"ABSTRACTIndonesia merupakan sebuah negara hukum sebagaimana sudah tertuang dalam UUD 1945. Sebagai negara hukum, hak berpendapat di muka umum juga sudah dijamin dalam pasal 28 Undang Undang Dasar Negara Republik Indonesia Tahun 1945, dimana negara juga bertanggung jawab atas kecerdasan warga negaranya. Namun selama masa Orde Baru dan pasca Reformasi tindakan pembatasan akses informasi dan hak berekespresi di ruang publik masih dilakukan oleh negara. Baik pada masa Orde Baru maupun masa pasca Reformasi Indonesia masih belum berhasil mengaktualisasikan diri sebagai sebuah negara hukum.
