Industri properti adalah sebuah industri yang terkait hampir dengan semua jenis industri lainnya. Keunikan lain dari properti adalah sebagai salah 1 kebutuhan dasar manusia. Kedua hal ini membuat industri property dipilih dalam proses pemilihan industri. Pemilihan PT. Summarecon Agung Tbk. sebagai perusahaan yang dianalisis didasarkan pada 3 hal yaitu perubahan profitabilitas perusahaan dari penurunan berturut-turut menjadi kenaikan berturut-turut, keunggulan dibandingkan 2 perusahaan property tbk besar lainnya yang dipilih sebagai pembanding dalam proses seleksi, dan profitabilitas perusahaan di tahun 2013 yang di atas rata-rata industry. Keunggulan-keunggulan ini telah membuat PT. Summarecon Agung Tbk. menjadi sangat menarik untuk dianalisis, khususnya mengenai strategi korporasi, strategi bisnis, strategi keuangan, dan corporate action yang telah diterapkan oleh PT. Summarecon Agung Tbk. Analisis dan pembahasan ini akan dilakukan terhadap strategi-strategi korporasi dan tindakan-tindakan penting dari SMRA tahun 2004 sampai dengan tahun 2013 yang terbagi atas 4 periode. Kemudian akan dilanjutkan dengan analisis dan pembahasan strategi keuangan yang mencakup pertumbuhan, investasi, pendanaan, operasional, profitabilitas, resiko, kinerja keseluruhan, dan nilai dari PT. Summarecon Agung Tbk. terkait strategi-strategi dan tindakan-tindakan korporasi selama 4 periode tersebut.
ABSTRACT
Real estate industry is an industry that related almost with all kinds of other industries. Another uniqueness of real estate, namely as one of the basic needs of human. Both of these make industrial real estate selected in the industry selection process. Selection PT. Summarecon Agung Tbk. as analyzed company is based on three things: the change of the company's profitability consecutive reduction into consecutive rise, advantages over two other major public real estate company selected as a comparison in the selection process, and the profitability of the company in 2013 were above the industry average. These advantages made PT. Summarecon Agung Tbk. become very interesting to be analyzed, particularly regarding corporate strategy, business strategy, financial strategy, and corporate action that has been applied by PT. Summarecon Agung Tbk. Analysis and discussion will be conducted on corporate strategies and critical actions of SMRA from 2004 to 2013, divided into 4 periods. Then will proceed with the analysis and discussion of the financial strategy that includes growth, investment, financing, operations, profitability, risk, overall performance, and the value of the PT. ABSTRAK
Pembentukan peraturan perundang-undangan desain industri di Indonesia tidak didasarkan pada kepentingan dan kebutuhan dari masyarakat Indonesia itu sendiri, melainkan sebagai konsekuensi dari keikutsertaan Indonesia dalam persetujuan TRIPs-WTO. Masyarakat Indonesia pada umumnya masih menjunjung tinggi rasa kebersamaan atau komunalistik dan masih mengedepankan nilai-nilai spiritualistik, sedangkan rezim HKI menganut nilai kapitalistik dan mengedepankan kepentingan individu (individualistik). Benturan karakter atau nilai tersebut turut menjadi faktor yang mengakibatkan ketidakefektifan implementasi ketentuan-ketentuan hukum HKI di dalam masyarakat. Hal inilah yang terjadi di dalam masyarakat pengrajin perak Kotagede. Rasa asing terhadap sistem perlindungan HKI menyebabkan pemahaman masyarakat pengrajin perak Kotagede terhadap Hak Kekayaan Intelektual sangat kurang Hasil penelitian menunjukkan bahwa 67,6% masyarakat pengrajin perak Kotagede tidak mengetahui adanya Undang-Undang Nomor 31 Tahun 2000 tentang Desain Industri yang memberikan perlindungan hukum bagi produk desain kerajinan perak mereka. Dalam penelitian diperoleh data bahwa belum ada satupun masyarakat pengrajin perak di Kotagede yang mendaftarkan produknya ke dalam perlindungan hukum desain industri. Hanya 26,5% saja yang memiliki keinginan untuk mendaftarkan produknya, sedangkan sisanya 73,5% responden tidak memiliki keinginan tersebut. Hal ini menunjukkan bahwa tingkat ketidakpedulian masyarakat pengrajin perak terhadap HKI masih sangat tinggi. Dalam penelitian ini dilakukan uji korelasi dan uji regresi linier/uji pengaruh antara variable nilai-nilai budaya masyarakat dengan sikap keberatan reponden atas peniruan desain produknya oleh orang lain. Diperoleh kesimpulan bahwa antara variable nilai budaya “rame ing gawe suci ing pamrih”, “gotong royong” dan “etika berbagi” dengan sikap keberatan reponden atas peniruan desain produknya terdapat korelasi/hubungan yang kuat, signifikan dan tidak searah. Semakin tinggi adanya kontak dengan nilai budaya tersebut maka masyarakat pengrajin perak Kotagede akan semakin tidak keberatan apabila desain produknya ditiru oleh orang lain. Variabel-variabel nilai budaya tersebut mempengaruhi sikap keberatan reponden atas peniruan desain produknya oleh orang lain.
ABSTRACT
The drafting of industrial design legislation in Indonesia is not based on the interests and needs of the people of Indonesia itself, but rather as a consequence of Indonesia's participation in the WTO-TRIPs agreement. Indonesian society in general still uphold a sense of togetherness or komunalistik and still promoting the values of spiritualistic, while the IPR regime adopted capitalistic values and promotes the interests of the individual (individualistic). Clash of the characters or the value is also a factor resulting in ineffectiveness implementation of the provisions of IPR laws in society. This is what happens in society silversmith Kotagede. People are unfamiliar with the IPR protection system, therefore caused the public's understanding to Intellectual Property Rights is very less. The results of research showed that 67.6% of the silversmith Kotagede do not know the Law No. 31 Year 2000 on Industrial Design that provides legal protection for product design their silver. In this case showed that no one in silversmith Kota Gede who register their products to the legal protection of industrial designs. Only 26.5% who have a desire to register their products, while the remaining 73.5% of respondents have no such desire. This suggests that the level of public indifference towards IPR still very high. In this study tested the correlation and linear regression test of variable cultural values with the objection’s attitude of respondents if his/her product design imitated by others. It is concluded that with the variable cultural values “rame ing gawe suci ing pamrih”, “gotong royong” and “etika berbagi”and the objection’s attitude of the respondents if his/her product design imitated by others there is a strong correlation/relationship, significant and not unidirectional. Variables cultural values influence objection’sattitudes respondents if his/her product design imitated by others.

Digitalisasi sebagai bagian dari perkembangan saat ini telah membentuk pasar baru bagi pelaku usaha, khususnya perusahaan teknologi, yaitu pasar digital. Google sebagai pelopor di pasar digital menjadi pemain terkemuka dan dengan demikian memegang posisi dominan di beberapa pasar digital termasuk Android App Store dan layanan pencarian umum. Namun, Komisi Eropa menemukan bahwa Google telah menyalahgunakan posisi dominannya di pasar Android App Store dan melanggar Pasal 102 TFEU melalui Mobile Application Distribution Agreement (MADA) yang salah satu ketentuannya mewajibkan produsen smartphone untuk melakukan pre-install Google Search App sebagai prasyarat untuk mendapatkan Play Store. Praktik yang dilakukan oleh perusahaan-perusahaan teknologi besar inilah yang memengaruhi implementasi Undang-Undang Pasar Digital di Uni Eropa untuk menciptakan persaingan yang sehat dalam ekonomi digital. Oleh karena itu, tujuan dari penelitian ini adalah untuk menilai apakah Google menyalahgunakan posisi dominannya dan melakukan penjualan bersyarat (tying) sesuai dengan Pasal 25 dan 15 Undang-Undang Nomor 5 Tahun 1999, serta menganalisis peraturan persaingan yang dapat mengatur persaingan secara efektif dalam ekonomi digital. Metode penelitian yang digunakan adalah yuridis normatif yang dilakukan dengan menganalisis data sekunder dengan menggunakan metode kualitatif. Penelitian ini menemukan bahwa praktik Google termasuk sebagai pelanggaran berdasarkan Undang-Undang Nomor 5 Tahun 1999 dan hukum persaingan di Indonesia belum memadai untuk mengatur persaingan di pasar digital secara efektif. Dengan demikian, penting bagi otoritas persaingan Indonesia untuk memberlakukan peraturan persaingan pada pasar digital yang menerapkan kewajiban dengan pendekatan per se illegal dan menerapkan prinsip ekstrateritorial. ......Digitalization as an imminent part of current development has established a new market for business actors, especially tech companies, namely the digital market. Google, as the forerunner in the digital market became a prominent player and thus hold dominant positions in several digital markets including Android App Store and general search service. However, the European Commission found that Google has abused its dominant position in the Android App Store market and violated Article 102 TFEU through Google’s Mobile Application Distribution Agreement (MADA) which one of the provisions obligates smartphone manufacturers to pre-install Google Search App as a pre-requisite for obtaining the Play Store. These kinds of practices that big-tech companies have committed to influence the implementation of the Digital Market Act in the European Union to create fair competition in the digital economy. Therefore, the purpose of this research is to assess whether Google abuses its dominant position and perform tying agreements in accordance with Article 25 and 15 of Law Number 5 of 1999 and to analyze the competition framework that can effectively regulate competition in the digital economy. The research method that is used is judicial normative which is done by analyzing secondary data using qualitative method. This research found that Google's practice would constitute a violation under Law Number 5 of 1999 and that the competition framework in Indonesia is not sufficient enough to regulate competition in the digital market effectively. Therefore, it is essential for Indonesian competition authorities to enact competition regulations in the digital market that implement per se obligations and have an extraterritorial principle.
