Abstrak :
Tesis ini mengkaji dan membahas topik fenomena Peran Fraksi-Fraksi DPR RI Periode Periode 2014 ndash;2019 dalam Perumusan Ambang Batas Parlemen dalam Undang-Undang Nomor 7 Tahun 2017 tentang Pemilihan Umum. Topik ini berangkat dari adanya upaya pembubaran fraksi DPR RI oleh Gerakan Nasional Pemberantasan Korupsi GNPK karena keberadaan fraksi dinilai banyak berperan di dalam pelaksanaan fungsi, tugas dan wewenang DPR dan dinilai bertentangan dengan UUD 1945. Sehubungan dengan itu, penelitian ini memfokuskan pada salah satu pelaksanaan fungsi DPR, yaitu fungsi legislasi dalam perumusan ambang batas parlemen dalam Undang-Undang Nomor 7 Tahun 2017 tentang Pemilihan Umum. Hal ini diangkat karena di Indonesia, ambang batas parlemen parliamentary threshold/PT merupakan salah satu isu krusial yang cukup alot dibahas. Fraksi DPR RI, yang merupakan kepanjangan tangan partai politik, memegang peran penting dalam perumusan ambang batas parlemen tersebut. Teori yang digunakan dalam penelitian ini adalah teori elite dan teori oligarki. Sementara, penelitian ini dianalisis dari perspektif Ilmu Politik dengan pendekatan rancangan penelitian kualitatif, yaitu jenis penelitian kualitatif, dengan strategi penelitian studi kasus, dan teknik pengumpulan datanya melalui studi dokumen dan wawancara. Sementara, teknis analisis data dilakukan berdasarkan hasil studi dokumen dan wawancara yang digunakan untuk memperdalam analisis. Hasil penelitian menunjukkan bahwa peran fraksi-fraksi DPR RI dalam perumusan ambang batas parlemen dalam Undang-Undang Nomor 7 Tahun 2017 tentang Pemilihan Umum, kuat dan mendominasi. Hal ini sebagaimana terlihat, baik dari aspek penentuan substansi kebijakan maupun aspek pengambilan keputusan. Implikasi teoritis menunjukkan bahwa teori elite Pareto, Mosca, Mills, dan Keller ; dan teori oligarki Michels dalam penelitian ini terbukti dan terkonfirmasi.
This thesis examines and discusses the topic of the Role of Factions of the DPR RI of 2014 ndash 2019 Period in the Formulation of Parliamentary Thresholds in Law Number 7 of 2017 on General Election. This topic is based on the effort to dissolve factions of the DPR RI by the National Movement for Corruption Eradication GNPK because while its existence is considered to play a significant role in the implementation of the functions, duties and authority of the DPR RI, its existence is also considered to be contradictory to the 1945 Constitution. With those considerations in mind, this research focused on the implementation of one function of the DPR RI, namely its function on legislation in the formulation of parliamentary threshold in Law Number 7 Year 2017 on General Election. This topic was raised because in Indonesia, the parliamentary threshold PT is one of the crucial issues intensely discussed. Factions of the DPR RI, as they are the extension of political parties, plays an important role in the formulation of parliamentary threshold. The theory used in this research is elite theory, oligarchy theory. Meanwhile, this research is analyzed from the perspective of Political Science with qualitative research design approach, that is qualitative research type, with case study research strategy, and data collection technique through document study and interview. Meanwhile, technical data analysis is conducted based on the results of document studies and interviews used to deepen the analysis. The results showed that the role of factions of the DPR in the formulation of parliamentary threshold in Law Number 7 of 2017 on General Election, was strong and dominating. This is as seen, both from the aspect of determining the substance of policy and decision making aspects. Theoretical implications show that elite theory Pareto, Mosca, Mills, and Keller and Michels rsquo oligarchy theory in this research is proven and confirmed.

Tesis ini membahas tentang penanganan perkara tindak pidana Pemilu khususnya menyangkut koordinasi antara Panwaslu, Kepolisian dan Kejaksaan yang tergabung dalam Sentra Gakkumdu dengan titik beratnya adalah peran kejaksaan dalam penanganan perkara tindak pidana Pemilu. Metode penelitian yang digunakan dalam tesis ini adalah yuridis normatif yang ditunjang dengan pendekatan perundang-undangan dan konsep. Pengumpulan data dilakukan melalui studi kepustakaan dan selanjutnya diolah secara deduktif. Hasil penelitian ini menyimpulkan bahwa dalam penanganan perkara tindak pidana Pemilu Legislatif 2009 yang dilakukan oleh Panwaslu, Kepolisian dan Kejaksaan adalah membuat Kesepahaman Bersama tentang Pola Penanganan Perkara Tindak Pidana Pemilu dan Pembentukan Sentra Penegakan Hukum Terpadu sebagai usaha untuk mengefektifkan penanganan perkara tindak pidana Pemilu. Dalam penanganan perkara tindak pidana Pemilu, Kejaksaan yang mempunyai peran sebagai bagian dari sistem peradilan pidana terpadu dan sebagai bagian Sentra Gakkumdu mempunyai berbagai permasalahan dalam melaksanakan fungsinya. Namun yang dapat digarisbawahi dalam penanganan perkara tindak pidana Pemilu Legislatif 2009 adalah adanya reposisi peran kejaksaan sebagai upaya untuk percepatan penanganan perkara pidana dan sebagai usaha rekonstruksi Penegakan Hukum Tindak Pidana Pemilu.
The thesis discusses the administration of criminal offenses associated to the General Election specifically in aspects related to the coordination between coordination of the Election Supervision Committee (Panwaslu), the National Police and the District Attorney Office as part of the Integrated Law Enforcement Center (Sentra Gakkumdu), wherein the emphasis is on the role of the district attorney office in managing election related offenses. The method used in this study is judicial normative augmented by laws and conceptual approaches. Data gathering is done through literature review then deductively processed. This study reveals that for the purpose of managing criminal offenses committed during the 2009 Legislative Election, the Election Supervision Committee (Panwaslu), the National Police and the District Attorney Office have set up a Memorandum of Understanding on the Pattern for Managing Election Related Criminal Offenses as well as establishing the Integrated Law Enforcement Center (Sentra Gakkumdu) in the effort to effectively manage election related criminal offenses. In managing election related criminal offenses, the district attorney office in its role as part of the judiciary system and the Sentra Gakkumdu had to content with a number of obstacles to execute its function properly. Furthermore, throughout the management of election related criminal offenses committed during the 2009 Legislative Election, there was a repositioning of the district attorney office's in the effort to accelerate the management of criminal cases and in the attempt to reform the Criminal Court System.

Skripsi ini membahas strategi anggota legislatif perempuan dalam mengawal ketentuan kuota perempuan di pembahasan RUU Pemilu 2012. Untuk membahas hal tersebut, skripsi ini meggunakan metode kualitatif dengan instrumen wawancara mendalam dan studi dokumen untuk pengumpulan data. Skripsi ini berasumsi bahwa anggota legislatif perempuan bisa dilihat dari 3 aspek, yakni KPP RI, anggota legislatif perempuan di fraksi, dan anggota legislatif perempuan di panitia pembahasan. Temuan penelitian yang diperoleh adalah melalui KPP RI, anggota legislatif perempuan melakukan strategi diskusi internal, audiensi dengan Pansus, audiensi dengan fraksi-fraksi, dan lobi dengan pimpinan partai. Melalui partai politik, anggota legislatif perempuan memperkuat jaringan dengan Divisi Pemberdayaan Perempuan di partai masing-masing, sambil menguatkan lobi kepada pimpinan partai. Anggota legislatif perempuan yang masuk di panitia pembahasan juga melakukan beberapa strategi, diantaranya mempengaruhi secara langsung pembahasan dengan melemparkan usulan dan melakukan perdebatan, juga melakukan lobi di sela-sela rapat dengan fraksi-fraksi lain. Melalui serangkaian strategi tersebut, anggota legislatif perempuan berhasil mempertahankan ketentuan mengenai kuota perempuan dan menambahkan bagian penjelasan dari pasal 56 di UU Pemilu No. 8 Tahun 2012. ......This research is explaining how the strategy of women MPs to keep the quota regulation in General Election Law revision process on 2012. Using qualitative methods, this research use in-depth interview, as well as, document study to collect the data. The assumption built in this research is that the women MPs can be seen from three aspects, which is KPP RI, women MPs in political party, and women MPs in revision committee. This research found that from KPP RI, women MPs make an internal discussion, make an audience with the revision committee, and lobbying the head of political parties. Women MPs in the political party are strenghtening coordination with Woman Empowernment Division, as well as, strenghtening lobby to the head of their each political party. Women MPs in the revision committee are directly influencing the process through debates, and lobbying other MPs to supporting the idea of quota. With those explained strategies, women MPs success to keep the regulation of woman quota in General Election Law Number 8 Year 2012.

[ABSTRAKbr Selama ini pengaruh ideologi terhadap pemberian suara belum banyak diteliti pada konteks Indonesia. Penelitian ini dilakukan untuk mengetahui apakah terdapat pengaruh dari ideologi konservatisme, anti-sekularisme, tradisionalisme, dan sikap terhadap penegakan khilafah-syariah, terhadap pemberian suara pada Pemilu Presiden 2014. Ideologi konservatisme dan anti-sekularisme masing-masing diukur menggunakan skala konservatisme dan anti-sekularisme yang disusun oleh peneliti. Ideologi tradisionalisme diukur menggunakan item-item skala tradisionalisme yang digunakan Asian Barometer Survey Gelombang 3. Sikap terhadap penegakan khilafah syariah diukur menggunakan skala dari Chusniyah (2012). Responden penelitian merupakan 268 mahasiswa UI muslim yang telah memberikan suara pada Pemilu Presiden 2014. Analisis dilakukan dengan menggunakan model persamaan struktural. Hasil penelitian menunjukkan bahwa terdapat pengaruh signifikan dari ideologi konservatisme (t = 1,96, p < 0,05) dan sikap terhadap penegakan khilafah-syariah (t = 1,99, p < 0,05), terhadap pemberian suara. Sementara itu tidak ditemukan pengaruh yang signifikan dari ideologi anti-sekularisme dan tradisionalisme. ;The effect of ideology towards voting choice had not been studied widely in Indonesia context. This research was conducted to see the effect of conservatism, anti-secularism, traditionalism, and attitude towards caliphate-sharia to voting choice in Presidential Election 2014. Conservatism and anti- secularism ideology was measured using respectively conservatism scale and anti-secularism scale developed by the researcher. Traditionalism ideology was measured using traditionalism items from Asian Barometer Survey Wave 3. Attitude towards the establishment of caliphate-sharia was measured using scale developed by Chusniyah (2012). There were 268 muslim students of Universitas Indonesia who had given their vote in Presidential Election 2014 as respondents involved in this research. The data was analysed using structural equation modeling. The result showed that there are significant effect from conservatism (t = 1,96, p < 0,05) and attitude towards the establishment of caliphate-sharia (t = 1,99, p < 0,05) to vote choice. Meanwhile, there was no significant effect found from anti-secularism and traditionalism ideology. ;The effect of ideology towards voting choice had not been studied widely in Indonesia context.
