Abstrak :
Dalam pemenuhan unsur Pasal 11 UU No. 5/1999 yang mengatur tentang kartel, putusan KPPU Nomor 09/KPPU/I/2018 tentang kartel garam industri aneka pangan menyatakan tidak terbukti adanya perbuatan kartel dikarenakan unsur mempengaruhi harga dan dapat terjadinya praktek monopoli dan/atau persaingan usaha tidak sehat tidak terpenuhi. Namun pada putusan kartel garam ini, Majelis Komisi tidak mempertimbangkan tentang keuntungan berlebih yang didapat oleh para terlapor yang dihitung berdasarkan margin keuntungan dari nilai harga beli garam dengan nilai harga jual. Selain itu, Majelis Komisi menilai dampak adanya kartel akan terjadi ketika terdapat kenaikan harga yang signifikan. Di sisi lain, kenaikan harga signifikan ini tidak disebutkan sebagai tolok ukur untuk meloloskan unsur terjadinya praktek monopoli dan/atau persaingan usaha tidak sehat dalam perkara kartel ban dan ayam. Dalam pembuktian unsur-unsur Pasal 11 ini, Majelis Komisi dapat menggunakan bukti ekonomi diluar jangka waktu objek perkara untuk melihat pergerakan perubahan harga dari sebelum dan sesudah kartel.

In fulfilling the elements of Article 11 Law Number 5/1999 which regulates cartels, KPPU decision Number 09/KPPU/I/2018 concerning the cartel of salt for various food industry states that there is no proof of the cartel behavior because the elements of influencing prices and monopolistic practices and or unfair business competition are not fulfilled. However, in the decision of the salt cartel, the Commission Council did not consider the excess profits obtained by the reported parties based on the profit margin from the value of the salt purchase price and the value of the selling price. In addition, the Commission Council assesses that the impact of the cartel will occur when there is a significant price increase. On the other hand, this significant price increase is not mentioned as a benchmark to pass the elements of monopolistic practices and or unfair business competition in the cases of the tire and chicken cartels. In proving the elements of Article 11, the Commission Council can use economic evidence outside the time period of the case object to see the movement of price changes from before and after the cartel.
