Abstrak :
Tesis ini membahas mengenai apakah Palestina dapat dikategorikan sebagai Negara berdasarkan hukum internasional dan bagaimana status hukum alien occupation Israel atas Palestina berdasarkan hukum humaniter internasional. Penelitian ini adalah penelitian normatif dengan desain deskriptif. Hasil penelitian menyimpulkan bahwa Palestina dapat dikategorikan sebagai suatu Negara berdasarkan hukum internasional; pendudukan Israel atas Palestina dapat dikategorikan sebagai alien occupation berdasarkan hukum humaniter internasional, namun Israel melanggar aturan-aturan dalam Hague Regulation, Konvensi Jenewa 1949, dan Protokol Tambahan I 1977.
......This thesis discusses about whether the Palestinians can be categorized as a State under international law and how the legal status of the alien occupation of Palestine by Israel based on international humanitarian law. The study was a normative study with a descriptive design. The study concluded that Palestine can be categorized as a State under international law; Israel's occupation of Palestine can be categorized as an alien occupation under international humanitarian law, but Israel has violated the rules of the Hague Regulations, the Geneva Conventions 1949 and Additional Protocol I 1977.
