"Sistem gilir ganti sawah menjadi salah satu penyebab rendahnya capaian realisasi sertipikasi tanah dalam program PTSL di Kabupaten Kerinci. Pemerintah melalui Permen ATR/BPN No 9 tahun 2015 telah memfasilitasi masyarakat pemilik sawah gilir ganti untuk memiliki sertipikat dengan keseluruhan nama pemilik tercantum dalam sertipikat tersebut. Penelitian ini bertujuan untuk mengidentifikasi dan menganalisis penyebab perilaku masyarakat pemilik sawah gilir ganti yang tidak mau mensertipikatkan sawahnya. Penelitian ini menggunakan rancangan penelitian deskriptif analitik dengan pendekatan kualitatif melalui kuesioner, telaah dokumen dan in depth interview dengan informan yang dipilih dan ditentukan. Penelitian ini menunjukkan bahwa masyarakat pemilik sawah gilir ganti yang tidak mau mensertipikatkan sawahnya karena tidak paham tentang pentingnya sertipikat tanah, tanah gilir tersebut kepunyaan banyak pemilik atau banyak ahli warisnya, masyarakat masih banyak yang belum mengetahui tentang sertipikat tanah komunal, masyarakat tidak mau mensertipikatkan tanahnya dengan alasan tidak diperbolehkan oleh ninik mamak dan tengganai, juga karena ada kebingungan tentang siapa yang akan memegang sertipikat dan nama siapa yang tercantum di dalamnya, dan karena masyarakat merasa terbebani dengan pajak-pajak dan administrasi lainnya jika tanah mereka di sertipikatkan.

The shift system for changing fields is one of the causes of the low achievement of land certification realization in the PTSL program in the Kerinci Regency. The government through Permen ATR/BPN No. 9 of 2015 has facilitated the community of rotating rice field owners to have a certificate with the entire owner's name listed on the certificate. This study aims to identify and analyze the causes of the community owner’s behavior of shifting rice fields who do not want to certify their fields. This study uses a descriptive-analytical research design with a qualitative approach through questionnaires, document review, and in-depth interviews with selected and determined informants. This research shows that the community who owns shifting rice fields who are not interested to certify their fields because they do not understand the importance of land certificates, the rotational land has many owners or heirs, there are still many people who do not know about communal land certificates, people do not want to certify their land on the grounds ninik mamak and tengganai are not allowed, the community does not want to certify their land because there is confusion about who will hold the certificate and whose name is on it, and because the community feels burdened with taxes and other administration if their land is certified."

"This thesis discusses the legal position of Creative Commons licenses in accordance with Indonesian copyright law as regulated in Law Number 19 of 2002. This research used prescriptive analysis and juridical normative by describing research and analyzing the issues. Indonesian private law uses open system for every party to make an agreement, as stipulated in Indonesian Civil Code in Article 1338 (I). The open system means that everyone is free to create an agreement as long it fulfills the requirements to make an agreement. Law Number 19 of 2002 regulates copyright in Indonesia including license agreement; however the implementing regulation of Article 47 of the law is yet to be available. Creative Commons license agreement is a tool for on-line sharing that conforms to the copyright concept as regulated in the TRIPs Agreement. Copyright disputes can be settled through three ways, out of court settlement (alternative dispute resolution) as regulated in Law Number 30 of 1999 on Arbitration and Alternative Dispute Resolution, private method through the Commercial Court or criminal procedure. The dispute between Susan Chang v Virgin Mobile, LLC, Virgin Mobile Pty and Creative Commons in the United States for the Northern District of Texas, Dallas Division, is the first case in which Creative Commons stands as one of the Defendants."
