ABSTRACT
Fokus dari tesis ini adalah untuk membahas tentang perbandingan terhadap
hukuman mati di Indonesia dan Belarusia. Belarusia merupakan satu-satunya
negara di Eropa yang belum menghapus hukuman mati, terlepas dari tuntutan dari
Amnesti Internasional atau Perserikatan Bangsa-Bangsa. Hukuman mati di
Indonesia dan Belarusia menjadi hal yang kontroversial karena ada banyaknya pro
dan kontra yang muncul dalam implementasi terhadap hukuman mati di kedua
negara. Tujuan dari tesis ini adalah untuk memahami apakah hukuman mati
bertentangan dengan UUD 1945 sebagai dasar negara atau tidak, serta untuk
memahami lebih lanjut apa saja upaya yang telah dilakukan oleh pemerintah
Belarusia untuk menerapkan hukuman mati mereka, terlepas dari pro dan kontra
yang muncul di negeri ini.
The focus of this thesis is about the comparison of abolishment of death penalty in
Indonesia and Belarus. Belarus is the only country in the Europe region that has
not abolished death penalty, despite all the pressure that came from the Amnesty
International or the United Nations regarding the abolishment of death penalty.
Death penalty in Indonesia and Belarus became a controversial matter since there
are many pros and contras arises to the implementation of death penalty in both
countries. The purpose of this thesis is to understand whether or not death penalty
is contrary to the 1945 Constitution as the foundation the country, as well as to
understand further what are the efforts that has been made by Belarus government
in order to implement their death penalty, despite of the pros and contras that
arises in the country.
