud dengan resistensi pasif adalah suatu penolakan untuk menyerah pada keadaan lingkungan yang berubah, kekuasaan, pemaksaan atau kekerasan tanpa memperlihatkan perlawanan (secara lisan atau lainnya) terhadap orang yang melakukan pemaksaan tersebut atau lingkungan yang berubah. (Horace B & English, 1958: 460). Orang Tionghoa penganut agama Khonghucu di Cimanggis menolak untuk menyerah pada keadaan lingkungan yang berubah atau beberapa peraturan diskriminatif terhadap masyarakat Tionghoa yang diterapkan oleh pemerintah Orde Baru. Namun mereka juga tidak memperlihatkan perlawanan (secara lisan atau lainnya). Untuk tetap mempertahankan kebudayaan Tionghoa ini, mereka lalu melakukan beberapa penyesuaian.
Dengan menggunakan pendekalan strukturalisme yang diperkenalkan oleh Levi Strauss, penulis melihat bahwa dalam hal makanan sesaji, penyesuaian yang dlakukan oleh orang Tionghoa penganut agama Khonghucu di Cimanggis sebetulnya hanya terjadi pada struktur permukaan dari set of knowledge orang Tionghoa penganut agama Khonghucu di Cimanggis. Struktur dalamnya sama sekali tidak berubah. Selain itu konsep ?sudah menjadi takdir Tuhan? , konsep ?habis bagaimana lagi?, konsep da-tong yang berarti satu dunia atau universal harmony dan konsep chuantong yang berarti tradisi sangat membantu orang-orang Tionghoa berkompromi dan menggunakan kebijaksanaan yang praktis dalam memecahkan kesulitan yang mereka hadapi."

"The study departs from complexity of society as a general inclination in modern social life. Technological progress likes in USA and Europe such as transportations and communications will often appear many problems in inter ethnic interaction, culture, and religion. The condition is as same as Indonesia with its complexity of society and kind of back ground such as ethnic, religion, race (SARA), and culture. Social interaction among people and their complexity could make problem of SARA and it's not unusual supporting among parties to power their ethnic identity and primordialism. How ever, it doesn?t mean to weaker opinion that intensive of contacts as a result of social interaction would disappear differences among parties in social life.
It's good enough, one effective way of national assimilation through inter ethnic or population marriage. Marriage function is family legalization, and among other things goal to reproduce and for the next will be make a social reproduction. The social reproduction performances like as "new man". The new man's identity is fully depending on one parties domination of parents and social milieu, like as residence, job - places, educations, and customs. And accordingly with above, the study will observe marriages between Dayak people with Chinese womb in District of Samalantan, Regention of Sambas, West Kalimantan.
To express the study result, there are three main aspects will be studied, i.e. social adaptation, individual adjustment, and socialization.
Main theory base on the study is assimilation theory of Milton M. Gordon (1964) expressed three central inclinations, i.e., "Anglo-conformity", "melting-potn, and "cultural-pluralism". Other theory according to the study is from Zanden (1970), Goode (1985), Firth (1954), Barth (1970), Johnson (1981), Horton and Hunt (1984), Herskovits (1958), Haviland (1985), Linton (1945), Mennel (1974), and Merton {1975).
The study support to understand more about inter ethnic marriage function as an effective way in national assimilation. The result hopes could be used to developed knowledge?s in sociology and anthropology, and even for in-creased context in political and economic science. More over, the result could be used by government or other party who has right "to arrange" assimilation policies.
The data collecting method are taken from questionnaire using, observation, and interviews. As data resources and information, samples determined with total 100 respondents {50 marriage pairs) and key informant with total ten persons. Sample choosing method is done purposely and in﷓formant too. Analysis to be used is qualitative with using interpretation technique on data classification/information.
From a couple of dates and information have been taken from methodological procedure to be determined with prepositional way such as question likes above, and based on relevance theories, consequently the study result ex-pressed as follows:
Marriage between Days-Chinese wombs appears a symbiotic relation between both or parties in economy. The marriage bears political opportunity to Chinese caused of the Chinese would be protected by Days as original in habitants. Besides, the kind or marriage is a mediator between both of parties, family, and society.
Although there are many difficulties experienced by both of the parties to keep going their marriage, the family who is legalized by the marriage would be an effective way in national assimilation, and at least it could be as socialization way of their children as "new man".
As a reason, there is unreal 100 percent assimilation is happened. It's same with marriage they. The marriage could be stopped and may be followed on. It is so depending upon ethics and condition one of parties. And so the individual and society milieu.
But as same as the marriage have noble goal, e.g. developing their womb and preparing family and good society, so the Dayak-Chinese marriage has a glorious goal, e.g. getting good citizen based on under standing each other between the parties include society."
