"Skripsi ini mengkaji tentang fenomena praktik Rent Seeking antara negara dan bisnis yang terjadi pada tingkat nasional. Adapun studi kasus yang diambil dalam penelitian ini adalah kasus sengketa divestasi saham PT Newmont Nusa Tenggara yang melibatkan beberapa pihak seperti pemerintah pusat, pemerintah daerah, DPR, BPK, hingga Mahkamah Konstitusi. Penelitian ini dilakukan guna melihat bagaimana praktik rent seeking dijalankan dalam kasus ini. Teori rent seeking Tullock (1967) digunakan sebagai teori utama untuk menjelaskan bagaimana rent seeking dapat terjadi dan melalui mekanisme apa praktik rent seeking dalam kasus ini dijalankan. Konsep rent creation, rent extraction, dan rent seizing Michael L. Ross penulis gunakan untuk mengklasifikiasi cara-cara yang digunakan oleh rent seeker dalam melancarkan aksinya. Sementara teori Kruger digunakan untuk melihat penyebab hingga bentuk-bentuk praktik rent seeking yang muncul dalam kasus ini. Temuan penelitian ini memperlihatkan bahwa praktik rent seeking pada kasus sengketa divestasi saham PT Newmont Nusa Tenggara dijalankan oleh tiga aktor yang berbeda. Dalam menjalankan aksinya, dua dari tiga aktor rent seeker tersebut menggunakan cara yang disebut oleh Ross (2001) sebagai rent creation. Mayoritas pelaku lebih memilih untuk menggunakan mekanisme secara frontal dengan mengeluarkan sejumlah dana atau yang disebut oleh Tullock (1967) sebagai transfer cost daripada melakukan pendekatan melalui negosiasi atau lobbying (competing rent).

This thesis examines the phenomenon of Rent Seeking practice between the state and business that occurs at the national level. The case study taken in this research is the case of PT Newmont Nusa Tenggara's share divestment dispute involving several parties such as the central government, local government, DPR, BPK, to the Constitutional Court. This research was conducted to see how the practice of rent seeking is carried out in this case. Tullock's (1967) rent seeking theory is used as the main theory to explain how rent seeking can occur and through what mechanism the practice of rent seeking in this case is carried out. The author uses the concepts of rent creation, rent extraction, and rent seizing Michael L. Ross to classify the methods used by rent seekers in launching their actions. Meanwhile, Kruger's theory is used to look at the causes and forms of rent seeking practices that appear in this case. The findings of this study show that the practice of rent seeking in the case of the PT Newmont Nusa Tenggara share divestment dispute is carried out by three different actors. In carrying out their actions, two of the three rent seeker actors use a method called by Ross (2001) as rent creation. The majority of actors prefer to use a frontal mechanism by issuing a number of funds or what Tullock (1967) calls transfer costs rather than approaching through negotiation or lobbying (competing rent)."
