"Penelitian dilakukan untuk mendapatkan gambaran lebih lanjut mengenai perikatan yang terjadi dalam proses perpindahan pemain dalam olahraga sepakbola. Penelitian dilakukan dengan metode yuridis normatif, yaitu dengan memperhatikan perjanjian yang dibuat oleh para pihak serta peraturan-peraturan yang berlaku di dalam dunia olahraga sepakbola, peraturan FIFA, PSSI, dan peraturan Liga. Disamping itu juga analisis tidak lupa dilakukan terhadap peraturan perundang-undangan Indonesia yang berlaku terkait bidang olahraga yaitu Undang-undang Nomor 3 tentang Sistem Keolahragaan dan Peraturan Pemerintah No. 16 tahun 2007. Hasil penelitian ini menunjukkan bahwa perikatan yang terbentuk dari proses perpindahan pemain merupakan suatu perjanjian campuran, yaitu percampuran antara perjanjian jual beli serta perjanjian persetujuan baru yang mana pengaturannya tidak terdapat dalam Kitab-Undang-Undang Hukum Perdata.

The study was conducted to obtain further description of the engagement that occurs in the moving process of football players. The study was conducted with normative juridical method, namely taking into account the agreement made by the parties and the regulations in world football, FIFA rules, PSSI, and League rules. This study also analyzed Indonesian laws and regulations about sports namely the Law No. 3 of 2005 about The Sports System and the Government Regulation No. 16 of 2007. The results of this study indicate that the agreement formed by the process of moving the player is a combinatie agreement, which is a combination of the purchase agreement and approval of new agreements that are not listed in the regulation of The Civil Code."

"Pemerintah mempunyai kewenangan mengenai penyelenggaraan olahraga di Indonesia dalam rangka untuk mencapai kesejahteraan di dalam masyarakat, namun dalam penyelenggaraan olahraga di Indonesia terdapat suatu organisasi olahraga yang mempunyai kewenangan dalam olahraga sepak bola, yaitu PSSI. Keberadaan PSSI di Indonesia selain mewakili Indonesia dalam sepak bola di dunia internasional, tetapi juga sebagai anggota FIFA di Indonesia. Sehingga dalam penyelenggaraan olahraga secara nasional memungkinkan adanya suatu pertentangan antara sistem hukum olahraga nasional dengan sistem hukum FIFA. Agar keduanya bisa berjalan baik maka diperlukan suatu harmonisasi hukum antara keduanya, sehingga hasil harmonisasi hukum tersebut bisa menciptakan suatu sistem hukum olahraga yang baik di dalam penyelenggaraan sepak bola di Indonesia.

Indonesian government have autorithy in Indonesian sports event for achieving prosperity in society, but there is a sports organizations which have authority in football, is PSSI. PSSI existence in Indonesia to representing Indonesia in international football world, but in other side, PSSI as a member of FIFA in Indonesia. So, there is a possibility of conflict in national sport event between national sports law and FIFA legal system. Harmonization of laws needed for making good conditions in both of them. So the result of harmonization is making a good sports legal system in Indonesian football event."

"Tulisan ini menganalisis bagaimana perilaku pengunggahan highlights pertandingan sepak bola di media sosial oleh suporter olahraga menurut UU Hak Cipta. Penelitian ini dilakukan dengan menggunakan metode penelitian doktrinal. Highlights merupakan ringkasan yang memuat bagian paling penting atau menarik dari sesuatu (seperti acara olahraga) yang biasanya disajikan dalam siaran televisi. Namun seiring dengan perkembangan teknologi, highlights pertandingan dapat pula diunggah di media sosial, terutama oleh suporter olahraga. Undang-Undang Nomor 11 Tahun 2022 tentang Keolahragaan menetapkan adanya hak yang diperoleh oleh para suporter olahraga terdaftar, salah satunya adalah hak untuk memberikan dukungan secara langsung atau tidak langsung, baik di dalam maupun di luar pertandingan olahraga. Dalam penelitian ini ditemukan bahwa pengunggahan highlights pertandingan sepak bola di media sosial oleh suporter olahraga dapat dikategorikan sebagai bentuk dukungan dan dilindungi oleh UU Keolahragaan. Dengan tidak adanya pembatasan mengenai apa saja yang dikategorikan sebagai tindakan dalam hak untuk memberikan dukungan dalam UU Keolahragaan, suporter olahraga terdaftar dapat memperoleh keleluasaan untuk melakukan hal tersebut. Akan tetapi, keleluasaan tersebut tetap dibatasi oleh peraturan perundang-undangan mengenai hak cipta yang berlaku di Indonesia.

This study analyzes the behavior of uploading football match highlights on social media by sports supporters under the Copyright Law. The research employs a doctrinal research method. Highlights are summaries containing the most important or interesting parts of something (such as sports events), usually presented in television broadcasts. However, with technological advancements, match highlights can also be uploaded on social media, particularly by sports supporters. Law No. 11 of 2022 concerning Sports stipulates the rights granted to registered sports supporters, including the right to provide support directly or indirectly, both during and outside of sports events. This study finds that uploading football match highlights on social media by sports supporters can be categorized as a form of support and is protected under the Sports Law. With the absence of restrictions on what actions fall under the right to provide support in the Sports Law, registered sports supporters have the flexibility to engage in such activities. However, this flexibility is still limited by the applicable laws and regulations on copyright in Indonesia. "
