Usaha uniuk memperkenalkan hukum mengcnai pengungsi telah mulai dilakukan di Indonesia sejak tahun 1981 dan mulai dilakukan secara inlensif sejak tahun 1998 yang menghasilkan beberapa perkembangan. Hal tcrsebut nampak dari adanya kelentuan yang secara implisit terdapat pengaturan mengenai pengungsi yaitu Undang-Undang No. 37 Tahun 1999 tentang Hubungan Inlemasional, Selain itu, telah dikeluarkan beberapa peraturan nasional yang terkail dengan pengungsi, aniara lain Sural Edaran Perdana Menleri RI No. I1/RI/I956 tenlang Perlindungan Pelarian Politik, Keputusan Presiden No. 38 Tahun 1979 tentang Koordinasi Penyclesaian Masalah Pengungsi Vietnam di Indonesia, dan Keputusan Presiden No. 3 Tahun 2001 tenlang Badan Koordinasi Nasionai Penanggulangan Bencana dan Penanganan Pengungsi. Tulisan ini menjelaskan mengenai perkembangan dari hukum pengungsi di Indonesia dan posisi Indonesia terhadap Convention relating to the Status of Refugee 1951 dan Protocol relating to the Status of Refugee 1967.

Abstrak :
Throughout the world and over the centuries, societies have welcomed frightened, weary foreigners, the victims of prosecution and violence in their place of habitual residence. Basically every State has the responsibility of protecting refugees and asylum seekers within its territory. Protection of refugees and asylum seekers is a classical issue in International law. Nowadays more than 140 States have adopted International Instruments of Refugee Law. Eventhough the right to seek asylum has been enshrined in the Indonesian Constitution and the Human Rights Act: up to now Indonesia has not ratified or acceded to any international instrument on Refugees and has no national operational legislation dealing with the protection of refugee and asylum seeker. The objective of this paper was to discuss the urgency and the stumbling blocks of incorporating international instruments on Refugees into the Indonesian law. It should be born in mind that a national legislation concerning the protection of refugees and asylum seekers indicate commitment of a State to the protection and promotion of Human Rights in general An incorporation of refugee laws into the Indonesian legal system would fill the gap concerning the unavailability of operational legal instrument dealing with refugees and asylum seekers in Indonesia.

Abstrak :
Being a transitory destination, Indonesian has been drawn into the problem of refugees. Since 1979, when Vietnam was tormented by war, up to the recent times, when turmoil and instability erupted in the Middle East and South East, thousands of refugees have fled their countries and Indonesia has received the causative predicaments of their being illegally stranded in Indonesian territory.
Indonesia as not a party to the 1951 UN Convention relating to the Status of Refugees and its Protocol of 1967. Thai being the case, Indonesia is no! the legal obligations of the convention. However, Indonesia has established a strong legal basis concerning human rights (including the aspect of asylum and refugees) Decision of the People's Consultative Assembly TAP MPR XVtl/MPR/1997 on Human Rights, Law no.37/1999 on Foreign Relations and Law no.39/1999 on Human Rights. Indonesia's handling of refugees problems is a testimary of Indonesia's determination in upholding human rights. Therefore, an administrative circular nose issued set by the Director General of Immigration on 20 September, 2002 on the Directions to Procedure of Handling the Self-claimed Asylum Seekers and Refugees.
Indonesian immigration authority allows UNtiCR and IOM to give temporary protection and facilitation by U\HCR protection officer. The two international organizations managed to resolve the refugee problems, namely by managing voluntary return or resettlement to third countries. Meanwhile, operational regulations to execute refugees and asylum seekers handling in Indonesia as preseribed in the above mentioned laws are still pending. In the future, alternatively, immigration law shall include hitman rights values without abandoning the immigration selective policy.

Skripsi ini pada dasarnya membahas mengenai kerjasama negara sebagai bagian dari masyarakat internasional dalam penanganan serta perlindungan pengungsi yang datang ke wilayah suatu negara secara masal ditinjau dari sudut pandang hukum internasional. Konsep kerjasama yang kemudian dikenal sebagai konsep burden sharing ini berakar dari prinsip kerjasama serta solidaritas internasional yang berkembang sebagai suatu prinsip yang disetujui oleh negara-negara dan sebagai suatu prinsip hukum yang dikenal secara umum di dunia. Pertanyaan mendasar tulisan ini adalah bagaimana konsep tersebut berlaku dalam hukum internasional dan bagaimana penerapannya oleh Indonesia.
Penelitian yang dilakukan Penulis ini berujung pada suatu hasil bahwa konsep burden sharing ini merupakan konsep yang masih berkembang sehingga tidak ada acuan rigid dalam penerapannya. Maka dari itu, mekanisme penerapannya di berbagai belahan dunia berbeda-beda namun dengan tujuan utama yang sama yaitu berbagi beban secara adil. Terkait dengan Indonesia, konsep ini memiliki keterkaitan dengan Indonesia dengan posisi Indonesia sebagai negara yang membutuhkan bantuan negara lain dalam menangani permasalahan pengungsi masal, khususnya pengungsi-pengungsi Rohingya. Kebutuhan Indonesia akan kontribusi negara lain dalam penanganan permasalahan pengungsi masal ini terlihat dari pandangan-pandangan Indonesia yang terindikasi dari pernyataan perwakilan-perwakilan negara di berbagai konferensi internasional yang diikuti Indonesia yang membahas mengenai solidaritas negara dalam menangani pengungsi masal.
Penelitian ini dilakukan dengan melakukan tinjauan pustaka serta wawancara dengan pihak terkait seperti Kementerian Luar Negeri dan UNHCR Indonesia. Saran penulis terkait dengan isu ini adalah bahwa sebagai bagian dari masyakat internasional, negara-negara di dunia harus senantiasa memberikan kontribusinya terhadap penanganan pengungsi masal yang tentu akan sangat berat apabila hanya ditangani oleh satu negara saja.

This study basically explains about cooperation between states as part of international community in handling and protecting the refugees which arrive in one's territory massively, observed from international law standpoint. The concept of cooperation, which is further known as burden sharing concept, is rooted from the principle of international cooperation and international solidarity which is developing as a principle agreed by states and are widely recognized as a general principle of law. The fundamental question of this writing is how such concept exist under international law and how is the implementation by Indonesia.
This research leads to a conclusion that burden sharing is a concept that is still evolving so that there is no rigid guidance in the implementation yet. Therefore, there are varieties of implementation mechanisms among states, but the ultimate purpose remains the same, that is equitable distribution of burden. In relation with Indonesia, this concept has a connection with the fact that Indonesia is a state which needs support from other countries in handling the mass influx of refugees, especially the Rohingyan refugees. Indonesia's need of others'contribution in handling this problem is seen from the views indicated from Indonesia's representatives statement in a number of international conferences attended by Indonesia on solidarity of states in facing the mass influx of refugees.
This research is conducted by having a literature review and field interview with several concerned institutions such as Foreign Ministry of Indonesia and UNHCR Indonesia. It is author advise that as part of international community, states should always assert their contribution in accommodating the mass influx of refugees which certainly would very burdening if it is handled only by one state.
