Tesis ini membahas mengenai perlunya perlindungan hukum terhadap kurator. Kurator adalah suatu profesi yang diangkat oleh Pengadilan Niaga untuk melakukan pengurusan dan pemberesan harta pailit. Dalam prakteknya, banyak hambatan yang ditemui di lapangan ketika kurator menjalankan tugasnya. Walaupun telah diputus pailit oleh pengadilan dan harta pailit milik debitor sudah berada dalam penyitaan umum, ada saja debitur yang tidak kooperatif dengan keberadaan kurator untuk pengurusan harta perusahaannya. masalah lain yang dihadapi kurator dalam melaksanakan tugas yaitu, dilaporkannya kurator oleh debitur pailit kepada instansi kepolisian. Hal ini menunjukkan perlindungan terhadap kurator belum maksimal karena belum ada jaminan hukum yang jelas untuk melindungi tugas kurator. ...... This thesis covers about legal protection which should be given to curator. Curator is a profession that appointed by the Commercial Court to carry out Management and Settlement of the Bankruptcy estate. In practice, there are a lot of obstacles are founded in the field when Curator do their duty. Although the Bankruptcy has been stated by the court, and all bankruptcy estate of debtor are already in general foreclosure there are debtors who do not cooperate with the existence of the Curator in charge for management of their company's properties. Another problem which is encountered in practice that the Curator was reported by the bankrupt debtor to the police. It shows that the Legal Protection of the curator is not maximized because there is no clear guarantee to protect the Curator.
