Abstrak :
Tesis ini membahas mengenai perebutan klaim kebenaran dalam memandang semburan lumpur Lapindo yang berimplikasi terhadap bagaimana aktor-aktor mengkonstruksi tata lingkungan dan sosial akibat semburan. Penelitian ini adalah penelitian kualitatif dengan desain pemahaman (etnografi). Hasil penelitian menunjukkan bahwa setiap aktor dalam kasus Lapindo mengkonstruksi pengetahuan dalam memaknai fenomena semburan. Dengan menginspirasi teori kekuasaan Foucault, negara merupakan aktor dominan yang berkepentingan agar seluruh penyelesaian kasus mengacu pada skema Perpres. Sementara pada ranah relasi kekuasaan, Lapindo dan aktivis merupakan aktor dominan yang berkepentingan membentuk korban sebagai governable subject. Tesis ini menganalisa kasus Lapindo tanpa berpretensi berpihak pada salah satu pandangan, yang dengan itu mungkin dapat menghadirkan pandangan dalam melihat persoalan secara lebih kritis. The focus of the study is how some actors claiming the truth in looking at Lapindo mud which implicate how some actors construct environmental and social order. This research is qualitative understanding interpretive. This thesis explores how some actors construct knowledge to look at the mud flow phenomena. Inspired by Foucauldian theory of power, state is a dominant actor concern to impose the governmental rule through the case. In the light of power relation, Lapindo and activist are dominant actor concern to construct the victim as governable subject. By analyzing Lapindo case without any pretention in one of the scientist overview, this study provides critical understanding for this environmental and social problem.

Abstrak :
Since hot mud flowed the earth in the subdistrict of Porong, Sidoarjo May 29th 2006, there were social and economic impacts have been suffered by local people and their surroundings, mainly compensation was regulated. This research using qualitative approach and find out that there were tripartie relation of state, corporate, and society are inequal. Lapindo as a corporative showed more significant role and power than state. State not yet showed maximally power (weak state) for protect their citizen right. So, state have to the significant role (strong state) while interact to Lapindo for accelerate the solution of social and economic impact in society of Sidoarjo

Oftentimes, the link between ethics and business escapes our notice. Business practices in Indonesia often wax corruptive and conspiring, with the misuse of representation and power, and rife with immorality. Yet, business is precisely often related to economic power and the ways of controlling it. Ethics allows the science of business to develop virtues through each action that involves the use of economic power. Truly ethical conduct is the dream of every man. That is why doing business should not be equated to"dirty play". Aristotle can become a reference point for the study of national ideals organized by a government that is just and good. The discussion of this topic takes the mudflow case of Lapindo in Sidoarjo as an example. We hope that this study could be a little contribution to the study of ethics in the national life of Indonesia and the social life of our people, two things that one feels is continually s into the mire as time passes.

Putusan pengadilan terhadap gugatan yang diajukan oleh WALHI dan YLBHI terkait kasus Lapindo telah berkekuatan hukum tetap (inkracht), meskipun dinilai tidak dapat membuktikan hubungan kausalitas antara gempa bumi dengan luapan lumpur, selain hanya menyatakan bahwa semburan lumpur di area BJP-1 merupakan fenomena alam. Hakim telah tidak menggunakan pendekatan ilmiah untuk mendapatkan fakta ilmiah (scientific fact) dalam menetapkan putusan hukumnya karena fakta hukum memuat fakta ilmiah. Putusan pengadilan tidak dapat membuktikan tentang adanya hubungan kausalitas antara gempa bumi Bantul/Yogyakarta/Klaten dengan luapan lumpur yang terjadi di Porong Sidoarjo. Putusan tersebut telah menimbulkan pendapat-pendapat kontroversial yang mengemuka baik itu dari kalangan ilmuwan terutama ilmuwan tentang geologi/gempa bumi dan ilmuwan/ahli hukum maupun warga masyarakat. Tujuan dilakukannya penelitian ini bukan untuk menjustifikasikan bahwa Lapindo Brantas benar atau salah ataupun memandang bahwa putusan yang sudah berkekuatan hukum tetap tersebut merupakan putusan pengadilan yang tidak benar, selain untuk melihat implikasi ekonomi yang dapat timbul dari suatu penegakan hukum yang menggunakan dan/atau menerapkan asas-asas hukum dan konsep-konsep hukum tentang strict liability. Pendekatan melalui strict liability sebagai suatu konsep hukum yang telah dituangkan dalam undang-undang sebagai norma hukum dipandang dapat ditelusuri dan dianalisis dengan pendekatan ekonomi melalui pendekatan critical legal studies (CLS) yang memandang hukum melalui pandangan teori sosial, sebagai social institution, akan mempunyai arti yang penting dalam menegakkan keadilan bagi masyarakat yang terkena dampak.
Court ruling against a lawsuit filed by WALHI and related YLBHI Lapindo case has legal force and inkracht, although deemed unable to prove causality between an earthquake with a flood of mud, in addition to simply stating that the mudflow in the area of BJP-1 is a natural phenomenon. The judge was not using a scientific approach to get the scientific facts in setting legal decision because the legal facts contain scientific facts. The court's decision not to prove the existence of causality between the earthquake in Bantul / Yogyakarta / Klaten with mudflow that occurred in Porong Sidoarjo. The verdict has led to controversial opinions which arise either from among scientists, especially scientists about the geology / earthquakes and scientists / experts or legal residents. The purpose of this study is not to justify that Lapindo Brantas is right or wrong or who considers that the decision has legal force and equipment is a court ruling that is not true, other than to look at the economic implications that may arise from a law enforcement use and / or apply the principle of law and legal concepts of strict liability. Approach through strict liability as a legal concept that has been poured in the law as a legal norm is seen to be traced and analyzed with the economic approach through the critical legal studies approach (CLS) which looked at the law through the view of social theory, as a social institution, will have meaning important role in upholding justice for the affected communities.

Peristiwa terjadinya letusan lumpur dan gas secara tidak terkendali dari lubang 150 meter dari LUSI (Lumpur Sidoarjo) sumur pengeboran eksplorasi hydrocarbon yang terus menerus keluar hingga ± 160.000 m³ per hari. Ketika laju aliran lumpur di dalam pipa berjalan lambat terjadi pengendapan pada bagian bawah, hanya cairan yang mengalir di atasnya. Sebaliknya, ketika aliran kecepatan terlalu tinggi menaikkan kerugian jatuh tekanan dan abrasi pada dinding pipa. Aliran dalam pipa spiral pada jarak langkah yang konstan menyebabkan aliran terus bercampur akibat perputaran sehingga dapat mencegah pengendapan. Tujuan dari penelitian ini yaitu untuk mengetahui kerugian jatuh tekanan (minor losses) dan distribusi kecepatan pada pipa circular lengkung dan spiral lengkung. Pengukuran distribusi kecepatan di dalam pipa spiral lengkung untuk dapat mengetahui proses pengendapan lumpur menggunakan alat pitot tube pada lokasi ? = 45º dan pengunaan manometer untuk mengukur minor loses. Minor losses yang terjadi pada pipa circular lengkung lebih kecil dibanding pada pipa spiral lengkung. Namun, untuk konsentrasi kepadatan lumpur 50%, pada Re = 2x10³ terjadi penurunan minor losses pada pipa spiral sehingga berhimpit dengan pipa circular. Distribusi kecepatan pada pipa circular lengkung berbeda dengan pipa spiral lengkung. Dimana untuk pipa circular lengkung, D = 24.6 mm terjadi ketebalan kecepatan minimum 0.42 m/s lebih besar dibanding ketebalan kecepatan minimum 0.36 m/s pada pipa spiral lengkung P/D = 6.7. Hal ini menunjukkan bahwa pada pipa circular lengkung pada kecepatan tertentu terjadi pengendapan sedangkan pada pipa spiral kengkung belum terjadi pengendapan. Variasi kepadatan Lumpur yang digunakan yaitu 50% dan 30%, dengan diameter rata-rata Lumpur adalah 5x10-³ mm. ......Events of mud and gas eruption is not controlled from the hole 150 metres from LUSI (Lumpur Sidoarjo) hydrocarbon exploration wells drilling continuing approximately 160,000 m³ per day. When the mud flow rate in the pipe slow subsidence occurred at the bottom, only the fluid that flows in pipe. Conversely, when the flow speed is too high increasing the pressure and the loss falls on the pipe wall abrasion. Spiral flow in a pipe at a constant distance measures the flow velocity due to continued mixing so as to prevent sedimentation. The purpose of this study is to determine the loss of pressure fall (minor losses) and the velocity distribution in curved circular and curved spiral pipes. Measurement of velocity distribution inside the curved spiral pipe to know process of settling of the mud using a pitot tube at a ? = 45º and using manometer to measurement of minor losses. Minor loses that occur in curved circular pipe is less than the curved spiral pipe. However, for the concentration density of mud 50%, at Re = 2x10³ minor decrease spiraling losses in the pipe so that coincide with a round pipe. Velocity distribution in curved circular pipe is different from the curved spiral pipe. Where to curved circular pipe, D = 24.6 mm occurred a minimum speed of 0.42 m/s greater than the thickness of a minimum speed of 0.36 m / s on the curved spiral pipe P / D = 6.7. This shows that the curved circular pipe at a certain speed while precipitation occurs in the curved spiral pipe has not occured. Mud density variations that are used are 50% and 30%, with an average diameter of Mud is 5x10-³ mm.
