Skrispi ini membahas terjadinya transisi demokrasi di Myanmar. Dengan mengacu kepada teori Samuel P. Huntington mengenai faktor pendorong demokratisasi dan pola transisi demokrasi, skripsi ini berargumen bahwa transisi demokrasi di Myanmar terjadi karena diinisasi oleh rezim yang sedang berkuasa, dan dipengaruhi beberapa faktor pendorong, yaitu 1) krisis legitimasi, 2) faktor ekonomi, 3) perubahan keagamaan, 4) perubahan kebijakan pelaku eksternal dan 5) efek demonstrasi. Melalui penelitian kualitatif dan studi literatur skripsi ini menemukan bahwa proses transisi demokrasi di Myanmar dimulai setelah liberalisasi awal yang dilakukan oleh rezim militer pada tahun 2007, dan dilanjutkan oleh pemerintahan baru yang dipimpin Thein Sein pasca pemilihan umum 2010. Sepanjang 2011-2016, pemerintahan Thein Sein yang melibatkan koalisi militer dan sipil transisi demokrasi terbatas di Myanmar melalui penerapan kebijakan reformasi politik dan ekonomi. Dari temuan tersebut skripsi ini menyimpulkan bahwa pola transisi demokrasi Myanmar yang diinisiasi oleh rezim militer dan diterapkan secara terbatas dibawah pengaruh kuat militer dan pelibatan kelompok opisisi dalam pemerintahan Thein Sein merefleksikan ciri model transformasi. ......This thesis discusses the occurrence of democratic transition in Myanmar. Referring to Samuel P. Huntington’s theory regarding the driving factors for democratization and the pattern of democratic transition, this thesis argues that the democratic transition in Myanmar occurred because of the initiatied by the ruling regime and influenced by several factors, such as 1) legitimacy crisis, 2) economic factors, 3) religious changes, 4) changes in policies of external actors and 5) demonstration effects. Through qualitative research and literature study, this thesis finds that the democratic transition process in Myanmar began after the initial liberalization carried out by the military regime in 2007, and continued by a new government led by Thein Sein after the 2010 general election. During 2011-2016, Thein Sein’s government involving military and civil coalitions of limited democratic transition in Myanmar through the implementation of political and economic reform policies. From these findings, this thesis concludes that the pattern of Myanmar’s democratic transition initiated by the military regime and implemented in a limited manner under the strong influence of the military and the involvement of opposition groups in Thein Sein’s government reflects the characteristics of the transformation model.

This is about the law of reflective in the thoughts of Jurgen Habermas. A deliberative democracy and a law of positivism are legitimate for consensus of the society, economy, and the nation. Utilizing his idea on a deliberative democracy, Habermas answers the unsolved problems posed by the ideology critiques on the instrumental rationality used by the Western constitution systems. His theory may also be applied to establish democracy within the Eastern values of the Asian societies, like Indonesia, which uses certain traditional values in the systems of the constitution.

Abstrak :
What is the relationship between the strength of a country's democracy and the ability of its courts to address deficiencies in the electoral process? Drawing a distinction between democracies that can be characterised as 'dominant-party' (for example Singapore, Malaysia, and Hong Kong), 'dynamic' (for example India, South Korea, and Taiwan), and 'fragile' (for example Thailand, Pakistan, and Bangladesh), this book explores how democracy sustains and is sustained by the exercise of judicial power. In dominant-party systems, courts can only pursue 'dialogic' pathways to constrain the government's authoritarian tendencies. On the other hand, in dynamic democracies, courts can more successfully innovate and make systemic changes to the electoral system. Finally, in fragile democracies, where a country regularly oscillates between martial law and civilian rule, their courts tend to consistently overreach, and this often facilitates or precipitates a hostile take-over by the armed forces, and lead to the demise of the rule of law

Why have Taiwan, rich parts of China, and Thailand boomed famously, while the Philippines has long remained stagnant both economically and politically? Do booms abet democracy? Does the rise of middle "classes" promise future liberalization? Why has Philippine democracy brought no boom and barely served the Filipino people? This book, unlike most previous studies, shows that both the roots and results of growth are largely political rather than economic. Specifically, it pays attention to local, not just national, power networks that caused or prevented growth in the four places under consideration. Violence has been common in these polities, along with money. Elections have contributed to socio-political problems that are also obvious in Leninist or junta regimes, because elections are surprisingly easy to buy with corrupt money from government contracts. Liberals should pay more serious theoretical attention to the effects of money on justice, and Western political science should focus more clearly on the ways non-state local power affects elections. By considering the effects on fair justice of local money and power (largely from small- and medium-sized firms that emerge after agrarian reforms), this book asks democrats to face squarely the extent to which electoral procedures fail to help ordinary citizens. Students and scholars of Asia will all need this book - as will students of the West whose methods have become parochial.
