Abstrak :
Tesis ini membahas mengenai kewajiban dan perlindungan hukum terhadap saksi - saksi dalam peresmian akta notaris. Kekosongan hukum mengenai pengaturan kewajiban dan perlindungan saksi - saksi dalam akta notaris memberikan masalah tersendiri terkait dengan profesi Notaris yang merupakan profesi yang berdasarkan kepercayaan. Penelitian ini menggunakan pendekatan yuridis normatif dengan spesifikasi tipologi penelitian preskriptif. Yuridis normatif digunakan untuk mengkaji berbagai norma hukum yang berhubungan dengan jabatan Notaris dan kewajiban serta perlindungan hukum bagi saksi - saksi dalam akta Notaris. Tipologi penelitian preskriptif memberikan solusi dalam permasalahan mengenai kewajiban dan perlindungan hukum terhadap saksi - saksi dalam peresmian akta notaris. Hasil penelitian ini menunjukkan bahwa kewajiban dan perlindungan hukum terhadap saksi - saksi dalam peresmian akta Notaris penting untuk diatur secara jelas. Tanpa adanya pengaturan yang jelas mengenai kewajiban saksi dalam akta Notaris, khususnya mengenai kewajiban merahasiakan isi akta dan perlindungan hukum yang jelas bagi saksi dalam akta Notaris saat harus berhadapan dengan proses peradilan, hal tersebut akan mengganggu kredibilitas jabatan Notaris dalam kewajibannya menjaga kerahasiaan akta.

This thesis discusses the liability and legal protection of witnesses in the inauguration of the notary deed. Legal vacuum on liability and protection of witnesses of notary deed provides its own problems associated with the Notarial profession as a profession that is based on trust. This study uses normative juridical approach to research and prescriptive typology specifications. Normative juridical used to assess various legal norms relating to the Notary function and the liabilities and legal protection for witnesses of the notarial deed. Typology prescriptive research provides solutions of problems regarding liability and legal protection of witnesses in the inauguration of the Notary deed. The results of this study indicate that the liability and legal protection of witnesses in the inauguration of the notary deed is important to set clear. Without a regulations on the liability of witnesses in the notarial deed, especially regarding the contents of the deed secrecy liability and legal protection for witnesses in a notarial deed when it comes to dealing with the judicial process, it will affect the credibility of Notary function in obligations of the deed confidentiality.
