"Penelitian ini akan membahas mengenai perbuatan melawan hukum yang dilakukan oleh Pers khususnya mengenai tindakan pencemaran nama baik dalam pemberitaan yang dilakukan oleh Pers. Peneliti dalam penelitian ini akan melakukan analisis melalui aspek kebebasan pers dan filosofi Pers itu sendiri. Selain itu, Penulis akan menjelaskan mengenai prosedur yang harus ditempuh untuk menyelesaikan sengketa ataupun perbuatan melawan hukum yang dilakukan oleh Pers baik dari ketentuan-ketentuan yang diatur dalam UU Pers, KUHPerdata dan peraturan perundang-undangan lainnya. Lebih jauh, Penulis akan menjelaskan mengenai penerapan Pasal 1372 dan 1365 KUHPerdata dalam gugatan pencemaran nama baik/fitnah yang dilakukan oleh Pers dan kaitannya dengan penggunaan hak jawab.

This research will discuss the unlawful act committed by the press, especially regarding defamation in the news carried out by the Press. Researchers in this study will conduct the analysis through the aspect of freedom of the press and the philosophy of Press itself. In addition to that, the author will explain the procedures that must be taken to resolve the dispute or unlawful act committed by the Press either by the provisions stipulated in the Law on the Press, the Civil Code and other legislations. Furthermore, the author will explain the application of Articles 1372 and 1365 of the Civil Code in a libel suit / slander conducted by the Press and its relation to the use of the right of reply (Hak Jawab)."
