"Penelitian ini membahas tentang pemenuhan hak identitas anak melalui pelibatan masyarakat untuk mengembangkan model perlindungan anak berbasis komunitas. Pendekatan penelitian ini adalah kualitatif dengan jenis penelitian deskriptif dan penelitian aksi sebagai strategi penelitiannya. Hasil penelitian menunjukan adanya kesenjangan antara kebijakan pemerintah dengan realitas di masyarakat dalam pemenuhan hak identitas anak. Peran pekerja masyarakat diperlukan untuk memberdayakan masyarakat khususnya orang tua agar mampu melakukan perannya. Pemerintah, pekerja masyarakat dan tokoh masyarakat perlu bersinergi membuat strategi agar partisipasi masyarakat berjalan secara efektif dalam mengembangkan model perlindungan anak berbasis komunitas.

This research is about fulfillment of the child’s rights identity through community involvement to develop a child protection model with community-based approach. This research used a qualitative approach with descriptive type and action research as the strategy. The result shows the gap between government policy and the reality in community in fulfilling the child's rights of identity. The community workers is needed to empower people, especially the parents to be able to perform their roles. Goverment, community workers and community leader have to work together in making a strategy so the community have a child protection model with community-based approach."

"Persoalan hak asuh anak setelah putusnya perkawinan membutuhkan perhatian khusus terhadap pemenuhan hak-hak anak. Majelis Hakim dalam memutus perkara hak asuh anak sudah seharusnya berlandaskan pada prinsip The Best Interest of the Child. Penelitian ini menganalisis bagaimana prinsip The Best Interest of the Child dimaknai dalam Konvensi Hak Anak dan relevansinya terhadap pemenuhan hak asuh anak, serta bagaimana pengaturannya dalam hukum Indonesia dan Inggris, termasuk penerapannya pada Putusan Pengadilan Keluarga Guildford [2023] EWFC 118 dan Putusan Pengadilan Negeri Jakarta Utara Nomor 296/Pdt.G/2019/PN Jkt.Utr. Melalui hal tersebut, penelitian ini disusun menggunakan metode pendekatan perbandingan berbentuk doktrinal. Di Indonesia, hakim cenderung menitikberatkan pada usia anak atau kedekatan anak dengan salah satu orang tua, tanpa evaluasi yang menyeluruh serta tanpa melibatkan tenaga profesional seperti psikolog atau pekerja sosial. Hal ini disebabkan karena belum adanya aturan hukum yang secara tegas merinci parameter penilaian prinsip The Best Interest of the Child dalam penentuan hak asuh anak. Sebaliknya, sistem hukum Inggris melalui Children Act 1989 telah mengatur secara tegas melalui welfare checklist yang digunakan oleh hakim dengan melibatkan ahli dalam menilai kesejahteraan anak. Oleh karena itu, Indonesia perlu membentuk aturan khusus sebagai pedoman penerapan prinsip The Best Interest of the Child dalam penentuan hak asuh anak.

The issue of child custody following the dissolution of marriage requires special attention to the fulfillment of children's rights. The Panel of judges plays a significant role in deciding child custody cases, which should ideally be based on the principle of The Best Interest of the Child. This study analyzes how the principle of The Best Interest of the Child is interpreted in the Convention on the Rights of the Child and its relevance to the fulfillment of child custody rights, as well as how it is regulated in the legal systems of Indonesia and England, including its application in the Guildford Family Court Decision [2023] EWFC 118 and the North Jakarta District Court Decision Number 296/Pdt.G/2019/PN Jkt.Utr. This study employs a comparative doctrinal approach. In Indonesia, judges tend to emphasize the child's age or the closeness of the child to one of the parents without conducting a comprehensive evaluation and without involving professionals such as psychologists or social workers. This occurs due to the absence of clear legal regulations detailing the assessment parameters of The Best Interest of the Child in custody decisions. In contrast, the English legal system, through the Children Act 1989, has specifically regulated the assessment of The Best Interest of the Child through the welfare checklist, which is used by judges with the involvement of experts in evaluating the child’s welfare. Therefore, Indonesia needs to establish specific regulations as a guideline for applying the principle of The Best Interest of the Child in custody determinations."

"ABSTRAKAnak sebagai penerus bangsa hingga saat ini masih berada pada kondisimemprihatinkan. Anak perlu disosialisasikan haknya agar mampu menyuarakanaspirasi berkaitan dengan kepentingan dan kebutuhan mereka. World VisionIndonesia (WVI) sebagai NGO yang fokus pada anak telah melakukan sosialisasihak anak melalui program anak sebagai wadah transfer nilai hak partisipasi.Program yang dilakukan adalah kegiatan kelompok minat dan bakat (tari, futsal,musik), pertemuan rutin Forum Anak, penyuluhan dan perayaan. Penelitiankuantitatif ini dilakukan terhadap 94 anak dampingan WVI ADP Kebon Pala,Jakarta Timur. Terdiri atas 50 anak yang mengikuti program WVI dan 44 anakyang tidak mengikutinya dalam kurun waktu satu tahun terakhir. Tujuannya untukmengetahui apakah ada perbedaan pengetahuan hak partisipasi dan partisipasidalam keluarga terhadap kedua kelompok. Hasil penelitian menunjukkan tingkatpengetahuan hak partisipasi berbeda signifikan secara statistik pada α=0.05 (pvalue=0.005) antara mengikuti program WVI dengan yang tidak mengikutinya.Tingkat pengetahuan hak partisipasi yang mengikuti program WVI lebih tinggi(76%) daripada yang tidak mengikutinya (48%). Partisipasi dalam keluargaterdapat perbedaan signifikan secara statistik pada α=0.05 (p-value=0.025)dimana partisipasi dalam keluarga yang mengikuti program WVI lebih tinggi(64%) daripada yang tidak mengikutinya (41%). Hal ini menunjukkan perlunyauntuk menfasilitasi forum anak menjadi wadah sosialisasi hak anak termasuk hakpartisipasi.

ABSTRACTAs the next generation, children until now are still in poor condition. Childrenneed to be socialized to be able to express the aspirations of their rights related totheir interests and needs. World Vision Indonesia (WVI) as an NGO that focuseson children had socialized child rights through program which transferparticipation rights values. The program is a interests and talent group (such asdance, indoor soccer, music), Children's Forum regular meetings, education andcelebration. Quantitative research was conducted on 94 children assisted WVIADP Kebon Pala, East Jakarta. It consists of 50 children who attend the programWVI and 44 children who did not follow within the past year. The goal is todetermine whether there are differences in knowledge and participation rights ofparticipation in the family of the two groups. The results showed different levelsof knowledge of the rights of participation are statistically significant at α = 0.05level (p-value = 0.005) between children who attend the WVI program andchildren that does not follow. The level of knowledge of rights WVI programparticipation is higher (76%) than those not followed (48%). Participation in thefamily show that there is a statistically significant difference at α = 0.05 level (pvalue= 0.025) where participation in the family who attend the program WVIhigher (64%) than those not followed (41%).
