Abstrak :
Penelitian ini adalah efektifitas strategi anti Fraud Bank Indonesia (2011) sebagai bentuk pencegahan kejahatan perbankan. Tujuan penelitian ini adalah untuk menganalisis prospek keberhasilan Surat Edaran Bank Indonesia No.13/28/DPNP tentang Penerapan Strategi Anti Fraud bagi Bank Umum menurut pendapat para ahli dibidang perbankan di Indonesia. Metodologi yang digunakan dalam penelitian ini adalah teknik Delphi yaitu sebuah metode menyusun sebuah proses komunikasi kelompok sehingga proses tersebut membantu dalam pengelompokkan pendapat sebagai suatu kesatuan dalam menghadapi permasalahan penelitian dengan melibatkan beberapa pakar. Hasil penelitian menyimpulkan bahwa strategi anti Fraud Bank Indonesia 2011 adalah prospektif. Pilar pencegahan dinilai memiliki prospek karena programprogram tersebut merupakan langkah-langkah yang sesuai dengan kepentingan bank dalam menciptakan lingkungan dan budaya kerja yang profesional tanpa kecurangan. Pilar deteksi dinilai memiliki prospek didasarkan pada kepentingan bank dalam mengkoreksi setiap kegiatan bisnis dengan setiap perencanaan guna pencapaian tujuan bisnis bank agar efektif dan efisien. Pilar investigasi, pelaporan dan sanksi dinilai prospek guna pemeliharaan kinerja tanpa kecurangan dengan memberikan efek jera bagi si pelaku kecurangan dan memberikan efek kehatihatian bagi para karyawan bank untuk mempertimbangkan ulang atas perbuatan kecurangan yang mungkin akan dilakukannya. Pilar evaluasi, pemantauan dan tindak lanjut dinilai prospek di dalam rangka untuk memberikan evaluasi berkelanjutan terhadap potensi-potensi terjadinya kecurangan dalam bank dalam jangka panjang.
Abstract
This study is about the effectiveness of antifraud strategy of Bank Indonesia (2011) as a form of crime prevention. The purpose of this research is to analyze of the prospect of Surat Edaran Bank Indonesia No. 13/28DPNP about the implementation of antifraud strategy for commercial bank in according to expert?s opinion in Indonesia. The methodology used in this research is Delphi technique, a method for formulating a group communication process which assist grouping experts opinion as a whole. The research result revealed that the antifraud strategy of Bank Indonesia 2011 is considered as prospective. The prevention pillar is appreciable prospect since that programs is the efforts in line with the bank?s interest in creating the environmental and cultural work with the high professionalism without the fraud. The detection pillar is appreciable prospect since that programs assisted in correcting every business activities in according to every planning in order to meets the business goals to be effectively and efficient. The investigation, reporting and sanction pillars are appreciable prospect since that programs can give the wary for employees to consider for fraud will be done in the future. And evaluation, monitoring and following are appreciable prospect in order to run continuously improvement in handling potential fraud in a bank in long term.

Banking crime phenomenon recently occurs by vreaking the Automatic Teller Machine as conducted by the criminal has created unsafe feeling amongst community specially for bank's customer. There are some typical methods used in the crime operation such as using skimmer, cloning credit card, cloning ATM card and stealing Personal Identification Number by hidden-camera and card reader installing on the machine. This type of electronic transaction crimes (e-banking) has been technically improved along with the highly development of technology in electronic banking transaction. The Act No. 11 year of 2008 regarding Information and Electronic Transaction has been attempted to cover and anticipate the accurrence of electronic crime. In practice, however, there is sort of constraint in implementing the law since such articles have called as grey are or having different meaning in perception of legal institution, so there requirement for another legal remedy in form of legal interpretation. In case the Judge unwilling to search for another legal interpretation but prefers to apply streams of legism then sociologically the law would not catch the highly e-banking crime.

Banking crime was is an story. However, at any time the story may be blown up on the surface as new crime story like the automatic teller machine breaking which happenned in Jakarta and Bali in the last view months ago. As likely and iceberg story, the case of breaking ATM is just a peak of iceberg, there may many unseen crime stories that we have never known whether in total capital lose or in total customer disadvantaged. The main stream of action can be varied amongst intelectual actors and direct crime perpetrators, thus there are possibly become a global crime network. The breaking ATM has become a test case of law No. 11 year 2008 regarding Information and Electronic Transaction. International syndication did the action of breaking automatic teller machine using such method such as, skimming, ATM cloning, stealing Personal Identification Number (PIN), credit card cloning, installing camera or card reader to copy the PIN. The question now are, why occured the ATM breaking undetected until the accumulated lose reached for billions of rupiah? How far banking security system works to protect bank customer and credit card holder? Then, how wide the impact of the ATM breaking case on bank rush?
