"ABSTRAKTesis ini membahas tentang Akta Perjanjian Pemberian Jaminan dan Kuasa dalam rangka pemberian kredit yang memiliki banyak pelanggaran akan tetapi pada prakteknya masih ditemui. Permasalahan yang dibahas yaitu akibat hukum terhadap pengalihan jaminan dalam akta perjanjian pemberian jaminan dan kuasa serta tindakan Notaris untuk mengatasi potensi masalah dalam akta perjanjian pemberian jaminan dan kuasa. Penelitian ini menggunakan metode penelitian berupa penelitian yuridis normatif dengan tipe deskriptif-analitis. Hasil penelitian ini yaitu Akta Perjanjian Pemberian Jaminan dan Kuasa yang berimplikasi pada pengalihan objek jaminan berakibat hukum menjadi suatu perjanjian yang batal demi hukum. Cara yang dapat dilakukan oleh Notaris untuk mengatasi potensi masalah terkait akta tersebut yaitu dengan membuat suatu perjanjian akta kuasa menjual terpisah antara kreditur dan debitur. Pembuatan Akta Perjanjian Pemberian Jaminan dan Kuasa semacam ini seharusnya ditolak oleh Notaris karena berakibat batal demi hukum.

ABSTRACTThe focus of this thesis is about Deed of Guarantee Agreement and Power of Attorney in the framework of granting credits that have many violations legally but in practice is still found. The problems discussed are the legal consequences of the transfer of guarantees in the deed of agreement to grant guarantees and power of attorney, and the actions of the Notary to deal with potential problems in the deed of agreement and authorization. This study uses a research method in the form of normative juridical research with descriptive-analytical type. The results of this study conclude are the Deed of Guarantee Agreement and Power of Attorney that implicates transfer of ownership of collateral object becoming a null and void agreement. A method that can be done by a Notary to overcome potential problems related to the deed, namely by making a deed of power to sell separately between creditors and debtor. Deed of Guarantee Agreement and Power of Attorney should be refused by the Notary because the consequences are null and void."
