"Terdapat perbedaan pendapat antara DPR dan Menteri Keuangan mengenai pembelian saham divestasi PT Newmont Nusa Tenggara Tahun 2010 oleh Pusat Investasi Pemerintah. Menurut DPR pembelian tersebut memerlukan persetujuan DPR sedangkan menurut Menteri Keuangan tidak perlu. Hal ini memicu Sengketa Kewenangan Lembaga Negara ke Mahkamah Konstitusi. Melalui penelitian yuridis normatif dengan melakukan analisis deskriptif terhadap peraturan perundang-undangan terkait, penulis mencoba menjelaskan kewenangan Pusat Investasi Pemerintah, kategori pembelian saham dimaksud, dan implikasi putusan Mahkamah Konstitusi. Hasilnya, Pusat Investasi Pemerintah secara hukum memiliki kewenangan untuk membeli saham dimaksud tanpa persetujuan DPR sebagai Investasi Surat berharga.

There are differences opinion between the House of representative and the Minister of Finance regarding the purchase of 2010 PT Newmont Nusa Tenggara Divestiture Shares by the Indonesian Investment Agency. According to the House of representative, purchases require their approval, while Minister of Finance opining that is not necessary. It sparked a dispute authority of state institutions to the constitutional court. Through a normative juridical study with a descriptive analysis of the related regulations, the author tries to explain Indonesian Investment Agency authority, category of the purchasing shares mentioned, and the implications of the constitutional court verdicts. As a result, the Indonesian Investment Agency legally has the authority to buy the divestiture shares as Investment Securities without approval of the House of representative."
