Skripsi ini membahas tentang upaya industri film Hollywood untuk mencegah pembuatan peraturan sensor film resmi baik dari pemerintah daerah maupun pemerintah pusat Amerika Serikat. Pihak Hollywood membentuk Motion PictureProducers and Distributors of America (MPPDA) untuk menjadi badan pengawas yang mengatur produser-produser film agar menghasilkan film-film yang bersih dari adegan tidak bermoral. Hal ini dilakukan untuk menghindari tuntutan masyarakat terhadap Hollywood. Selama MPPDA berdiri sejak 1922, tidak ada pembuatan peraturan sensor resmi baik di negara bagian maupun pemerintah pusat. MPPDA berhasil meyakinkan masyarakat bahwa film-film yang diproduksi Hollywood aman untuk ditonton.

ABSTRACT
This thesis discusses about the Hollywood movie industry efforts to prevents the making of official film censorship regulation, from both local government and the fedral goverment of United States. Hollywood form the Motion Picture Producers and Distributors of America (MPPDA) to be a regulatory body that regulates film producers to produce movies that are clean of immoral scenes. During MPPDA stood since 1922, there was no official censorship legislation in both the state and rederal governments. MPPDA managed to convince the public that the films produced by Hollywood is safe to watch.

Film adalah karya seni budaya yang merupakan pranata sosial dan media komunikasi massa, dan sensor merupakan filter untuk menentukan apa yang patut diperlihatkan dan apa yang tidak patut diperlihatkan. Dalam hal penyensoran film, wewenang tersebut dimiliki oleh Lembaga Sensor Film sebagai suatu representasi peran negara untuk melindungi Indonesia dari budaya yang bersifat destruktif bagi budaya Indonesia. Namun sebagai pelindung budaya, Lembaga Sensor Film tidak memiliki parameter yang jelas dalam menjalankan kegiatan penyensoran dan penentuan penggolongan usia penonton sehingga cenderung menjadi multi- interpretatif dan sangat bersifat subyektif. Kelenturan ketentuan tersebut mengakibatkan mudahnya suatu film yang hendak rilis untuk disetir sesuai dengan kepentingan pihak yang memegang kekuasaan. ...... Film as a form of art has the capacity of visual communication, and censorship is a filter thats used to determine what is proper to be shown to the public and whats not. The authority to censorize film is given to the Board of Film Censorship to represent the Indonesian governments willingness to protect Indonesia from something that could possibly destroy Indonesias culture but Board of Film Censorships regulation seems too abstract because of the seemingly loose parameter therefore it could cause some multi-interpretation, a higher possibility of unobjective assessment of the film for the sake of fulfilling the regimes interest.

Netflix adalah salah satu layanan hiburan terkemuka di dunia dengan sekitar 222 juta keanggotaan berbayar di lebih dari 190 negara yang menyajikan layanan streaming serial TV, dokumenter, film layar lebar, dan gim seluler dalam berbagai genre dan bahasa. Undang-Undang Perfilman mewajibkan sensor untuk pertunjukan film pada jaringan teknologi informatika, termasuk internet didalamnya. Akan tetapi, Netflix belum tunduk pada ketentuan mengenai sensor film. Penulis akan membahas status hukum Netflix sebagai perseroan, PSE Asing, Pelaku Usaha PMSE, dan usaha perfilman. Penelitian ini menggunakan metode penelitian hukum yuridis-normatif, yakni penelitian hukum yang mencakup penelitian terhadap prinsip-prinsip hukum dan sistematika hukum, sejarah hukum, dan perbandingan hukum, dimana penelitian dilakukan dengan cara meneliti bahan pustaka, atau disebut juga dengan penelitian kepustakaan. Tanpa adanya entitas usaha yang berbadan hukum Indonesia, operasional Netflix seolah dibiarkan. Aturan bidang perfilman yang tidak adaptif dengan kemudahan perizinan berusaha, ditambah dengan ketiadaan koordinasi antara Lembaga Sensor Film dengan Ditjen Aptika melemahkan penegakkan hukum terhadap Netflix. Berdasarkan penjabaran tersebut, Netflix seharusnya tunduk pada ketentuan mengenai sensor film yang berlaku pada masing-masing operasionalnya. Solusi yang penulis ajukan antara lain: melakukan revisi pada aturan perfilman, peningkatan sinergi antara LSF dengan Ditjen Aptika, digital presence, dan kualifikasi tambahan pada pertunjukan fiilm melalui jaringan teknologi informatika. ......Netflix is one of the world's leading entertainment services with approximately 222 million paid memberships in over 190 countries serving streaming TV series, documentaries, feature films, and mobile games in a variety of genres and languages. The Film Act requires censorship for film performances on information technology networks, including the internet in them. However, Netflix has not been subject to provisions regarding film censorship. The author will discuss Netflix's legal status as a company, Foreign ESP, e-commerce, and film business. This research uses juridical-normative legal research methods, namely legal research which includes research on legal principles and legal systematics, legal history, and legal comparisons, where research is carried out by researching library materials, or also known as literature research. Without a business entity incorporated in Indonesia, Netflix's operations seem to be allowed. Non-adaptive film rules with ease of business licensing, coupled with the lack of coordination between the Film Censorship Agency and the Directorate General of Infromatics Aplication weakened law enforcement against Netflix. Based on these descriptions, Netflix should be subject to the provisions regarding film censorship that apply to their respective operations. The solutions proposed by the author include: revising film rules, increasing synergy between LSF and the Directorate General of Infromatics Aplication, digital presence, and additional qualifications for fiilm performances through information technology networks.
