......Indonesia is the largest vegetable oil producer in the world, through the production of palm oil. Although it has contributed positively in generating foreign exchange for Indonesia, palm oil is often indicated to be discriminated against from consumer countries, namely the European Union, the United Kingdom and Switzerland, which set regulations to fulfill climate change commitments under the UNFCCC law. On the other hand, Indonesia's palm oil production activities, although already regulated in a series of regulations and policies, still need improvement, especially in law enforcement and forest and land governance. The WTO agreement as an international regulation allows for environmental protection that should not be carried out arbitrarily, discriminatory or through a disguise restriction. For this reason, it is necessary to make an agreement that can balance climate change commitments and international trade for sustainable palm oil through several bilateral and regional forums.

ABSTRACT
Climate change has become an issue that is increasingly raising concerns. Scientific studies have portrayed the possible detrimental effects it could have towards human life. Consequentially, governments have started to regulate and implement measures in response. States have also convened together and negotiated international legal instruments in order to collectively address climate change. Nevertheless, an issue that remains of concern is compliance. The most recent international legal instrument, which is the Paris Agreement on Climate Change addresses compliance through a Compliance Committee, but limits possible responses in case of non compliance to not include adversarial and punitive responses. This brings the question on how can a State rsquo s citizens ensure that their government indeed complies with obligations and commitments under the climate change regime. In finding the answer to such question, this undergraduate thesis uses the normative juridical method in order to research, then analyse and evaluate a possible solution to the issue of compliance. After using such method, this thesis concludes that a possible solution is to use climate change litigation as a venue to hold governments accountable to their international, as well as national obligations. This is possible in Indonesia through Citizen Lawsuits. Nevertheless, there are external factors that may affect the success of cases, including the time needed for the central or regional government to adhere to court decisions, and how the resulting measure will be implemented and supervised. Therefore, it is suggested for further research to be conducted in order to understand the possibilities of climate change litigation.

As frustration mounts in some quarters at the perceived inadequacy or speed of international action on climate change, and as the likelihood of significant impacts grows, the focus is increasingly turning to liability for climate change damage. Actual or potential climate change liability implicates a growing range of actors, including governments, industry, businesses, non-governmental organisations, individuals and legal practitioners. Climate Change Liability provides an objective, rigorous and accessible overview of the existing law and the direction it might take in seventeen developed and developing countries and the European Union. In some jurisdictions, the applicable law is less developed and less the subject of current debate. In others, actions for various kinds of climate change liability have already been brought, including high profile cases such as Massachusetts v. EPA in the United States. Each chapter explores the potential for and barriers to climate change liability in private and public law"-- Provided by publisher. Contents Machine generated contents note: Part I. Abstrak :
"This examination of the role of litigation in addressing the problem of climate change focuses not only on how the massive and growing number of lawsuits influences regulation directly but also on how the lawsuits shape corporate behavior and public opinion. It provides readers with an understanding of how these lawsuits have shaped approaches to mitigation and adaptation and have been used to try to force and to block regulation. There is a particular emphasis on lawsuits in the United States and Australia, the two jurisdictions that have had the most climate change litigation in the world, and the lessons supply broader insights into the role of courts in addressing climate change"--

Abstrak :
In Climate change from a criminological perspective, a panel of pioneering green criminologists investigates an increasingly complex chain of ecological causes and effects. Illegal acts are analyzed as they contribute to environmental decline (e.g., wildlife poaching) or result from ecological distress (e.g., survival-related theft). Regulatory and other interventions are critiqued, concepts of environmental harm refined, and new research methodologies called for. And while individual events described are mainly local, the contributors keep the global picture, and substantial questions about human rights and social relationships, firmly in mind. Topics featured include : global warming as corporate crime. Climate change and the courts : U.S. and global views. Climate change, natural disasters, and gender inequality. The roles and responsibilities of environmental enforcement networks. A sociocultural perspective on climate change denial. PLUS: instructive in-depth chapters on criminological aspects of Hurricane Katrina and the Japanese nuclear disaster.
