Abstrak :
[Penelitian ini bertujuan untuk mengetahui apa yang menjadi dasar pertimbangan hakim dalam menentukan hak dan bagian waris anak luar kawin yang diakui (studi kasus putusan nomor 752 PK/PDT/2011). Penelitian ini merupakan penelitian hukum yang sifatnya yuridis normatif menggunakan data sekunder yang dapat berupa Peraturan Perundangan dan buku-buku. Kesimpulan yang diperoleh dari hasil penelian ini dapat menjawab permasalahan, anak luar kawin hanya memiliki hubungan dengan ibu dan keluarga ibunya dalam hal keperdataan. Tapi dengan adanya pengakuan dari ayah anak luar kawin, anak tersebut mempunyai hubungan dengan ayah biologisny. Dalam kasus ini perkawinan yang dilakukan serta kedudukan suami dan anak-anak yang dilahirkan dari perkawinan mereka tersebut dan sebagai ahli waris dari pewaris. ......This research aims to find out what the basic consideration in determing the judges and the inheritance rights of children outside marriage recognized (case study Decision No. 752 PK/PDT/2011). This research is a normative juridicial law using of secondary data in the form of laws and regulation and books. The conclusion from this research can answer the problem, illegitimacy only have relationship with the mother and her family in civil case. But with the recognition of the father of the child outside marriage have relationship with his biological father.
