Abstrak :
Karya seni merupakan bagian dari masyarakat yang merepresentasikan identitas atau budaya suatu masyarakat, baik itu secara individu atau komunal. Lahir dari pemikiran manusia, lalu diekspresikan atau difiksasi ke dalam bentuk nyata dan si pencipta atau pemilik karya tersebut bisa merasakan manfaatnya. Walaupun berawal dari sebuah ide yang bersifat abstrak, dapat berubah menjadi nilai ekonomis dan juga nilai moral yang akhirnya memberikan si pencipta suatu hak eksklusif yang disebut dengan istilah Hak Kekayaan Intelektual, atau dalam kasus ini yang lebih spesifik disebut dengan Hak Cipta. Dengan berkembangnya zaman, karya seni dapat dipublikasikan baik secara konvensional atau digital. Ditambah dengan kemajuan teknologi yang memberikan akses untuk karya cipta secara global. Setiap orang dapat menikmati karya cipta dari pencipta yang berasal dari negara manapun. Tentunya, semakin banyaknya karya cipta yang dapat dinikmati, muncul juga konsekuensi berbentuk tindak pelanggaran hak cipta atau penyalahgunaan karya cipta. Salah satu bentuk tindakan tersebut yang paling umum adalah tindakan plagiarisme. Terutama dengan bantuan teknologi yang memudahkan proses plagiarisme ini. Tindakan pelanggaran hak cipta ini, dapat terjadi baik dalam ranah nasional atau internasional. Apabila dalam ranah nasional, maka yang mengatur tentang perihal pelanggaran hak cipta adalah hukum domestik negara tersebut. Apabila sudah terjadi dalam ranah internasional atau lintas batas negara, maka perihal ini diatur dalam Berne Convention for Protection of Literary and Artistic Works. Konvensi ini telah menjadi tonggak utama dalam pelindungan hak cipta terhadap karya-karya seni dan juga literasi. Dengan menggunakan metode penelitian yuridis normatif, tulisan ini akan menganalisis mengenai bagaimana pelindungan hukum hak cipta terhadap koreografi tari modern diatur menurut Konvensi Berne dan Undang-Undang No. 28 Tahun 2014 tentang Hak Cipta dan bagaimana aspek-aspek hukum perdata internasional dalam pelindungan hak cipta terhadap koreografi tari modern. ......Artwork is a part of society which represents the identity or culture of a society, either individually or communally. Born from human thoughts, then expressed or fixed in a tangible form and the creator or owner of the work can receive the benefits. Even though it starts with an abstract idea, it can turn into economic value as well as moral value which ultimately gives the creator an exclusive right called an Intellectual Property Right, or in this case, more specifically, is called copyright. With the development of times, works of art can be published either conventionally or digitally. Added with technological advances that provide access to copyrighted works globally. Everyone can enjoy copyrighted works from creators from any country. Of course, the more copyrighted works that can be enjoyed, the consequences will appear in the form of copyright infringement or misuse of copyrighted works. One of the most common forms of such action is plagiarism. Especially with the help of technology that facilitates this plagiarism process. This act of copyright infringement can occur either in the national or international realm. If it is in the national realm, what regulates copyright infringement is the country's domestic law. If it has occurred in the international sphere or across national borders, then this matter is regulated in the Berne Convention for the Protection of Literary and Artistic Works. This convention has become a major milestone in the protection of copyrights for works of art and also literacy. Using normative juridical research methods, this paper will analyze how copyright law protection for modern dance choreography is regulated according to the Berne Convention and Law no. 28 of 2014 concerning Copyright and how are aspects of international private law in the protection of copyrights for modern dance choreography.
