"Setelah diputus pailit maka pengurusan dan pemberesan atas harta debitor pailit dilakukan oleh kurator di bawah pengawasan hakim pengawas dengan tujuan utama menggunakan hasil penjualan harta tersebut untuk membayar utang debitor pailit secara proporsional. Untuk melindungi kreditor maka UUKPKPU menentukan bahwa tindakan debitor pailit yang merugikan budel pailit atau kreditor dapat dibatalkan, yaitu melalui gugatan actio pauliana. Berdasarkan hal-hal tersebut maka permasalahan yang akan diteliti dalam skripsi ini adalah pertimbangan-pertimbangan kurator dalam melakukan gugatan actio pauliana dan pelaksanaan putusan atas perkara actio pauliana yang memenangkan pihak kurator. Metodologi yang digunakan dalam penulisan skripsi ini adalah penelitian kepustakaan.

After pleading of bankruptcy by court, then the management and settlement on the estate of debitor done by curator of bankruptcy under the supervision of a supervisory judge with the main purpose is to use the sale proceeds to pay the debts of debitor proportionally. To protect creditors then the Indonesia's Bankruptcy Law determine the act of debitor which adverse the creditor that can be undone through an actio pauliana lawsuit. Based on those issues then the problems that will be examined in this thesis are the curator of bankruptcy's consideration in the actio pauliana lawsuit and the execution of an actio pauliana’s verdict that won by the curator of bankruptcy. The writing methodology that used in this thesis is literature study."
