In connection with the widespread occurence of the problem of land disputes that exist in Indonesia, on the basis of these facts the authors tried to examine the case of overlap (overlapping) that occured in Cilandak, South Jakarta between Fredy Gozali and Debby Yulita of land with buildings in Cilandak, South Jakarta, covering an area of 550 m2, This case stems from land state purchased by Debby Yulita of Robert Tumiwa under the Sale and Purchase Agreement Deed and Land Rights No. 56, dated on April 26, 2007 are made in the presence of R. John Sarwonom SH, Notary/PPAT in Jakarta, after that, Debby Yulita apply for rights to land to get a certificate of land rights on his behalf of Fredy Gozali. The problems are how the legal effect of the cancellation of certificate of land rights because of overlapping by the South Jakarta District Court No. 438.PDT.G/2008/PN.JKT.SEL, dated August 14, 2008 and how the responsibilities of the Land Office in South Jakarta municipality in solving problems of overlapping disputes that occured. Research used in research on the writing of this law is a legal research library that is judical normative, while the typology of research used in this study is descriptive prescriptive. This thesis are describe about the legal consequences that occured and responsibilities of the Land Office Municpality of South Jakarta after a case of overlap (overlapping) based on South Jakarta District Court that the status of the soil back into the ground state and do write-off on behalf of the Land Book Fredy Gozali and publishing rights certificate land of behalf of Debby Yulia.

Pendaftaran tanah adalah suatu kegiatan yang dilakukan untuk mendapatkan hak atas tanah dan pendaftaran tanah diatur dalam Undang-Undang Pokok Agraria dan Peraturan Pemerintah No 24 tahun 1997 sebagai penyempurnaan dari PP no 10 di 1961 tentang pendaftaran tanah, pendaftaran tanah di Indonesia menghasikan satu sertifikat sebagai alat pembuktian yang kuat dalam hal kepemilikan tanah dan pendaftaran tanah bertujuan untuk memberikan jaminan kepastian hokum, tetapi dalam kenyataannya tidak dapat secara optimal dalam hal memberikan jaminan kepastian hukum kepadan seseorang, tidak adanya jaminan kepastian hokum yang mutlak yang diberikan oleh peraturan kepada pemegang hak atas tanah kemudian dapat menyebabkan timbulnya masalah dikemudian hari yang didasari dari tidak adanya kepastian hukum. Untuk dapat memberikan suatu kepastian hukum perlu dilakukan suatu perubahan peraturan hukum yang mendasar dan sistem pendaftaran tanah di Indonesia.
The registration of the land was an activity that was carried out to get the upper right of a land and the registration of the land in arranged of the main regulations of Agriculture and the Government Regulation no 24 in 1997 as the finishing from PP no 10 in 1961 about the registration of the land, the registration of the land in Indonesia produced one certificate as the authentication implement that was strong on ownership of a land and the registration of the purposeful land to give the assurance guarantee of the law but in matter of fact was not realized optimally in the matter gave the legal guarantee to someone. The nonexistence of the assurance guarantee of the absolute law that was given by regulations to the holder of land rights then will cause a problem that was caused in afterward the day because of the assurance of the law was the aim of the foundation of the Registration of this land. Then to be able to give the assurance law guarantee this needed to be carried out by a good change in the regulation and system available in Indonesia.

Undang-undang dasar pokok agraria (UUPA) terbentuk sebagai nasionalisasi dari undang- undang yang telah ada sejak jaman penjajahan. Dasar terbentuk UUPA adalah untuk menjamin kepastian hukum bagi pemilik hak atas tanah. UUPA mengatur konversi hak-hak tanah bekas hak barat menjadi hak atas tanah yang diatur dalam UUPA. Pokok permasalahan yang dibahas penulis adalah konversi tanah bekas hak eigendom yang merupakan tanah hak milik lama menjadi tanah hak milik baru sesuai UUPA. Cara perolehan pembuktian hak lama atas tanah menurut penjelasan pasal 24 Peraturan Pemerintah Nomor 24 tahun 1997 ada dua macam cara yaitu berdasarkan pembuktian pemilikan tanah dan berdasarkan pembuktian penguasaan tanah. Proses pendaftaran pertama kali dilakukan di Badan Pertanahan nasional untuk mendapatkan sertipikat hak atas tanah. Penerbitan sertipikat oleh Badan Pertanahan Nasional bersifat konstitutif, yaitu keputusan administrasi pemerintah yang menimbulkan akibat hukum. Akibat hukumnya adalah negara menjamin dan melindungi pemegang sertipikat hak atas tanah.Berdasarkan kasus yang ditinjau bahwa penguasaan tanah bekas hak eigendom oleh tergugat yang telah mendiami tanah tersebut selama 20 tahun dan dengan itikad baik tidak dapat dibatalkan. Sertipikat yang telah dikeluarkan tidak dapat dengan mudah dibatalkan, apabila sertipikat tersebut telah berusia lima tahun ataupun lebih.Sertipikat hak atas tanah merupakan alat bukti yang kuat. Terhadap pihak ketiga tanggung jawab diberikan kepada siapa perjanjiannya dibuat. Pihak yang mengadakan perjanjian dianggap yang mempunyai tanggung jawab bila terjadi permasalahan dikemudian hari
Basic Constitution of Agrarian was made as a nasionalitation from another constitution in the colonial decade. The base of basic constitution of agrarian is to guaranty law assurance for landlord. Basic constitution of agrarian regulate is to convert west land right become land right that manage by basic constitution of agrarian. The main concern that written by the author is the convert eigendom right which is old land right become new land right that regulate by basic constitution of agrarian. The procedure of this conversion manage by art 24 Government regulation number 24 of 1997, there are two option available, first, proof of ownership of land and second, proof of land ownership. First time land registration in national land agency to having a land certification. The published certificate are constitutif, which means government administration decision that affected legal consequences. The legal consequences is government guaranty dan protect land certificate owner. Based on this case that a eigendom land ownership that be managed twenty years with good faith by defendants can not be canceled. The published certificate can not be easy to canceled, although the certificate more than five years.Land right certificate is a strongest proof. For third party the liability is for who the agreement was made. The party that have an agreement should take responsibility for future circumstances.

This dissertation examines the question of justice in the implementation of the Right of Indonesia Nations and the Right of State to Control in agrarian legal policy domain since post independence of 1945 to post reformation of 1998 Problems of justice in their manifestation of injustice has become the focus of analysis using Sen rsquo s theory of justice This study belongs the realm of normative legal research or literature The results of the analysis in the three periods of the practice of agrarian legal policy 1945 1965 1965 1998 and 1998 2020 applying the perspective of 39 Matsyanyaya 39 in theory of justice of Sen found the dominant factor causing injustice namely the practice of political dominance of neo imperialism and capitalism Theoretical justification of the relationship between law and politics can be found either in Zamboni 39 s theory or the work of Kahin Tully Pilger Roosa van ittersum Perkins The study provides recommendations in the realm of the theoretical and legal agrarian policy practices In the domain of the theoretical perspective of legal studies this study suggests to review the inconsistencies in the legal and legal policy systems in the agrarian law research and teaching of legal studies realms In the practical domain then the virtual values of Pancasila ought to be implemented in the practice of law in the realm of the executive legislative and judicial branches of government in dealing with domination of neoimperialism neo capitalism and neo liberalism in the practice of agrarian law politics and the entire realms of life.

Tanah adalah aset masyarakat, aset rakyat, dan aset negara, oleh karenanya pemerintah/negara berkewajiban memimpin penggunaan tanah dan mengatur hak atas tanah dimana pengaturan tersebut berpengaruh sekali terhadap pendapatan dan kesejahteraan. Pengaturan tersebut telah dituangkan dalam Undang-undang Nomor 5 Tahun 1960 tentang Pengaturan Dasar Pokok-Pokok Agraria (UUPA) dan sebagai pelaksanaan dari UUPA tersebut pemerintah mengeluarkan UU no 56 PrpTahun 1960 tentang Penetapan Luas Tanah Pertanian dengan Pelaksanaan PP no. 224 Tahun 1961 tentang Pelaksanaan Pembagian Tanah dan Pemberian Ganti Kerugian serta PP No. 41 Tahun 1964, Pasal 1 mengatur adanya larangan Pemilikan Tanah secara Absentee atau Guntai oleh karena adanya pengembangan kawasan Industri di daerah karawang sehingga penelitian ini bertujuan untuk mengetahui bagaimana sebenarnya syarat berlakunya larangan pemilikan tanah absentee (guntai) dan apakah dapat diberlakukan untuk pemilikan kelebihan tanah di kawasan industri serta bagaimana sebenarnya tatacara pembebasan hak atas tanah terkait pemilihan kawasan bagi perusahaan industri.
Penelitian ini menggunakan metode yuridis normatif, dengan menggunakan data primer dan data sekunder yang kemudian dianalisis dengan menggunakan teknik analisis kulitatif.
Hasil penelitian menunjukan bahwa pembuatan suatu penyataan yang harus dilakukan investor perusahaan industri terkait pemilikan tanah industri di kawasan industri dan larangan tanah absentee/guntai mengandung unsur ketidakjelasan informasi dari Notaris/PPAT dan Kantor Pertanahan kepada para investor tersebut dan perlu diadakan koordinasi antara kantor Pertanahan, pengelolakawasan, investor dan PPAT/Notaris sehingga dapat memberikan kejelasan apakah larangan pemilikan tanah absentee/guntai tersebut berlaku atau tidak bagi Kawasan Industri.
Land is a Society asset and national asset, because of that statement, gaverment or country has the obligation of leading the utilize ofthe land which the control of that utilization will be make the effect in goverment income and people prosperity.The obligation has been stated in Law number 5 year 1960 on the Basic Regulation of Agrarian Principles (UUPA) and as an implementation of UUPA, government issued Law no 56 Prp Year 1960 on Stipulation on the Area of Farmland with the implementation of Government Regulation No. 224 Year 1961 on the implementation of Land Distribution and the Provision of Compensation in conjuction with Article (1) Government Regulation No. 41 Year 1964 there is a prohibition for ?Absentee/Guntai land ownership because of the industrial area development in Karawang, Consequently, this research aims to find out how in fact the rules that prohibition for ?Absentee/Guntai land ownership can be valid and is it valid for excess land in industrial area and in fact how the rules of land exemption related with the land ownership in industrial area for industrial company.
This research employs the Juridical Normative methodology, by using primary and secondary data which are later analyzed using the qualitative analysis technique.The result of the research shows that the create of Statement Letter which is done by all director from industrial company and prohibition for ?Absentee/Guntai land ownership contains unclear information from the Notary/PPAT and official from Agrarian Office. It is necessary to conduct coordination between Notary/PPAT,Official from Agrarian Office and Industrial Land Developer until it gets the clarity that a prohibition for ?Absentee/Guntai land ownership can be valid or not for industrial company in industrial area.
