Tesis ini membahas tentang kekuatan hukum dekrit presiden yang pernah diberlakukan di Indonesia sebagai produk keputusan presiden dalam keadaan darurat. Metode penelitian yang digunakan adalah metode penelitian hukum normatif. Hasil penelitian ini menunjukkan bahwa efektivitas dekrit yang dikeluarkan oleh presiden akan sangat ditentukan oleh dukungan berbagai kalangan dalam pelaksanaannya, sekalipun tidak ditemukan landasan pengaturannya dalam konstitusi. Di masa yang akan datang, presiden seharusnya tetap tunduk pada ketentuan konstitusi dan segala tindakan yang diambil dalam masa pemberlakuan keadaan darurat harus dapat diuji oleh lembaga peradilan. ...... The focus study of this thesis is the legal force of presidential decree in Indonesia as a product of the president's decision in the state of emergency. This thesis is a normative research. Result of this research indicates that the effectiveness of the implementation of a decree will be determined by the acceptance of various groups, even though it can not found the constitutional basis. The researcher suggest that the president should remain subject to the provisions of the constitution and all actions taken during the state of emergency must be reviewed by the courts in the future.
