Skripsi ini memberikan analisis terhadap putusan Mahkamah Agung tentang keberatan Komisi Pengawas Persaingan Usaha terhadap putusan Pengadilan Negeri Bandung Nomor 1/Pdt.G/KPPU/2014/PN Bdg yang pada pokoknya menyatakan bahwa tidak terjadi pelanggaran Pasal 15 ayat 2 Undang-Undang Nomor 5 Tahun 1999. Pada tahun 2013 KPPU mengeluarkan putusan yang pada pokoknya menyatakan bahwa PT Angkasa Pura II yang turut bekerja sama dengan PT Telkom mewajibkan mitra usahanya di Bandara Soekarno-Hatta untuk menggunakan produk Electronic Point of Sales e-POS yang kemudian terhadap putusan tersebut para Terlapor mengajukan keberatan ke Pengadilan Negeri Bandung dan kemudian dilanjutkan dengan pengajuan keberatan oleh KPPU di tingkat Kasasi. Dengan menggunakan metode penelitian hukum normatif dalam skripsi ini, ditemukan bahwa dalam memutus perkara nomor 482.K/Pdt.Sus-KPPU/2015, Majelis Hakim telah keliru dalam mempertimbangkan ketepatan dari pertimbangan Hakim Judex Facti.

ABSTRACT
This thesis provides an analysis of the Supreme Court ruling on the Commission for the Supervision of Business Competition objections against the decision of the Bandung District Court Number 1 Pdt.G KPPU 2014 PN Bdg, which essentially states that no violation of Article 15 paragraph 2 of Law No. 5 of 1999. In 2013, the Commission for the Supervision of Business Competition issued a ruling that fundamentally states that PT Angkasa Pura II who works together with PT Telkom obliges its business partners at Soekarno Hatta Airport to use Electronic Point of Sales e POS product which then upon that decision, the reported party filed an objection to the Bandung District Court and then proceed with the filing of objections by the Commission for the Supervision of Business Competition at the level of Cassation. Through the use of normative legal research methods in this thesis, it has been found that in deciding the case Number 482.K Pdt.Sus KPPU 2015, the judges had erred in considering the accuracy of judgment of Judge Judex Facti.
