Abstrak :
Banyak koperasi di Indonesia gagal karena permasalahan keanggotaan dan permodalan. Undang-undang ditengarai menjadi salah satu penyebab kegagalan tersebut, sehingga RUU Koperasi dirasakan perlu dibuat. Skripsi ini akan membahas mengenai pergeseran keanggotaan dan permodalan antara gagasan-gagasan dan ketentuan undang-undang yang pernah berlaku sejak kemerdekaan yaitu UU Nomor 79 tahun 1958, UU Nomor 14 tahun 1965, UU Nomor 12 tahun 1967, UU Nomor 25 tahun 1992, dan juga RUU Koperasi.

Abstract
Many cooperatives in Indonesia failed due the membership problems and the capital deficiency. Act of cooperatives is suspected as one of the cause of the failure, therefore the new act must be made. The purposes of the thesis is to grasp paradigm shifting between cooperatives idea and the act of cooperatives ever apply in Indonesia since the Independence, i.e. Act No. 79 Year 1958, Act No. 14 Year 1965, Act No. 12 Year 1967, Act No. 25 Year 1992, and also the draft of Cooperatives bill.

Abstrak :
Putusan Mahkamah Konstitusi Nomor 28/PUU-XI/2013 telah mencabut UU Nomor 17 tahun 2012 tentang Perkoperasian. Terdapat 3 (tiga) hal utama yang dipertimbangkan Mahkamah yaitu tentang badan usaha Koperasi, tata kelola organisasi, dan permodalan. Daalm beberapa bagian pertimbangannya, Mahkamah Konstitusi tidak mendasarkan pertimbangannya pada argumentasi hukum yang kuat yang memberikan pengaruh terhadap semakin hilangnya atau semakin kaburnya tujuan Koperasi yang merupakan kekhasan dari Koperasi. ...... Constitutional Court Decision Number 28/PUU-XI/2013 has repealed Law Number 17 year 2012 on Cooperative. There are three main issues which have been considered by Constitutional Court in its decision namely cooperatives as a business entity, the organizational governance of cooperative, and its capital. In several parts, Constitutional Court did not base its argumentation with a strong legal argument which impacts Cooperatives to loose or to unclear Its special nature of entity.
