Amerika Serikat dikenal sebagai negara yang paling protektif terhadap ancaman perdagangan internasional. Pada kasus ini Indonesia terkena imbas dari sifat protektif tersebut. Hal ini tidak terlepas dari kesadaran Amerika Serikat dalam memproteksi industri dalam negeri mereka. Tercerminkan pada United States Tariff Act of 1930 yang dirumuskan jauh sebelum adanya organisasi perdagangan internasional dan peraturan tersebut terus di amandemen seiring dengan adanya putaran di dalam GATT. Tesis ini mencoba menganalisis penetapan bea masuk antidumping yang dikenakan kepada Indonesia pada tahun 2010 berdasarkan perbandingan antara undang-undang Amerika Serikat dengan Agreement on Implementation of Article VI of The General Agreement on Tariffs And Trade 1994 (ADA) yang merupakan perjanjian internasional yang mengatur tentang penerapan antidumping ditingkat perdagangan internasional.

ABSTRACT
United States is known to be the most protective country to the threat of international tread. In this particular case, Indonesia is a affected by United States protectiveness. It is due to the concern of the United States to protect its domestic industry. It is reflected in the United States Tariff Act of 1930 that was codified way before the establishment of international trade organization; and that Act was continuously amended, as the GATT rounds persist. This thesis tries to analyze the imposition of antidumping duties to Indonesia that was occurred in 2010, by comparing the United States’ Act with the Agreement on Implementation of Article VI of The General Agreement on Tariffs and Trade 1994 (ADA) which is an international treaty that governs the imposition of antidumping measure in international level, United States is known to be the most protective country to the threat of international tread. Tesis ini membahas mengenai penerapan safeguards berupa Bea Masuk Tindakan Pengamanan (BMTP) terhadap impor produk kertas dan kertas karton dilapisi, tidak termasuk kertas uang sebagai upaya melindungi industri dalam negeri ditinjau dari persyaratan yang diatur dalam ketentuan safeguards dan pertimbangan kepentingan nasional. Penelitian ini bersifat yuridis normatif dan preskriptif. Hasil penelitian menyimpulkan bahwa penerapan safeguards terhadap impor produk tersebut telah sesuai dengan persyaratan yang diatur dalam ketentuan safeguards dan memenuhi unsur pertimbangan kepentingan nasional. Berdasarkan data impor tahun 2015? 2016 dapat disimpulkan bahwa penerapan BMTP bagi produk tersebut cukup mampu mengurangi lonjakan impor

ABSTRACT
This thesis discusses the application of safeguards (BMTP) against imports of coated paper and paperboard in an effort to protect domestic industries in terms of the requirements stipulated in the provisions of safeguards and considerations of national interests. This study is normative and prescriptive. The study concluded that the application of safeguards against imports of the product complies with the requirements set out in the provisions of safeguards and meet the elements of national interest considerations. Based on data of imports in 2015- 2016 it can be concluded that the application of BMTP is quite capable of reducing imports surge.

Abstrak :
Penelitian ini membahas mengenai Peraturan Menteri Keuangan Republik Indonesia Nomor 165/PMK.010/2015 tentang Pengenaan Bea Masuk Tindakan Pengamanan Terhadap Impor Produk Coated Paper dan Paper Board, serta dampaknya terhadap industri coated paper Indonesia. Penelitian ini menggunakan pendekatan kualitatif dengan memanfaatkan Competition Assessment Tool Kit (Tool Kit Penilaian Persaingan Usaha). Terdapat 7 (tujuh) indikator persaingan usaha yang digunakan sebagai obyek pengukuran dampak persaingan, yaitu pelaku usaha lama (incumbent), perusahaan baru, harga coated paper, kualitas dan keragaman produk coated paper, inovasi, pertumbuhan pasar, dan pasar terkait. Berdasarkan hasil penelitian, dapat disimpulkan bahwa bahwa pemberlakuan kebijakan tersebut tidak berdampak secara signifikan dalam mempengaruhi persaingan usaha pada industri coated paper dibandingkan periode sebelum diberlakukannya kebijakan tersebut. Meskipun demikian, terdapat beberapa dampak negatif yang ditimbulkan yaitu terhadap pelaku usaha lama (pemasok produk impor), perusahaan baru, harga, pertumbuhan pasar dan pasar terkait. Namun disisi lain, kebijakan tersebut tidak mempengaruhi turunnya kualitas, keragaman dan inovasi produk coated paper. ......This study discuss the Financial Ministery regulation No. 165 / PMK.010 / 2015 about imposing safeguard measure and its impact to Indonesian coated paper and paper board industry. The research used a qualitative approach by utilizing the OECD Competition Assessment Tool Kit. There are 7 (seven) indicators of competition used as the object of measuring the competition impact; the incumbent of business actor, the new entrant, coated paper price, the quality and diversity of coated paper products, innovation, market growth, and related markets.. It can be concluded that the policy implementation has no significant impacts to competition in the coated paper industry than before the implementation of the policy. The policy also has negative impacts to the incumbent of business actor, the new entrant, coated paper price, market growth and related markets. While the positive impacts were no decline in the quality, diversity and innovation of coated paper products.
