Abstrak :
Skripsi ini membahas mengenai adanya dugaan praktek kartel yang dilakukan oleh importir bawang putih. Adanya dugaan praktek kartel ini menurut perkiraan awal KPPU yang melihat terdapat kejanggalan dalam hal distribusi dengan dilakukannya penahanan bawang putih ke pasaran di pelabuhan oleh importir bawang putih, padahal ketika itu pasokan dipasaran sedang langka dan mengakibatkan harga bawang putih naik hingga 5 (lima) kali lipat dari harga normal. Sejauh ini KPPU belum dapat membuktikan kebenaran praktek kartel yang dilakukan oleh para importir bawang putih dan instantsi pemerintahan. Teori pembuktian melalui direct evidence dan indirect evidence yang diamanatkan oleh Peraturan Komisi Pengawas Persaingan Usaha Nomor 04 Tahun 2010 belum bisa membuktikan kebenaran praktek kartel ini dan KPPU belum bisa membuktikan adanya perjanjian yang dilakukan oleh para importir bawang putih. ......This thesis discusses about the alleged cartel practices carried out by the importer garlic.
