"Tulisan ini menganalisis bagaimana transaksi pemanfaatan Barang Milik Negara dilaksanakan melalui fasilitas (project development facility) yang dilaksanakan oleh badan usaha milik negara melalui penugasan khusus dapat diimplementasikan secara efektif. Tulisan ini disusun dengan menggunakan metode penelitian doktrinal. Mekanisme pemanfaatan Barang Milik Negara melalui Project Development Facility yang dilaksanakan PT Penjaminan Infrastruktur Indonesia (Persero) yang mendapatkan penugasan khusus bertujuan untuk mendukung optimalisasi aset negara guna meningkatkan penerimaan negara dan penyediaan infrastruktur publik. Sinergi antara PT Penjaminan Infrastruktur Indonesia (Persero) sebagai pelaksana project development facility dan pemerintah sebagai pemberi penugasan mencerminkan tata kelola yang baik, transparansi, dan akuntabilitas, sehingga memastikan pemanfaatan Barang Milik Negara berjalan optimal sesuai regulasi dan memberikan manfaat maksimal bagi negara. Tulisan ini juga menganalisis Peraturan Menteri Keuangan Nomor 18 Tahun 2024 tentang Tata Cara Pemberian Fasilitas Penyiapan dan Pelaksanaan Transaksi Pemanfaatan Barang Milik Negarasebagai regulasi yang mengatur mengenai project development facility. Dengan menggunakan Pedoman 6 Dimensi, evaluasi ini menilai kesesuaian regulasi berdasarkan prinsip Pancasila, ketepatan jenis peraturan, harmonisasi aturan, kejelasan rumusan, asas bidang hukum, dan efektivitas pelaksanaan.

This paper analyzes how state property utilization transactions implemented through facilities (project development facilities) carried out by state-owned enterprises through special assignments can be implemented effectively. This paper is prepared using doctrinal research methods. The mechanism of utilization of State Property through the Project Development Facility implemented by PT Penjaminan Infrastruktur Indonesia (Persero) which received a special assignment aims to support the optimization of state assets in order to increase state revenue and the provision of public infrastructure. The synergy between PT Penjaminan Infrastruktur Indonesia (Persero) as the implementer of the project development facility and the government as the assignor reflects good governance, transparency, and accountability, thus ensuring that the utilization of state property asset runs optimally according to regulations and provides maximum benefits to the state. This paper also analyzes the Minister of Finance Regulation Number 18 of 2024 concerning Procedures for Providing Facilities for the Preparation and Implementation of State Property Utilization Transactions as regulations governing project development facilities. Using the 6-Dimensional Guideline, this evaluation assesses the suitability of regulations based on the principles of Pancasila, the accuracy of the type of regulation, the harmonization of rules, the clarity of formulation, the principles of the legal field, and the effectiveness of implementation."
