Abstrak :
Skripsi ini membahas mengenai konsep dan pelaksanaan alat bukti tambahan berupa sumpah pelengkap (Suppletoir) yang digunakan dalam proses pembuktian di Pengadilan Agama. Penulisan ini dilatar belakangi oleh penemuan penulis dalam beberapa putusan yang memperlihatkan kesulitan bagi para pihak dalam mengajukan alat bukti selama proses pembuktian terutama dalam perkara perceraian. Penulisan ini mengkaji dua putusan dengan menggunakan metode pendekatan yuridis normatif dan sifat penulisan deskriptif analisis. Berdasarkan hasil kajian, penulis menemukan adanya pemahaman keliru oleh Majelis Hakim mengenai konsep dan pelaksanaan sumpah tambahan tersebut di Pengadilan Agama. Perbedaan konsep dan pelaksanaan sumpah tambahan / suppletoir dengan sumpah pemutus haruslah dipahami baik oleh hakim agar dapat menghasilkan putusan yang tidak menimbulkan tendensi kerugian bagi para pihak.

This thesis discusses the concept and implementation of additional evidence, specifically additional oath (Suppletoir), which is used in the verification or evidence process in the Religious Court.The writing is motivated by the discovery of the author in several court verdicts that show the difficulties for the parties to submit evidence during the verification process, especially in divorce cases.This writing examines two court decisions by using normative juridical approach and descriptive analysis method. Based on the results of the study, the author found an erroneous understanding by the judges of the concept and implementation of the additional oath in the Religious Court. The difference concept and implementation of supplemental oath / suppletoir should be understood well by the judges in order to decide a decision which is not cause a loss tendency for the parties.
