Abstrak :
Penelitian ini membahas mengenai pendekatan de minimis rule dalam hukum persaingan usaha di Indonesia dan Uni Eropa. Perbandingan tersebut difokuskan dari segi pengaturan serta penerapan pendekatan de minimis rule di dalam putusan. Penelitian ini merupakan penelitian yuridis normatif yang berdasarkan asas-asas norma hukum tertulis dengan cara penggambaran yang deksriptif. Hasil perbandingan tersebut dapat diketahui bahwa di Indonesia penerapan dan pengaturan pendekatan de minimis rule tidak secara eksplisit disebut dalam UU No. 5 Tahun 1999 maupun perundang-undangan terkait lainnya melainkan dapat ditemukan dalam unsur-unsur pasal yang mengatur mengenai batas pangsa pasar yang tidak boleh dilampaui, hal tersebut berbeda dengan Uni Eropa yang sudah mengaturnya secara tegas di dalam Commission Notice yang berjudul “Notice on agreements of minor importance (De Minimis Notice)”. Sehingga berdasarkan perbandingan tersebut dapat diambil beberapa pengaturan di Uni Eropa yang dapat diterapkan untuk perkembangan hukum persaingan usaha di Indonesia. ......This thesis discusses about the de minimis rule approach under competition law in Indonesia and the European Union. The comparison is focused on the regulation of de minimis rule approach and its application. This thesis is the juridical research based on normative principles of legal norms by means of written descriptive representations. The results from the comparison show that in Indonesia the application and regulation of the de minimis rule approach are not explicitly mentioned in Law No. 5 of 1999 and other related laws but can be found in the elements of articles that regulate market share limits that must not be exceeded, its is different from the European Union which has explicitly regulated it in the Commission Notice entitled "Notice on agreements of minor importance (De Minimis Notice) ”. Based on this comparison, some regulations in the European Union can be applied to the regulatory progress of competition law in Indonesia.
